About this opportunity

The Department of the Army Corps of Engineers, Engineering District New York seeks design and construction of the Port Monmouth Phase II, Contract 1 Mitigation Project through a two-phase design-build procurement, with Phase One proposals due October 21, 2026. Competition is unrestricted and full and open; up to five Phase One offerors advance to Phase Two competitive award.

Place of performance is Port Monmouth, Middletown Township, New Jersey. The project encompasses approximately 34.6 acres of wetland mitigation and restoration across two sites—Pews Creek (22.87 acres of freshwater forested, scrub-shrub, and emergent wetlands with ditch restoration) and Compton Creek (11.74 acres of tidal marsh restoration with low and high marsh, scrub-shrub, and upland rehabilitation)—plus 8.76 acres of upland restoration and 0.12 acre of native grass replanting on the Keansburg Levee. Work also includes clearing, invasive species control, channel excavation, grading, seeding, planting, herbivory fencing, two years of maintenance and monitoring concurrent with five-year monitoring obligations, and compliance with federal, state, and local permits including USACE Federal Consistency, NJDEP Freshwater Wetlands permits, and CAFRA authorizations. Project magnitude is between $15 million and $30 million.

The Design-Build Contractor must commence work within five calendar days of Notice to Proceed and complete within 760 calendar days. The contractor must provide a Professional Wetland Scientist or Certified Ecological Restoration Practitioner with eight years of experience and New Jersey-licensed Professional Engineers. Seasonal restrictions prohibit tree and shrub clearing from March 15 to July 31 under the Migratory Bird Treaty Act, and in-water work at Compton Creek is prohibited from March 15 to June 15 for anadromous fish passage, with potential fall restrictions from September 1 to November 30. Minimum Commercial General Liability insurance is $5,000,000 per occurrence.

Phase One evaluation weighs Relevant Specialized Experience (most important) and Past Performance (equally important secondary factor), both using adjectival ratings. Offerors must submit between two and five construction projects (design firms two to three) with minimum construction costs of $7 million per individual project, completed within 15 years, demonstrating at least one tidal mitigation and one freshwater forested mitigation project, with at least one fully complete and another minimum 75% complete, all achieving 85 percent plantings survivability five years post-completion. Phase One proposals are limited to 30 pages for Tab A.

Phase Two restricts participation to up to five Phase One finalists. Evaluation shifts to Factors 3 (Technical Approach, 20 pages maximum), Factor 4 (Management Approach, 20 pages maximum), Factor 5 (Small Business Participation Plan, 15 pages maximum), and price, with non-price factors combined approximately equal in importance to price. The Government will award a firm fixed-price contract without discussion unless determined in the Government's best interests. Liquidated damages are $3,363.00 per calendar day for schedule delays plus $841.00 per day for incomplete punch list items after beneficial occupancy. Performance and payment bonds are required within 10 calendar days of award; bid guarantee is 20 percent of bid price or $3 million, whichever is less. Amendments 0001 through 0004 (posted October 2, October 19, October 19, and October 20) addressed procedural clarifications, extended the Phase One deadline from October 19 to October 21, and revised RFI responses regarding project magnitude thresholds and past performance evaluation criteria. NAICS code 237990, PSC Y1PZ.
