FY 12 WATER TREATMENT AND DISTRIBUTION SYSTEM, FORT IRWIN, SAN BERNARDINO COUNTY, CA. Project consists of design and construction services for a new Electro-Dialysis Reversal (EDR) Water Treatment Facility and water supply and distribution system infrastructure upgrades at Fort Irwin, California.

Offerors must submit both a technical proposal and a price proposal. The basis for award is Best Value "Trade-off" IAW FAR 15.101-1. The Government reserves the right to consider award to other than the lowest priced offeror or other than the highest technically rated offeror. The relative weighting of price and technical is as follows: all evaluation factors other than cost or price, when combined, are significantly more important than cost or price.

The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them necessary. FAR 52.215-1(f)(4).

The estimated cost range of this procurement is $100,000,000 - $250,000,000.

The Notice of Price Evaluation Preference for HUBZone SBC will apply to this procurement. See Section 00 07 00, Contract Clause No. FAR 52.219-4.

SECTION 00 01 10

PERFORMANCE/TECHNICAL-PRICE TRADE-OFF BEST VALUE

(Proposal Submission Requirements and Instructions)

1.0 INTRODUCTION

1.1 This is a Federal Acquisition Regulation (FAR) 15, unrestricted, competitive, best value, single phase, design-build, source selection. In this competition, a competing Prime Construction Contractor, hereafter referred to as the “Offeror”, will be evaluated for its design-build teams’ capabilities to design and construct the requirements of this Request for Proposal (RFP). The submission criteria for this RFP are found in this section. The evaluation criteria and basis of award are found in RFP Section 00120. The RFP criteria rely upon industry standards, where allowable, to afford the Offeror a degree of design flexibility while meeting certain specific project requirements. The successful Offeror must design and construct a complete and useable facility, as described in the RFP package.

Offerors must perform sufficient preliminary design work prior to submitting proposals in order to verify quantities and costs. By submission of a proposal, the Offeror accedes to all the terms of this RFP.

2.0 WHO MAY SUBMIT

2.1 Any responsible, legally organized Offeror may submit a proposal. Firms formally organized as design-build entities, design firms and construction contractors that have associated specifically for this project, consortia of firms or any other responsible, interested parties may submit proposals.

2.2 Any firm that contributed to and/or participated in preparation of this solicitation, whether as a Government contractor or as a subcontractor to a Government contractor, is not eligible to participate in this solicitation as a prime contractor or a design subcontractor due to a conflict of interest.

The Government considers such firms to have an unfair competitive advantage, and therefore will not consider such firms if proposed.

2.3 Organizational Conflicts of Interest (OCI) Disclosure: The contractor shall provide a disclosure statement with its proposal which concisely describes all the relevant facts concerning past or present organizational conflicts of interest relating to work on this project. In the same statement, and if applicable, the contractor shall provide information to assure the government that the conflicts of interest have been mitigated and/or neutralized to the maximum extent possible. If a conflict of interest is discovered after award of this contract, the Contracting Officer will make a decision whether to terminate the contract.

3.0 GENERAL PROPOSAL SUBMISSION INSTRUCTIONS

3.1 Submit proposal packages to the U.S. Army Corps of Engineers at the address shown in Block 8 of Standard Form 1442 (SF 1442) in this solicitation. The Government must receive your proposal no later than the time and date specified in Block 13 of SF 1442. Any and all amendments to the solicitation shall be acknowledged by completion of Block 19 of the SF 1442.

SECTION 00 01 10-Page 2

3.2 Submit your proposals in two separate volumes. Volume I should be titled “Volume I-PAST PERFORMANCE CAPABILITY AND KEY PERSONNEL EXPERIENCE”. Volume II should be titled “Volume II- ADMINISTRATIVE REQUIREMENTS”.

Submit an original and seven (7) copies of Volume I information in separate, three-ring binders labeled: “Volume I – Past Performance Capability, and Key Personnel Experience and Technical Information”.

Submit an original and one (1) copy of Volume II, which includes the price, in a sealed envelope labeled “Volume II Administrative Requirements”. In the same envelope, the Offeror is to submit the entire proposal (Volumes I and II) in Portable Document File (PDF) format on compact disk (CD). Provide two copies of the CD of the entire proposal. Volume II CD’s (which includes price) may be submitted within three (3) business days after the proposal receipt date.

Provide written portions of the proposal in 8-1/2" x 11" format. Also see, Paragraph 6.0 PRICE BREAKDOWN REQUIREMENTS regarding possible requirements for cost or price breakdowns to be furnished upon request.

