3 01 22 00.00 10 - With regards to CLIN 29AE Add cost for Trains - Please advise if we need to insure any other railroads besides NJ Transit. We also need to know the number of passenger and freight trains ,if applicable. This information is required to get a quote for the required railroad insurance.
Only NJ Transit trains run on these tracks. Remainder of this question was answered in Amendment 0004, question 105.
4 01 30 00 para 1.6.a(1) - The referenced insurance specification states "with a contractual liability endorsement covering the risks assumed and indemnification given by the New Jersey Department of Environmental Protection (Non-federal sponsor), Middlesex County, NJ and the Borough of Middlesex, NJ under the Project Agreement and the State/County agreements (a copy of these agreements must be furnished to the insurance underwriter”. Please advise what the endorsement/wording is exactly so we can present it to the underwriter and see if this can be done, and provide the agreements.
No additional language is specified at this time. Please reference what is provided in 01 30 00 para 1.6.a(1).

5 On visiting the site, it was noted that an 8" drainage pipe penetrates the exisitng grouted rip rap at the southwest corner of the South Lincoln Ave. Bridge. This pipe is not referenced anywhere within the contract drawings. It is unclear where the pipe runs or what its limits are. Contract Drawing EC-154 indicates that this location is scheduled to be armored with articulated concrete block. Does the USACE want for this pipe to remain in place? If so, presumably, it will have to penetrate the articulated block revetment. Please provide a detail for this penetration. If the pipe is to be removed, please provide the limits of the pipe's removal.
Pipe is to be removed to a point behind the armor which is to be installed and a specified length of the remaining (buried) pipe from the end will be required to be grouted solid. This will be shown on a revision to drawing CD-154.
6 Based on Section 01 11 00, if Option #1 and/or Option #2 are executed after 182 days after the NTP of the Base bid the, 548 calendar days will be added to the contract duration. Being that this is going to be decided after the bid, there is no mechanism or bid item to capture this extended time for staffing & overhead. We ask that an Alternate Bid Item be added to the contract to account for this extra cost, should it be needed.
No change will be made to the bid list or spec section 01 11 00.
7 After reviewing the painting schedules for the roller gates, 3.5.a and 3.3.4, and consulting with our paint manufacturers we are having a hard time finding a top coat. They have found Paint 38 Level I and Level II but not Level III and suggested perhaps it was supposed to be Paint 36 Level III. If the customer could verify that it is supposed to be Paint 38 Level III and possibly provide an example of a coating that matches that requirement it would be greatly appreciated. Alternatively, if the customer could approve the use of SSPC Paint 38, Level II Corothane I HS Aliphatic Finish Coat for the 3rd coat that would work as well.
3.3.4 System No. 23-A-Z
The coating system shall be applied according to the manufacturer's written instructions. It shall be a 3-coat system. All materials shall be procured from the same coating manufacturer. The individual paints comprising the system shall have been tested and passed all requirements of the applicable SSPC standards. SSPC Paint 38 topcoat shall meet the requirements of Accelerated Weathering Level 3. Application shall be by spray in accordance with the manufacturer's written instructions. Limited use of brush and roller application is permitted provided the specified film thicknesses are achieved. Dry film thickness per coat shall be that recommended by the manufacturer. Application of the system in less than three coats shall not be accepted. The coatings shall be mixed and thinned in accordance with the manufacturer's written directions.
The paint spec will be revised to permit Accelerated Weathering Level 2 rather than Level 3 for the Paint 38 top coat.
ge 27 of 42
Coating material that has exceeded the manufacturer's pot life shall not be applied. Materials that have thickened appreciably shall not be applied. The manufacturer's recommendations for minimum and maximum dry time between coats shall be met. Areas of bubbling noted upon curing of any individual coat shall be removed by sanding or screening. The edges of the repaired areas shall be feathered and the coat reapplied to the repaired areas before a subsequent coat is applied.
3.5 SYSTEM NO. 23-A-Z

9 This paragraph states that Option 1 and/or Option 2 may be exercised within 730 days of the Base Bid NTP. We understand adding in 538 days if this addition is made after 182 days from the Base Bid NTP. We request this methodology be reconsidered. As is, this is a very risky responsibility put on the contractor. In a worse case scenario, this is asking us to be responsible for material escalations and extended Overhead for possibly 3.5 years (730 + 538 days). And, it is possible with this wording that the contractors might not know this for 730 days. No material vendors will hold their pricing for 730 days without a written agreement. The possible scenario as written will result in additional costs being included in the bid. Please reconsider this arrangement in considering awarding Options 1 & 2.
The specifications for Options 1 and 2 will remain as currently written.

