Technical Specifications Summary
This document comprises the RTA 30% Design Technical Specifications for the Port Monmouth Mitigation Final Design-Build Request for Proposal (DB-RFP), serving as Attachment B to the contract documents for Phase II of the Port Monmouth Coastal Risk Management Project. The specifications establish comprehensive requirements for wetland mitigation work at two sites—Pews Creek (Block 121, Lot 1) and Compton Creek (Block 276, Lot 48)—located in Middletown Township, Monmouth County, New Jersey. The Design-Build Contractor must commence work within five calendar days of the Notice to Proceed and prosecute work diligently to completion, with all work performed in accordance with FAR 52.211-10 and 52.236-9, as well as USACE EM 385-1-1 Safety Requirements.
The scope of work includes clearing and invasive species control, excavation of secondary channels and unsuitable soils, placement of clean imported fill, grading, seeding, planting, herbivory fencing installation, vegetation establishment monitoring and maintenance for a two-year period, and incidental related activities. Payment is structured through lump-sum job items (Mobilization/Demobilization, Landscape Implementation Plan, Tidal Envelope Plan, and Liability Insurance) and unit-price job items covering excavation, clean imported soil, erosion and sediment control measures, temporary construction facilities, landscaping work, and vegetation maintenance. The Design-Build Contractor must provide project management, quality control oversight, environmental compliance documentation, monthly progress photography, and cost-loaded Critical Path Method scheduling using Primavera P6 software. Key contractual requirements include minimum Commercial General Liability insurance of $5,000,000 per occurrence, a Project Superintendent with ten years of construction experience and five years as superintendent on similar projects, Design Workshop facilitation within 35 calendar days of award, Preconstruction Conference within 35 calendar days, and formal Partnering sessions with escalation matrices and Construction Joint Risk Registers. Seasonal restrictions prohibit tree/shrub clearing from March 15 to July 31 under the Migratory Bird Treaty Act, and in-water work at Compton Creek is prohibited from March 15 to June 15 to protect anadromous fish passage, with potential fall restrictions from September 1 to November 30 if construction substantially blocks the waterway. All work must comply with applicable state and local permits, federal regulations, and environmental performance standards, with monthly schedule updates, weekly progress meetings, and comprehensive documentation of all project activities required throughout contract performance.

U.S. ARMY CORPS OF ENGINEERS (USACE)
EP 1110-1-8 (2021) Engineering and Design -- Construction Equipment Ownership and Operating Expense Schedule
1.2 CONTRACT COST BREAKDOWN
The Design-Build Contractor must furnish within 30 days after the date of Notice to Proceed, and prior to the submission of its first partial payment estimate, a breakdown of its single job pay item or items which will be reviewed by the Contracting Officer's Representative as to propriety of distribution of the total cost to the various accounts. Any unbalanced items as between early and late payment items or other discrepancies will be revised by the Contracting Officer's Representative to agree with a reasonable cost of the work included in the various items. This Contract cost breakdown will then be utilized as the basis for progress payments to the Design-Build Contractor. Equipment rates and operating expense rates for construction equipment shall follow the standards of EP 1110-1-8 .
1.3 SINGLE JOB PAYMENT ITEMS
Payment items for the work of this Contract for which Contract job payments will be made are listed in the PROPOSAL SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, are included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed constitutes full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Design-Build Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
1.3.1 Mobilization and Demobilization
1.3.1.1 Payment
Payment will be made for costs associated with mobilization and demobilization, as defined below.
Mobilization must include all costs for preparatory work and operations necessary for the movement of personnel, equipment, supplies, and incidentals to the project site, and other work performed prior to actual
SECTION 01 20 00 Page 7 commencement of work. The Design-Build Contractor must furnish and set up necessary general facilities, as are required by local, county, state and Federal laws, regulations or codes. The cost of required insurance and bonds and other similar significant initial expense required for the initiation of the contract work must be included in this item. The determination of the adequacy of the Design-Build Contractor's facilities, except as required by local, county, state and Federal laws and regulations, must be made by the Design-Build Contractor.
Demobilization must consist of all activities and costs for movement of personnel, equipment, and supplies/materials not used in this contract, including the disassembly, removal and site cleanup of temporary offices, and other facilities assembled on the site for this contract. Upon completion of work, the Design-Build Contractor must restore all access areas to the same conditions as prior to the start of work. The Design-Build Contractor must mark the positions of each grade stake, and to remove them after completion of the project. Design-Build Contractor must be held responsible for accounting for 100 percent removal of all grade stakes, as they pose a serious public safety hazard as the fill erodes and remaining stakes become exposed in the surf. Stakes must be metal pipes, so that they can be pulled out intact, and located with a metal detector, if necessary.
All costs connected with the mobilization and demobilization of the Design-Build Contractor's personnel, equipment, supplies, and materials will be paid for the contract lump sum price for this item. 60 percent of the lump sum price will be paid to the Design-Build Contractor upon completion of his mobilization to the work site. The remaining 40 percent will be included in the final payment for work under this contract.
In the event that the Contracting Officer's Representative considers that the amount in this item which represents mobilization (60 percent) does not bear a reasonable relation to the cost of work in this contract, the Contracting Officer's Representative may require the Design-Build Contractor to produce cost data to justify this portion of his bid.
Failure to justify such price to the satisfaction of the Contracting Officer's Representative, will result in payment, upon completion of mobilization, of actual mobilization costs as determined from the cost data submitted by the Design-Build Contractor. Payment for the remainder of this item will be included in final payment for work under this contract. The determination of the Contracting Officer's Representative is not subject to appeal.