3.3 To effectively and equitably evaluate proposals, the Source Selection Evaluation Board (SSEB) must receive information in the order described below and sufficiently detailed, clearly describing an Offeror's past performance capabilities to successfully execute the work required by this solicitation.

It is therefore the responsibility of the Offeror to submit complete proposal information and documents that are fully responsive to the submission requirements of this section. Offerors are responsible for organizing submitted material sequentially under tabs and numbered pages to facilitate evaluation. Materials not organized under the appropriate tabs and in the sequence of subparagraphs set out below, may be easily overlooked during evaluations, possibly affecting an Offeror’s rating. Information incorporated by reference will not be evaluated. Offers should be concise, addressing only the information outlined in this Section. The Government intends to make an award based on initial evaluations without discussions.

SECTION 00 01 10-Page 3

4.1 VOLUME I-TAB A ADMINISTRATIVE INFORMATION. Under TAB A, submit the following items: (1) submit the completed proposal data sheet (See Attachment 1, provided at the end of this section); (2) submit a signed statement on the Offeror’s letter head regarding the status of organizational conflict of interest disclosure (RFP Section 00110, paragraph 2.1.3); and (3) submit signed Letter of Commitment making the unequivocal commitment that, in the event of an award of a contract to Offeror, the proposed lead design firm will fulfill the duties of preparing the design package for this effort(see Attachment 2 at the end of this section). Submit all this required administrative information in VOLUME I-TAB A.

4.2 VOLUME I TABS B AND D GENERAL REQUIREMENTS FOR SUBMITTING PAST

PERFORMANCE INFORMATION.

4.2.1 PAST PERFORMANCE INFORMATION FOR THE PRIME CONSTRUCTION CONTRACTOR AND

THE LEAD DESIGN FIRM. This general submission criterion relates to Tab B- Factor 1, the prime construction contractor and Tab D-Factor 3, the proposed Lead Design firm (or prime construction contractor if the design is to be self-performed). There are two aspects to the past performance information that shall be submitted. In both factors, the Offeror shall demonstrate recent, relevant past performance on projects similar to the scope and magnitude of effort and complexity required by this solicitation and demonstrate the quality record of that past effort. The Offeror may use the attachments at the end of this section for submitting the required information for each factor.

4.2.2 Where the word “project(s)” appears in this RFP Section 00 01 10, it is understood to mean a project, contract(s), task order(s), or any other contract document provided for by the Federal Acquisition Regulation (FAR 2.101). Examples of projects submitted by the prime construction contractor and the proposed lead design firm may be projects performed for a City, State or a Federal Government Agency; or for a commercial or private sector customer. If projects were design/build projects, so identify them as such.

4.2.3 Where the word “recent” appears it is understood to mean design type projects that have been 100% completed (final construction documents completed) within six (6) years of the RFP issue date. A “recent” construction type project is defined as a construction project for which design is 100% complete and the construction is at least 50% complete (measured by performance period days) as of the RFP issue date or a construction type project that has been completed and turned over to the owner within six (6) years of the RFP issue date. It is the responsibility of the Offeror to clearly indicate the percentage of completion on construction project examples that are underway at the time of this submission.

4.2.4 “Relevant” past performance information is one indicator of an Offeror’s ability to perform the contract successfully. Where the word “relevant” appears it is understood to mean that project effort is similar and logically connected to the context of this solicitation in terms of scope (similar type of work, size, dollar value, etc.) and magnitude of effort, and complexity as the work described in this solicitation. A brief description of work is found in RFP Section 01 10 10 paragraph 1, PROJECT DESCRIPTION”.

Regarding “relevant” prime construction contractor work, the Government will important than the technical information submitted in Volume I.

SECTION 00 01 10-Page 4 consider the type of work features self-performed, on-site by the Prime Contractor’s own organization in addition to construction management effort.

4.3 VOLUME I-TAB B- PAST PERFORMANCE SUBMISSION CRITERIA OF THE PRIME

CONSTRUCTION CONTRACTOR. There are two aspects to the past performance submission criteria: (a) Relevant Company Effort and (b) Quality of Past Performance.