12 We assume the various permits listed in several questions will be made available a reasonable time in advance of the Bid Turn In Date. Please confirm this is the case as we will need time to review and account for any impacts to our respective bids.
Confirmed.
13 The answer in Question #32 in Addenda #5 states "The permits will be added to the Specifications when they are received from the permitting agencies."
Will the permits be available in a timely fashion before the Bid Due Date? I am guessing, depending on all of the content possibly involved, that we will need a couple of weeks to review and plan for any contingencies in our bid preparation. We are already inside of that two weeks. May we suggest moving back the bid date again if they are not available this week, or, perhaps, waiting until the permits are received before setting a new bid date? Please advise by tomorrow, Friday, 1/6, if the bid date will be moved back due to this, and other, issues. And, we still do not have the plans mentioned in Addenda #5 that were promised yesterday, 1/4/23.
The FHA, FWW, SESC and NJPDES permits are included in the Amendment 0007 specifications. Ample time will be provided for their review before the bids are due.
14 Can you please advise if a new Amendment has been prepared for Solicitation No. W912DS22B0022? The sam.gov web site indicates that an update to Solicitation No. W912DS22B0022 was made on December 23, 2022 at 6:45 p.m. Is there any new information pending to be posted?
Additional Amendments have been issued since the submission of this RFI.

15 Paragraph 1.3.4 Approved Mitigation Banks indicates, that the Cranbury Mitigation Bank is approved to serve the project area (WMA 09) for forested wetlands, open water and riparian zone impacts. We have been notified that this do not appear to be correct. Please see below an excerpt from the NJDEP web site indicating that this riparian zone only serves WMA 10. Can you please advise? This information can be reviewed at the NJDEP Mitigation Bank web site https://www.nj.gov/dep/opi/riparian-zone-
NJDEP has approved the purchase of riparian mitigation credits from the Cranbury Mitigation Bank.

16 Section 01 22 00.00 10, page 2 describes Price and Payment Procedures for bid item 0005 – Floodwall (Segments C2 and H) a- Please confirm that Concrete Cut-off walls at Segment H, as shown on sheets S-351 thru S-358, will be paid under bid item 0015 b- For Segment C-2, sheet S-104, note 10 states “If sheet pile minimum tip elevation is not achieved, use a concrete cut-off wall…” Please confirm that if necessary, these concrete cut-off walls will be measured and paid under bid item 0015
a. Confirmed - concrete cut-off walls beneath Segment H floodwalls will be paid for under bid item 0015.
b. Sheet pile has been driven to refusal beneath the existing floodwall monoliths on both sides of the Segment C2 rolling closure gate monoliths (C2-16 and C2-17), so the need for concrete cut-off walls beneath these two monoliths is not expected. If concrete cut-off walls become necessary, they will be paid for at the same unit price (per square foot) as included in the bid item for the Segment H concrete cut-off walls.
17 Section 03 11 13.00 10 – Structural Cast-in-Place Concrete Forming, Paragraph 1.4 requires building sample panels for flood wall. Is the contractor allowed to build these panels as part of the planned floodwalls provided that sample panels are approved?
This question is not clear. The sample panels must be constructed and approved before actual floodwall construction can commence.
18 Amendment #4, page 55 of 62, Answer to question #124, references bid items 0030AA and 0030AF. These bid items are not included in Amendment #4 Bid Item list. Please revise the response to this question referencing updated bid items.
The bid list item numbers have changed. 0030AA Segment C2 Levee and BDR2 Pond is now 0026AA; 0030AF Pond BDR3 is now 0026AA.

19 Reference is made to Addendum #4 question and answers for the above referenced project, several questions specifically numbers 19/31/40/42/54/92 concern missing permits and agreements referenced in Section 00 90 01 thru 00 90 04. Have these documents been provided yet, if not do you see the bids being postponed again until they are available?
The permits are included in Amendment 0007.
20 Will all of the acknowledgments of amendments be required to be submitted by the bid due date? I don’t see the “hour and date specified in the solicitation” that the acknowledgment must be submitted by, unless that just refers to the current bid due date.
Yes, all amendments need to be acknowledged by the bid due date.
Please refer to Amendment 0006 for the last posted instructions for bid submission.
21 With the revision to the contract documents in Addendum 5, and the pending drawings (requested in previous RFI) as well as RFI responses, we hereby request a 3 week extension to the bid date for time to perform a comprehensive review of documents and pending responses.
Bid due date was extended, as per Amendment 0006.
22 Please provide copies of the Waste Disposal Profiles and any available supporting analytical data for the Contaminated, Non-hazardous Soils previously disposed of.
Waste disposal profiles are not available.
23 We are requesting a bid extension of at least two weeks. Bid due date was extended, as per Amendment 0006.
24 In addendum 5 RFI question #40 confirms that the RFI submission deadline is 1/4/2023 at 4 PM and yet addendum 5 was issued this morning, will an additional addendum be issued for questions submitted prior to the 1/4/2023 4 pm submission deadline?
Refer to Amendment 0006 and 0007 for additional responses to RFIs.
25 Amendment No. 5 posted on Tuesday January 3, 2023 is listing thirty (30) Contract drawings that have been revised and reissued. Please be advised that no drawings have been included on the Amendment. Can you please advise if those drawings will be posted separately?
Due to technical issues, there was a slight delay in posting additonal files to SAM.gov. All drawings in relation to Amendment 0005 have since been posted.
26 Can bid date be extended to account for amendment #5 specification and plan changes?
Bid due date was extended since the submission of this RFI.

