Round 2 Questions
1. SECTION 52.217-8, Page 20. Option to Extend Services (Nov 1999). “The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. …” Should the contractor assume level craft labor rates though out the duration of the contract/project?
Answer: When an option is exercised, the current Wage Determination will be attached to the modification exercising the option. Assuming level labor rates for the duration of this project isn’t a realistic assumption. Recommend Offerors provide a reasonable escalation rate.
2. There is GPS equipment listed as government owned. Can you please provide how many units, make, model, and what equipment is it designed/configured to fit?
Answer: A list of leased and government furnished equipment/items that will be available is attached. GPS equipment on the list is summarized below.
· Construction equipment navigation system that consists of a Trimble base station and two navigational units used on a CAT 336 excavator and CAT D6 bulldozer.
· Trimble Nomad data logger, includes R2 GPS receivers, backpack, survey pole, batteries, and charger.
3. It seems that a list of government owned erosion and sedimentation control equipment is not listed. Can you please provide the type, quantity, features, and location?
Answer: Erosion and sedimentation control features are documented in PLN-5511 (Rev. 3), Stormwater Pollution Prevention Plan for the Luckey Formerly Utilized Sites Remedial Action Program Remedial Project, (Nov. 2019).
4. SECTION 02 61 13 Page 3. 1.1.1.1 Excavation and Backfilling. “Measurement for excavation and on-site transportation will be based on the actual number of cubic yards of contaminated material in-place prior to excavation (i.e. bank cubic yards – BCY).” Note the term contaminated material in the statement. Is there any uncontaminated/clean material to be excavated/managed in order to remove the contaminated material? If so, can you provide the location and quantity of the uncontaminated/clean material? The statement in 1.1.1.1 insinuates that the handling and management of uncontaminated/clean material is incidental to the managing of contaminated material and therefore has to be priced as such.
Answer: Uncontaminated material overlying or adjacent to FUSRAP-contaminated material may be present. The approximate extent of contaminated material and uncontaminated/ clean material is documented in Performance Work Statement (PWS) Attachment 1.1, Contaminated Soil Volume Estimate Summary.
5. SECTION 02 61 13, Page 3. 1.1.2 PAYMENT. “This activity includes any other items incidental to excavation and handling not defined as having a specific unit cost.” And, “Compensation for backfill soil, transportation of backfill, backfill soil conditioning, backfilling, compaction, and geotechnical testing will be paid as a single unit cost.” The solicitation states these activities are cost reimbursable plus fixed fee tasks. Please confirm which is correct.
Answer: Purchase of backfill soil, transportation to the site, backfilling, compaction, and geotechnical testing are cost reimbursable plus fixed fee activities. Offeror’s cost proposal must follow the WBS outlined in the PWS:
· 331XX0211 – Geotechnical Testing
· 331XX2001 – Earthwork
· 331XX2002 – Revegetation and Planting
6. SECTION 02 61 13, Page 10. 3.8 SAMPLING. 3.8.1 PRE-CHARACTERIZATION. Collect pre characterization samples from each work area (SOW Figure 3) prior to the start of excavation activities. Follow PLN-5503. Analyze the samples to confirm the waste profile and verify compliance with the disposal facility’s waste acceptance criteria. Provide analytical results to the disposal facility and Contracting Officer prior to shipping. And 3.8.2 EXCAVATED SOIL. Collected and analyze soil samples to verify chemical/radiological composition, compliance with the disposal facility’s waste acceptance criteria, and proper shipping name for waste manifests. Follow PLN-5503. Clarification: Is 3.8.1 the physical collection and analysis of samples and 3.8.2 the verification process to ship the waste? Or is it stating that another sampling event is being conducted post excavation to verify and meet disposal facility criteria?
Answer: Paragraph 3.8.1 describes in-situ sampling from the anticipated extent of excavation to support the waste profiling process. Paragraph 3.8.2 describes the collection of samples from excavated material. One composite grab sample is taken from each 400 loose cubic yards (LCY). Each composite consists of 10 grab samples taken every 40 LCY. Analytical results are correlated to a group of actual waste containers. To date, this approach provided realistic characterization and DOT proper shipping names of the wastes, and provides information on the fluctuation of contaminant of concern concentrations as the excavation progresses. Refer to PLN-5503 for additional details regarding the purpose and scope of these sampling activities.
7. Reference Volume IV Cost, the RFP is silent concerning cost escalation. As this is a multi-year, combination of both cost plus and fixes price tasks, does the government intend that an escalation factor be utilized in developing costs? If so, to even the playing field, please provide the escalation factor all contractors should utilize.
Answer: See Answer to Question 1. An escalation factor is a business decision and the Government will not dictate an escalation factor.
8. Is there a limit to the single file document size that can be uploaded to the DoD Safe site? If so, what is the size? If files must be broken up to stay within size limits, what is the government instruction as to how to do?