(a) RELEVANT COMPANY EFFORT. The Offeror is to submit no more than five

(5) examples of its most “recent”, “relevant”, construction type effort performed as a prime construction contractor to demonstrate accomplishments that are similar to the scope and magnitude of effort and complexities required by this solicitation. For each “recent”, “relevant” project example submitted, the Offeror shall furnish the information specified below (Attachment 3 is provided for your use). If the Offeror is submitting “task order type projects”, each task order project shall be submitted on a separate project data sheet. At a minimum provide the following information:

(1) Company Name

(2) Name of Project

(3) Location

(4) Owner

(5) General Scope of Construction Project including any type of state permits that were required and obtained regarding water treatment and distribution systems.

(6) Your Role (Prime, Joint Venture, Subcontractor) (6a) Construction Type Work Features Your Company Self-Performed

(other than construction management)

(7) Construction Cost

(8) Extent and Type of Work Subcontracted Out

(9) Construction Began and Completion Dates (Provide Month/Year)

(10) Your Performance Evaluation by Owner, if Known

(11) Termination or Liquidated Damages Information; Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.

(12) Owner's Point of Contact for Reference Company Name

(13) Telephone and Fax Numbers

(b) QUALITY OF PAST PERFORMANCE

(1) The Offeror is to submit in its initial proposal a Past Performance Survey (Attachment 4 may be used), fully completed by the project owner, for each project example being submitted in response to the submission requirements of paragraph 4.3(a). CCASS Reports and other types of performance survey forms, signed by a commercial customer or signed by a representative from another city, state or federal agency, may be submitted as long as the information submitted has the same or similar information as indicated in the survey form at the end of this section, documenting the quality of the Prime Construction Contractor’s performance for the projects submitted. Letters of Recommendation or Appreciation are considered supplemental information to demonstrate customer satisfaction and are not considered equal to detailed past performance surveys.

(2) The Offeror may also provide in its initial proposal, information (i.e., letters of appreciation, safety awards, customer awards, etc.) of other completed projects that are relevant, to further demonstrate owner

SECTION 00 01 10-Page 5 satisfaction with the Offeror’s general trend in construction performance.

Information submitted must be “recent” and “relevant” as previously defined.

(3) If an Offeror has been required to take corrective action for any substandard performance, the Offeror should explain the circumstances and the corrective actions taken. If an Offeror has experienced other performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc., the Offeror should explain.

4.3.1 Joint Venture Submission Requirements. The Offeror submitting a proposal as a Joint Venture (JV) shall obtain a DUNS number and be registered in the CCR as the offering Joint Venture. The JV Offeror is to provide no more than five (5) “recent”, “relevant” projects performed by the JV to demonstrate its past performance.

4.3.1.2 If the JV has little or no record of “recent” and/or “relevant” project performed by the JV entity, then each member of the JV is to provide no more than five (5) “recent”, “relevant” projects performed by each JV member to demonstrate each members’ general trend of construction efforts, and record of past performance.

4.3.2 Verification: The Government reserves the right to verify the past performance record of cited projects, or other recent projects not submitted by reviewing the Past Performance Information Retrieval System (PPIRS), or other Government appraisal systems or by interview of the owner or references. The Government may check any or all cited references to verify supplied information. An Offeror will be afforded the opportunity to reply to or explain adverse performance information to which the Offeror has not previously had an opportunity to address.

4.4 Volume I-TAB C- KEY PROJECT PERSONNEL EXPERIENCE AND QUALIFICATIONS.

The key project personnel listed below are not necessarily all the personnel required for this design-build project. Reference RFP Section 00800, paragraph 952.999-4074, “KEY PERSONNEL, SUBCONTRACTORS AND OUTSIDE ASSOCIATES

OR CONSULTANTS”.

4.4.1 The information submitted in Volume I-TAB C consists of the following two elements that are equal and not rated separately:

(a) CONSTRUCTION PERSONNEL

(b) DESIGN PERSONNEL

The Offeror is to include only the resumes of the key project personnel listed below for construction and design. Submit the resumes in the sequence as listed in the chart below. Provide resumes that are fully complete, having, at a minimum, the required information as shown on Attachments 5 and 6, at the end of this section. Attachments 5 and 6 requests specific/required information to demonstrate the relevancy of proposed personnel experience and qualifications to the design and construction management experience required by this solicitation. Resumes are to be complete and are to fully address the required information found in the referenced attachments. The Offeror is to clearly indicate the role of each personnel assigned to this project and is to emphasize prior experience performing the role on previous projects. Where the word “relevant” appears, reference RFP Section 00110, paragraph 4.2.4 for the definition. All designs performed after award of the contract shall be accomplished by registered

SECTION 00 01 10-Page 6 design professionals in accordance with Federal Acquisition Regulations
