About this file

This is Amendment 0002 to Solicitation W912DS26RA032, issued by the U.S. Army Corps of Engineers (USACE), New York District on October 13, 2026. The amendment responds to contractor inquiries regarding a Design-Build Construction project for Port Monmouth Phase II Contract 1 Mitigation in Middletown, New Jersey. The revised proposal due date is October 19, 2026, at 2:00 p.m. Eastern Daylight Time. Key changes include deletion and replacement of the Phase One and Phase Two Design-Build Selection Procedure documents with revised versions that correct footer markings, incorporate revised Form A2, and eliminate hard-copy submission requirements in favor of electronic submission only.

The amendment includes 21 questions and government responses addressing offeror inquiries regarding proposal requirements. Critical clarifications include: the Proposal Cover Sheet, Table of Contents, and Form A1 do not count toward the 30-page Volume I, Tab A limit; the fifteen-year project experience requirement applies (not ten years, with conflicting language removed from Form A2); Form A4 (Letter of Commitment) submits in Tab C; retired client representatives may complete Form A3 (Past Performance Questionnaire); the $7 million similar-magnitude threshold applies individually to each project submitted; PPQs from any prior RFP (any USACE district) cannot be incorporated by reference; second-tier subcontractor information is not required; CPARS reports supplement but do not replace Form A3; and short-listed firms will not receive stipends for Phase Two competition. The Government declined to extend the proposal due date and clarified that CUI markings were inadvertently applied and removed, with no CMMC requirements established.

Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply

revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors for information only and do not revise the solicitation, plans, or specifications.

Question 1: The RFP documents are marked CUI. Please confirm if this was accurately referenced for this solicitation?

Government Response 1: See Government Response 7.

Question 2: Does the Proposal Cover Sheet, Table of Contents and Form A1 Proposal Data Sheet count towards the Volume 1 Tab A page limit ?.

Government Response 2: The Proposal Cover Sheet, Table of Contents, and Form A1, Proposal Data Sheet, do not count toward the Volume I, Tab A, 30-page limit. The Proposal Cover Sheet may be submitted as the first page of Volume I, before Tabs A and B, but shall be considered part of Tab C for administrative purposes.

Question 3: Please confirm the instructions to submit 'original and copies' noted in the Section IV, PHASE ONE OF A TWO-PHASE DESIGN-BUILD SELECTION PROCEDURE, 5. Proposal Submission Requirements and Instructions B.5. General Instructions, Format Requirements is to be followed for this RFP or if it should be disregarded since we are instructed to transmit this RFP via e-mail. Please clarify.

Government Response 3: The Phase One of a Two-Phase Design-Build Selection Procedure has been revised to delete the hard-copy submission instructions. Offerors shall submit proposals electronically in accordance with the solicitation's electronic proposal-submission instructions.

Question 4: Please confirm if the Pro Forma Data Sheet referred to in the Section IV, PHASE ONE OF A TWO-PHASE DESIGN-BUILD SELECTION PROCEDURE, B.3. General Instructions refers to the Form A1 Proposal Data Sheet or is there is otherwise a specific form we are expected to use?

Government Response 4: The Pro Forma Data Sheet referenced in Section IV, Paragraph B.3, General Instructions, of the Phase One of a Two-Phase Design-Build Selection Procedure is Form A1, Proposal Data Sheet, in Attachment F. Offerors shall use Form A1 to satisfy the Pro Forma Data Sheet requirement.

Question 5: Which Tab is Form A4 - Letter of Commitment to be included in?

Government Response 5: Form A4 shall be submitted in Tab C.

Question 6: Please confirm if the Form A2 - Relative Specialized Experience to be of Projects within the last 10 years (noted on Form A2) or within the last 15 years (noted in the Section IV, PHASE ONE OF A TWO-PHASE DESIGN-BUILD SELECTION PROCEDURE, D.Tab A - Submission Requirements. Please also note Tab B - Factor 2 requests performance recognition documents received within the last 10 years. Please clarify as there are differing periods noted in this RFP.

Government Response 6: The fifteen (15)-year requirement in Tab A, Factor 1, is correct. The conflicting ten (10)-year project-experience language has been removed from Form A2. Offerors shall use the fifteen (15)-year requirement for relevant specialized experience submitted under Tab A, Factor 1. The ten (10)-year requirement for performance-recognition documents under Tab B, Factor 2, remains unchanged.

Question 7: The file attachment "Phase one of a two phase design-build selection procedure.pdf" contains CUI markings. Please confirm whether the Government considers the information contained in this attachment to be CUI and whether receipt, storage, transmission, or use of this document by offerors requires compliance with any specific DFARS, NIST SP 800-171, CMMC, or other cybersecurity requirements.

Government Response 7: The Phase One and Phase Two of a Two-Phase Design-Build Selection Procedure documents were inadvertently marked as CUI. The documents have been revised to remove the inadvertent markings. See the revised attachments to this amendment.