Answer: Per the solicitation, DOD SAFE supports delivery up to 8GB.
9. Reference page 42, Past Performance. Times New Roman 12-point font combined with the two-page limit per project description leaves us little space to adequately present sufficient detail for complex past projects we have performed. If a project is presented within a table, we assume it is acceptable to utilize Times New Roman 10-point font. Please confirm.
Answer: Yes, it is acceptable. See Amendment 02 for changes.
10. Reference page 47, Cost/Price Proposal. MANDATORY SOLICITATION REQUIREMENT: Assume a funding limitation of no greater than $30 million annually. Please confirm that the $30 million applies only to the contractor’s cost, i.e. any USACE costs are separate from this number.
Answer: Assume a funding limitation of no greater than $27M annually will be available for the contract. See Amendment 02 for changes.
11. Reference Optional Tasks 5a-5g in Attachment 7 Bid schedule. There is no demobilization task specified. Should each task include demobilization cost or how is that task to be addressed?
Answer: Each optional task should include demobilizations costs, if applicable. An updated bid schedule is attached.
12. Does the contractor need to plan for electrical power outages/shortages at the site? If so, can you broadly provide any detail as to how often, how long, etc.?
Answer: No
13. Would the government please clarify what is meant by a “certified joint venture” agreement, i.e. executed by both parties or something else?
Answer: It means a copy of the duly executed JV agreement signed by individuals who are authorized to bind each company. See Amendment 02 for changes.
14. Reference page 46 Element A, Can the organization chart be presented on an 11x17 page and not count toward page count?
Answer: Yes, it can be presented on an 11x17 page and not count toward the page count. See Amendment 02 for changes.
15. May the contractor include an executive summary in both the Technical and Cost Volumes that does not count toward page count (since no page count limitation in Cost Volume, understand if allowed there is no issue in that Volume)?
Answer: No, an executive summary counts towards the page count in the technical volumes.
16. Please confirm the WWTP and potable water system operations should be captured in WBS 331XX22 General Requirements subtask 331XX2209 Temporary Construction Facilities (Operation).
Answer: Refer to PWS section 7.2.5. WWTP operation costs are captured in 331XX0907.
17. We did not see the number of adverse weather days contractors should assume impacting operations. Please provide dates on when specific events should be planned and the quantity of time, if we should include them.
Answer: Adverse weather days should not be included.
18. Where should mobilization/demobilization of personnel and equipment for the optional tasks be captured?
Answer: Use 331XX01 (Mobilization and Preparatory Work) under each optional task in accordance with the bid schedule.
19. The mobilization task is FFP and the incumbent contractor will not incur these costs. How will this be evaluated to ensure fair evaluation for all other contractors that will incur these costs?
Answer: Factor 4 is the least important factor and will be evaluated the same for each Offeror.
20. Please provide pricing for all the leased temporary facilities and equipment to include the offices in the Village of Luckey which will stay in place for the contractor to assume.
Answer: Pricing for leased facilities and equipment is provided on the attached list. The PWS will be updated via Amendment 03. Please note, it is the successful Offeror’s responsibility to arrange leases after award.
21. Reference Attachment 7 disposal items listed. Please confirm that the quantities/tonnage included in the attachment are inclusive of the soil conditioning additive.
Answer: The disposal quantities listed in the Bid Schedule do not include a soil conditioning additive. They are based on estimated in situ volumes (bank cubic yards - BCY) of contaminated soil documented in PWS section 7.2.4.1.1 and Attachment 1.1 (Contaminated Soil Volume Estimate Summary). The estimated weights use a conversion of 1.85 tons/BCY.
22. Reference Cost Volume. Since indirect rates are highly confidential, will the government allow subcontractors to provide this information directly to the government either through email or mailed hard copy directly to USACE?
Answer: Yes, they may be emailed to jeffrey.g.ernest@usace.army.mil before the due date/time of the RFP.
23. Please provide some recent site photos of the proposed work areas in this contract since none were provided and an actual site visit didn’t take place for the contractors to take them.
Answer: Recent photos were included in the presentation attached to Amendment 01.
24. Regarding Q&A, Amendment 1 question number 7 and answer. “Reference page 46, (a) Element A – Staffing Plan. “Provide an organizational chart that shows each project member, the lines of authority and communication/reporting, and the organizational position of personnel that are instrumental to contract execution, labor mix, and numbers of personnel.” Does the organizational chart count towards page count? If so, please consider having it not count towards page count given the overall limited pages allowed.
Answer: See answer to question 14.