27 Amendment # 4 Q # 67. Can you better explain the required depth or thickness of the rip rap for this area. It can be interpreted in two ways. One being the berm is constructed with imported levee material and this area is then lined with fabric, #57 stone (6”-thick) and rip rap (12 or 18” - thick). Two being the entire berm is constructed of rip rap over #57 stone & fabric. There is a significant difference in quantity of rip rap material needed between these two interpretations.
Please look closely at the levee cross-section on drawing C-352.
There is a callout at the center of the levee section that says "Compacted Embankement Material (See Specifications)" which is "soil" as opposed to "stone" as required by the specifications. The geotechnical fabric is laid on top of the embankment material, followed by 6" of #57 or #67 aggregate bedding, followed by D50=6" rip-rap which forms the 10'-wide bench. The hatching of the bench is intended to make clear that it is all rip-rap.
28 Was there a mandatory meeting and is there a place where I can view a plan holders list?
No, and there is no plan holders list. Please refer to the self-disclosed interested bidders listed on SAM.gov under this solicitation and the site-visit sign-in sheet posted after the optional site visit.
29 Utility Allowance Items. This subject is addressed in a number of Q&A’s. It is a bit confusing from our perspective when answers state the allowance is only for what the contractor is invoiced and pays the utility company. The answers imply that the contractor will be responsible for work or costs but does not clearly define what the contractor is expected to perform. In other words and specifically Amendment #4 Q&A #4, the answer sounds as if the contractor will be responsible for relocating the conduits but what would keep the contractor from hiring the utility company to do the work. This then would fall under costs to be paid back to the utility and reimbursed through the allowance. If this is the intent can you please confirm. If not can you please provide specific tasks/costs to be provided by the contractor when coordinating these activities?
The division of work between contractor and utility is a matter to be decided between the contractor and the utiility. Costs invoiced to the contractor by the utility are covered under the allowance.
30 I am reaching out to see if you have a prospective bidders list so we can get our pricing to all the GC’s bidding the project.
There is no plan holders list.
Please refer to the self-disclosed interested bidders listed on SAM.gov under this solicitation and the site-visit sign-in sheet posted after the optional site visit.
31 Can the contractor use mill secondary casing for permanent micropiles?

2.7 Added Intake Testing Noted
3. Renumbered following paragraphs Noted
4. 2.9.2 Modified cavitation test requirements (previously paragraph 2.8.2) See pumps manufacturer statement Manufacturer is pointing out as follows with the test requirements outlined.
Manufacturer is unable to test in accordance with the specification.
Manufacturer is proposing an alternate test plan for the NPSH on these pumps and offer the following for consideration.
The main limitation for this testing is that manufacturer cannot develop a low enough NPSHA to cause the pump to achieve a 3% drop in head, signifying cavitation.
Manufacturer proposes to perform the NPSH testing via the over-speed method. That is to overspeed the pump to roughly 65Hz.
This method lowers the NPSHA available to the pump by about 15% and allowing manufacturer to develop a minimum NPSHA of 34.9ft. This result indirectly proves the NPSHR at duty points. Those values are below the minimum NPSHA via the over-speed method. As such, manufacturer will not likely be able to find a 3% drop at five points across the curve. Testing the pump in this way will show points on the curve, where manufacturer can achieve the required 3% drop in head due to cavitation.
Summary: NPSH test results would be points on the curve where the NPSHR exceeds that 34.9ft value, and not at the duty points.
The cavitation test requirements in spec section 35 45 02.00 10, paragraph 2.9.2 have been modified to allow submission of NPSHR validation data from prototype tests.
33 If a riparian zone bank is not currently approved to sell riparian zone mitigation credits for Watershed Management Area (WMA 09), we suggest the government to provide allowance amounts for Items Nos. 0022, 0023 and 0024, in order to even the bidding plainfield.
NJDEP has approved the purchase of riparian mitigation credits from the Cranbury Mitigation Bank.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), http://www.dol.gov/agencies/whd/government-contracts ge 40 of 42 a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014.
PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers.
