About this file

This file consists of permit review comments and federal consistency determinations for the Port Monmouth Hurricane and Storm Damage Reduction Project, a multi-phase coastal protection initiative in Middletown Township, Monmouth County, New Jersey. The documents are attachments addressing existing and required permits for the project, which includes construction of floodwalls, levees, tide gates, pump stations, culverts, and related flood risk management infrastructure across five separate Phase II contracts. The New Jersey Department of Environmental Protection (NJDEP) Division of Land Resource Protection issued conditional federal consistency determinations and Section 401 Water Quality Certificates for multiple contracts, with the U.S. Army Corps of Engineers (USACE) New York District as the federal applicant and NJDEP as the non-federal sponsor.

The permit conditions impose extensive mitigation and restoration requirements across all contracts, including timing restrictions on in-water work from March 1 through June 30 to protect anadromous fish species and from January 1 through May 31 for winter flounder protection. Mitigation obligations vary by contract but include creation, restoration, or enhancement of coastal wetlands, freshwater wetlands, and intertidal/subtidal shallows, with acreage requirements ranging from 0.019 to 6.926 acres of permanent disturbance requiring compensation. Permittees must monitor mitigation projects for 5 years following completion, submit construction completion reports within 60 days of final project grading, and achieve 85 percent survival rates and 85 percent native species coverage. The NJDEP reserves the right to assess penalty increases of 20 percent annually if mitigation deadlines are not met, and approved mitigation banks serving the project area include Marsh Bog mitigation banks and Manasquan River Mitigation Bank through Evergreen Environmental and GreenVest.

871 linear feet of concrete floodwall, 1,040 linear feet of levee, rerouting of the Henry Hudson trail, two road closure gates at Broadway Avenue and Campbell Avenue and seven drainage outlet structures.

Based on modeling from a new guidance document from the Federal Emergency Management Agency (FEMA) it was determined that there is a need for additional culverts and a swale at Campbell Avenue to ensure that the Flood Control project will not cause an increase is the rise of surface water from storm events. Based on the FEMA modeling, this Federal Consistency is for the installation of three 18” diameter culverts and a diversion swale in the western approach of Campbell Avenue, to be built as part of Phase II Contract 4. This consistency determination is issued subject to compliance with the specific conditions below.

The work is show on site plans on nine (9) sheets, sheets 3-11, entitled: “HURRICANE AND