Offerors are responsible for complying with all applicable solicitation provisions and clauses, and other DFARS provisions listed in the solicitation. The solicitation does not include DFARS 252.204- 7021 and does not establish a Cybersecurity Maturity Model Certification (CMMC) requirement or specify a CMMC level.

Question 8: Section 01 10 10 1.1.3.a states "Minimum qualifications for certain project personnel and staff below are outlined in the 30% Design Technical Specifications. As necessary, the DBC may submit qualifications for additional disciplines and subject matter experts (SMEs) as needed.

These must be approved by the COR." We cannot find any reference to minimum qualifications for a Project Manager or Project Superintendent in any of the reference documents provided. Please advise if there are minimum qualifications and what they are for these Key Project Personnel.

Government Response 8: The RFP does not require offerors to identify or submit qualifications for key personnel as part of either the Phase One or Phase Two proposal submissions. The

Technical Specifications establish qualification requirements for certain contract-performance positions, including the Superintendent per Technical Specifications, Section 01 30 00, Paragraph 1.7.1, Superintendent Qualifications. The Phase One instructions state that technical specifications and drawings are not evaluated factors during solicitation; however, offerors are not relieved from meeting all technical or other requirements of the RFP.

Question 9: Form A3 requires the "Client" to fill out a portion of the form. In cases where all employees of that agency (client) with knowledge of a contractor's past performance are retired or no longer employed by the agency, who should be completing the form?

Government Response 9: A client representative with direct knowledge of the offeror's performance, including a retired former client representative, may complete Form A3, Past Performance Questionnaire (PPQ).

Question 10: Due to the limited time to send and receive completed "Form A3", we ask for a time extension.

Government Response 10: The Government is not extending the proposal due date at this time.

Offerors shall submit proposals by the date and time specified in the solicitation.

Question 11: Section IV, Tab A permits construction experience completed within the past fifteen

(15) years, while Form A2 requests projects constructed within the past ten (10) years. Please confirm the applicable project-experience recency period and revise Form A2 as appropriate.

Government Response 11: See Government Response 6.

Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors for information only and do not revise the solicitation, plans, or specifications.

Question 12: Who does the 'Client' refer to for blocks 5-8 in Form A3 - Past Performance Questionnaire (PPQ)?

Government Response 12: Form A3, "Client" means the owner, agency, organization, or other entity for whom the offeror performed the referenced work and who is able to provide informed information regarding the offeror's performance.

Question 13: Are CPARS reports accepted in lieu of, or in addition to, completed Past Performance Questionnaires (PPQs)?

Government Response 13: CPARS reports are not accepted in lieu of Form A3. CPARS reports shall be submitted, when available, in addition to Form A3.

Question 14: The solicitation states: "Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs." Does this restriction apply only to PPQs previously submitted to the New York District, or to PPQs submitted to any USACE district nationwide?

Government Response 14: This restriction applies to PPQs previously submitted for any other RFP, including RFPs issued by any USACE district.

Question 15: Are offerors required to provide information on second-tier subcontractors in Form A1?

Government Response 15: No. Offerors are not required to provide information on second-tier subcontractors in Form A1.

Question 16: Are offerors required to provide past project termination information for second-tier subcontractors in Tab B?

Government Response 16: No. Termination or projects issued a cure notice and accompanying information only applies to the offeror, including teaming partners if applicable.

Question 17: May offerors include an appendix to Form A2 with additional information explaining project relevancy?

Government Response 17: Yes. Offerors may include an appendix to Form A2 to provide additional information explaining project relevancy.

Question 18: Does the $7 million "similar magnitude" threshold apply to each project submitted by the contractor and design firm, or is it evaluated based on the team's overall relevant experience?

Government Response 18: The $7 million similar-magnitude threshold applies to each project submitted for consideration. It is not evaluated based on the team's overall combined relevant experience.

Question 19: For the additional consideration criteria, is "majority" determined by the number of project examples submitted? Is this evaluated separately for the contractor and designer, or across the entire proposal?

Government Response 19: For purposes of this solicitation, the "additional consideration criteria" refers to the non-exhaustive list of examples in Tab A, Factor 1, Evaluation Criteria, immediately following the sentence: "Where this experience includes the following, the proposal may be given additional consideration ..."

"Majority" means more than one-half of the project examples submitted under Factor 1. The additional-consideration criteria will be evaluated separately for construction contractor and design firm projects.

Question 20: Would a mitigation project performed for another federal agency qualify for additional consideration if it required a USACE permit or regulatory oversight, or must USACE or NJDEP be the contracting agency or customer?

Government Response 20: No. A project performed for another Federal agency that involved a USACE or NJDEP permit or USACE/NJDEP regulatory oversight is not considered a project "performed for the U.S. Army Corps of Engineers or New Jersey Department of Environmental Protection (NJDEP)" for purposes of that additional-consideration criterion.

Question 21: Will the short listed firms be entitled to a stipend?

Government Response 21: No. Firms short-listed to compete in Phase Two will not receive a stipend.
