About this file
This is Amendment 0004 to Solicitation W912DS26RA032, issued by the U.S. Army Corps of Engineers (USACE) New York District on October 20, 2026. The amendment provides revised responses to Offeror's Request for Information (RFI) #18 and does not extend the proposal due date. Offerors must acknowledge receipt of this amendment by the date specified in the solicitation through one of three methods: completing items 8 and 15 on the amendment form, acknowledging receipt on each copy of the offer submitted, or submitting a separate letter or electronic communication that references the solicitation and amendment number. Failure to acknowledge the amendment by the specified deadline may result in rejection of the offer.
The amendment addresses clarifications regarding the solicitation for Design-Build Construction for Port Monmouth Phase II Contract 1 Mitigation in Middletown, New Jersey (Phase 1). Key changes include responses to Questions 12–21 regarding past performance questionnaire requirements, CPARS report submissions, incorporation by reference restrictions, subcontractor information requirements, project relevancy documentation, the $7 million similar-magnitude threshold, evaluation of additional consideration criteria, federal agency project qualifications, and stipend eligibility for short-listed firms. Most significantly, the amendment provides a revised response to Question 18, clarifying that the $7 million figure represents a definition of similar magnitude for each individual project submission rather than a team-wide dollar total or submission minimum, and that projects below $7 million may still demonstrate similar scope and complexity. The Factor 1 rating is assigned to the offeror as a whole rather than to individual projects.

RFI Disclaimer
Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors for information only and do not revise the solicitation, plans, or specifications.
Question 12: Who does the 'Client' refer to for blocks 5-8 in Form A3 - Past Performance Questionnaire (PPQ)?
Government Response 12: Form A3, "Client" means the owner, agency, organization, or other entity for whom the offeror performed the referenced work and who is able to provide informed information regarding the offeror's performance.
Question 13: Are CPARS reports accepted in lieu of, or in addition to, completed Past Performance Questionnaires (PPQs)?
Government Response 13: CPARS reports are not accepted in lieu of Form A3. CPARS reports shall be submitted, when available, in addition to Form A3.
Question 14: The solicitation states: "Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs." Does this restriction apply only to PPQs previously submitted to the New York District, or to PPQs submitted to any USACE district nationwide?
W912DS26RA0320004
Government Response 14: This restriction applies to PPQs previously submitted for any other RFP, including RFPs issued by any USACE district.
Question 15: Are offerors required to provide information on second-tier subcontractors in Form A1?
Government Response 15: No. Offerors are not required to provide information on second-tier subcontractors in Form A1.
Question 16: Are offerors required to provide past project termination information for second-tier subcontractors in Tab B?
Government Response 16: No. Termination or projects issued a cure notice and accompanying information only applies to the offeror, including teaming partners if applicable.
Question 17: May offerors include an appendix to Form A2 with additional information explaining project relevancy?
Government Response 17: Yes. Offerors may include an appendix to Form A2 to provide additional information explaining project relevancy.
Question 18: Does the $7 million "similar magnitude" threshold apply to each project submitted by the contractor and design firm, or is it evaluated based on the team's overall relevant experience?
Government Response 18: The $7 million similar-magnitude threshold applies to each project submitted for consideration. It is not evaluated based on the team's overall combined relevant experience.
Question 19: For the additional consideration criteria, is "majority" determined by the number of project examples submitted? Is this evaluated separately for the contractor and designer, or across the entire proposal?
Government Response 19: For purposes of this solicitation, the "additional consideration criteria" refers to the non-exhaustive list of examples in Tab A, Factor 1, Evaluation Criteria, immediately following the sentence: "Where this experience includes the following, the proposal may be given additional consideration ..."
"Majority" means more than one-half of the project examples submitted under Factor 1. The additional-consideration criteria will be evaluated separately for construction contractor and design firm projects.
Question 20: Would a mitigation project performed for another federal agency qualify for additional consideration if it required a USACE permit or regulatory oversight, or must USACE or NJDEP be the contracting agency or customer?
Government Response 20: No. A project performed for another Federal agency that involved a USACE or NJDEP permit or USACE/NJDEP regulatory oversight is not considered a project "performed for the U.S. Army Corps of Engineers or New Jersey Department of Environmental Protection (NJDEP)" for purposes of that additional-consideration criterion.
Question 21: Will the short listed firms be entitled to a stipend?
Government Response 21: No. Firms short-listed to compete in Phase Two will not receive a stipend.

OFFERORS'S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors for information only and do not revise the solicitation, plans, or specifications.)
Question 18: Does the $7 million "similar magnitude" threshold apply to each project submitted by the contractor and design firm, or is it evaluated based on the team's overall relevant experience?
Revised Government Response 18: The $7 million figure is the definition of similar magnitude for each project submitted for consideration (construction contractor or design firm). It is not evaluated as a team-wide dollar total.
It is not a submission minimum. Offerors can submit projects with a construction cost below $7 million.
The Government will evaluate the relevancy of each submitted project against similar scope, complexity, and magnitude, as defined in Factor 1.
As stated in the solicitation: Projects do not have to include all of the criteria; however, projects that meet many or all of the criteria may be given a higher degree of relevancy.
A project below $7 million may still demonstrate similar scope and/or complexity.
The Factor 1 rating is assigned to the Offeror as a whole, not to individual projects. Proposals may be highly rated when the Offeror demonstrates extensive experience in all or nearly all of the aspects defining relevance.
