About this file
This document contains a justification and approval for using brand name specifications in a construction contract solicitation. The U.S. Army Corps of Engineers Louisville District plans to issue a request for proposal for the complete renovation of the 314,000 square foot Air Mobility Command Headquarters facility at Scott Air Force Base in Illinois. The project scope includes replacement of all mechanical, electrical, plumbing and communications systems. Compatibility with the base-wide Johnson Controls direct digital control HVAC monitoring system is required, so the solicitation will include brand name specifications for Johnson Controls equipment, as no other equipment would integrate with the existing system. The contract duration is 1260 calendar days and the anticipated value is between $100-250 million. The solicitation will be publicly posted on beta.sam.gov with full and open competition and utilize a tradeoff best value selection process.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: U.S. Army Corps of Engineers (USACE), Louisville District, Post Office Box 59, Louisville, Kentucky 40201-0059.
2. Description of Action: This justification and approval (J&A) is being prepared for the use of a brand name item, Johnson Controls HVAC Control Software and associated equipment, in the firm fixed price construction contract for the Air Mobility Command Headquarters Renovation project at Scott Air Force Base, Illinois. The government will not purchase the HVAC Control Software and equipment directly, but rather brand name specifications will be included in the design bid build solicitation that will lead to a new firm fixed price (FFP) construction contract. The construction contract is planned to be awarded under a full and open solicitation, using FY21 Sustainment, Restoration and Modernization (SRM) funding.
3. Description of Supplies/Services: The HVAC controls and monitoring system selected for use on the Air Mobility Command Headquarters Renovation project at Scott Air Force Base, Illinois is manufactured by Johnson Controls. The Johnson Controls Brand Name Proprietary Specifications will be included in the Design Bid Build Solicitation. Johnson Controls has offices and authorized sellers around the world and in the Scott AFB region. The estimated total cost for the equipment is approximately XXXXXX.
4. Authority Cited: 10 United States Code (U.S.C.) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” This authority is applicable to brand name justifications in accordance with FAR 6.302-1(c)(1).
5. Reason for Authority Cited:
a) Background: The Air Mobility Command Headquarters Renovation project at Scott Air Force Base is a wholesale renovation and systems replacement project. The scope of the project will consist of a complete renovation to make the 314,000 SF facility current for all applicable criteria, standards, and codes. The scope includes life safety systems, structural systems, architectural and interior systems, interior power and lighting, emergency / alarm systems, plumbing, HVAC, telecommunications systems, ATFP/Seismic upgrades, server racks, floors, walls / ceilings, toilets, and furnishings.
Work will include providing adequate seismic bracing and protection to the existing steel structure. Replacement of the interior partitions to better the suit the current mission within the facility. Replacement of the existing lighting with a more energy efficient system, and replacement of all conduit that will hold the wiring for all communication lines, security system lines, and fire alarm systems. Installation of a fire suppression system to meet updated codes to include any alarm and mass notification systems. All interior and exterior windows will be replaced along with the interior and exterior doors.
The electrical, HVAC, and plumbing systems will be replaced. Site work will include grading of the site and soil removal to accommodate additional pier foundations being installed. Site electrical utilities will include a primary switchgear, transformer, and grounding system. A generator will be included to ensure emergency power for the facility.
Scott Air Force Base currently centrally monitors all of its HVAC systems with Johnson Controls Direct Digital Control (DDC) equipment, which are proprietary products of the sole manufacturer, Johnson Controls.
b) Justification: The Scott Air Force Base, and the AMC HQ facility currently monitor their HVAC systems with Johnson Controls DDC equipment. The DDC controls are proprietary to Johnson Controls and the base maintains a service contract through Johnson Controls for the purposes of operating the base-wide system. This integration requires a compatible system to be installed and the Johnson Controls system is the only compatible component. If Johnson Controls system is not installed, this facility will not satisfy the user’s requirement to be integrated with the base-wide system. The installation would either have to monitor via two different programs, or replace the entire system at significant cost.
c) Impact: If equipment other than the specified Johnson Controls DDC equipment is installed in this facility it will prevent the facility from connecting to the base-wide monitoring system. The facility would have to be monitored separately from the rest of Scott Air Force Base, which would require the establishment of a separate service contract at a significant cost to the government.
d) Alternatives: None viable to achieve a fully functioning system for the reasons noted above in paragraph 5. b) and c).
6. Efforts to Obtain Competition: Technical capabilities of various manufacturers were reviewed for compatibility to the current system. None of the various manufacturers’ equipment would ensure compatibility with the existing system which currently utilizes Johnson Controls HVAC Control Software exclusively.
A Notice of Intent to Sole Source was posted on 09 September 2020 on the beta.sam.gov website. To date, no other sources have written to express interest. If prior to issuance of the solicitation, responses are received expressing interest, the justification will be amended.
7. Actions to Increase Competition: Apart from the complete replacement of the current system in its entirety, competition will be limited. This is a finite requirement with no future needs, and therefore there are no actions to increase future competition.
8. Market Research: A technical review and evaluation was conducted of the system requirements for the AMC HQ facility project. As discussed, in paragraph 6 above, only Johnson Controls HVAC Control Software will ensure compatibility with the existing system.