25. Page 46 of 56, Section L, Proposal Files, Volume II, Element B Transition and Schedule Risk Management Plan: States that “The Offeror’s proposal shall address their approach for eliminating or minimizing delays in resuming remedial activities.” The current contractor has non-government owned facilities (laboratory, etc.) that will need to be moved offsite prior to the new contractor mobilizing. For purposes of enabling offerors to schedule the project and write to this Element and Element C, please provide the following:
0. What is the anticipated award date for the new contract?
0. What is the anticipated date or duration after award in which the current contractor will be completely demobilized from the site and then new contractor will have access to mobilize?
Answer: Award of the new contract is expected by August 2021. Assume the new contractor will have access to mobilize as soon as the required work plans are approved by USACE.
26. Recommend adding an Executive Summary of no more than 3 pages in length to allow the offerors to introduce their team.
Answer: No, this information can be included within the Staffing Plan Tab.
27. Solicitation Attachment 7 – Bid Schedule: Please confirm that Item 331XX22 General Requirements should be included for Optional Tasks 5a through 5g. This item and any associated requirements are not described in PWS Section 6.3 or Section 7.5.
Answer: 331XX22 (General Requirements) are included on the bid schedule for optional tasks 5a through 5g. Required activities are described in PWS section 7.2.8. Includes supervision and management (2201), engineering, surveying, and quality control (2204), first aid, fire protection, traffic control, and security (2206), health and safety (2207), temporary construction facilities - ownership (2208), and temporary construction facilities – operation (2209).
28. Solicitation Attachment 7 – Bid Schedule: Please confirm that Item 331XX20 Site Restoration should be included for Optional Task 5d. This item and any associated requirements are not described in PWS Section 6.5 or Section 7.5 and are not included in the other Task 5 building deconstruction tasks.
Answer: Site restoration (331XX20) for optional tasks 5a through 5g has been added to the bid schedule). See attached bid schedule.
29. Solicitation Attachment 7 – Bid Schedule: Please confirm if Tasks 2a through 2f should include a summary subtask 331XX19 – Disposal (Commercial) for subtask 331XX1920 – Container Handling for consistency with PWS Section 6.2 and Section 7.2.6.
Answer: Disposal (331XX19) costs are included under tasks 3a through 3f. Container handling (331XX1920) costs are included under tasks 2a and 2f.
30. Page 45 of 56, Section L, Item (2) Volume II (Factor 2) – Past Performance: The bulleted list at the bottom of page 45 and top of page 46 includes two items – “Name, address, and telephone number of client,” and “Name, address, and telephone number of customer.” Please clarify what the difference is between client and customer.
Answer: No difference.
31. Page 42 of 56, Section L, Item (1) TECHNICAL VOLUMES: We are planning to prepare our five required project descriptions for Volume II (Factor 2) in tabular format for ease of review. Page 42 indicates that “Tables and illustrations may be landscape and may use a reduced font size, no less than 10-point. Please confirm that for Section L project descriptions prepared in tabular format a reduced font size, no less than 10-point, can be used.
Answer: Confirmed.
32. Page 42 of 56, Section L, Item (1) TECHNICAL VOLUMES: The last bulleted statement within this item indicates “Provide a proposal cover sheet with each example past performance project identified in Volume II.” This language is similar to that in the draft RFP where the information required for these cover sheets was described in detail. However, in the final RFP, all other references/descriptions of these cover sheets have been removed. Suggest that this bulleted item be removed since the requirements for the contents of the cover sheets have been integrated into the project descriptions themselves, and all other references to these cover sheets has been removed from the final RFP.
Answer: This was removed via Amendment 01. See Answer to Question 3 from Amendment 01.
33. Please provide the color orthophotograph (or source, ArcGIS Server address, etc.) utilized during the Proposal Kickoff Meeting (ArcGIS portion) that shows the most current site conditions. It appeared the orthophotograph was associated with the Lucas County Engineer/Woolpert, but no source or date was apparent.
Answer: The aerial photo was flown in 2019 and is not associated with the Lucas County Engineer/Woolpert. An aerial photo is included with Amendment 02.
34. Please confirm the sample preparation Conex trailer containing the paint shaker equipment will be available as-is (i.e., including all current components) to the contractor as Government Furnished Equipment as discussed during the USACE Proposal Kickoff Meeting held on 6/24/20.
Answer: The sample preparation conex trailer located east of the laboratory complex will be available.
35. Please confirm the deconstruction of the Main Production Building will be complete and the concrete slab foundation will be available to the contractor for general use upon award of this contract.
Answer: Offerors shall assume the concrete slab foundation will be available to the contractor for general use upon mobilization.
36. Please confirm the analytical methods currently performed and/or DoD ELAP accreditation for the on-site laboratory. The list of ELAP accredited methods provided in PWS Section 5.3.5 includes two organic methods (GC/ECD and GC/MS) that are not currently identified in the ELAP accreditation information available from the ANSI National Accreditation Board website (www.anab.ansi.org).
