SUBJECT: Follow-on Section 7 Consultation Regarding Revised Design for the
Project to Replace/Upgrade Pier 2 at Military Ocean Terminal Concord, Concord, CA

Dear Mr. Stern:
The Department of the Army (Army) submitted a letter to the National Marine
Fisheries Service (NMFS) dated January 29, 2016 regarding the proposed design changes for the project to replace/upgrade Pier 2 at Military Ocean Terminal Concord (MOTCO), California and potential need for re-initiation of formal consultation under Section 7 of the Endangered Species Act. At the request of U.S. Fish and Wildlife Service (USFWS) and as coordinated with NMFS, the Army prepared a letter dated June 3, 2016 wherein the Army evaluated the potential changes in the effects as compared to the NMFS Biological Opinion (BO) and Essential Fish Habitat (EFH) Response dated November 19, 2014 (SWR-2013-9819). This letter concluded that, overall, the effects of the revised design are expected to have lesser impact on the species addressed in the BO and EFH Consultation.
A conference call was held on August 10, 2016 with NMFS and USFWS to further exchange information regarding the revised design and analysis. This letter is in response to additional information and clarification requested during this conference call, including reconsideration of some design elements to further ensure that the potential effects of the redesign would have lesser effect to the species as addressed in the BO.
Specifically, the Army has 1) reverted to a conceptual redesign construction timeline that conforms with the notional schedule provided in prior consultations and
2) revised the placement of the electrical feeder line for the electrical substation.
Additionally, the Habitat Restoration Plan and associated Shoreline Protection Plan are under preparation and we expect to submit these for your review and approval in late October. As stated in the February 2015 Final Environmental Impact Statement for the Modernization and Repair of Piers 2 and 3 at MOTCO, these plans were developed as part of the design process and the Army committed to providing NMFS with an opportunity for review of these plans. A brief summary of the content of these plans is provided below. All other elements of the revised design are the same as those described in the June 3, 2016 letter. With these changes, the Army is confident that all effects of the redesign are within the scope of the impacts of the Pier 2 project as

Construction and Demolition Timeframes. The requested additional detail on the planned schedule for implementation of the project is provided in Enclosure 1. The Army has ensured that this schedule conforms to the timeline of the BO, specifically: 27 months to complete the project start to finish; including 24 months for construction and 7 months for demolition.
Substation Electrical Feeder Line Corridor Realignment. The Army has evaluated an alternate pathway, shown in Enclosure 2, and the proposed utility corridor has been rerouted to occur within the footprint of existing roadways. The proposed rerouting of the utility line corridor avoids the potential impacts for USFWS administered species noted in the June 3, 2016 letter.
Habitat Restoration Plan and Shoreline Protection Plan. The Habitat Restoration Plan addresses the restoration of habitat within the areas currently occupied by structures to be removed. The Habitat Restoration Plan also includes the removal of stands of perennial pepperweed (Lepidium latifolium), grading to establish elevations less favorable for pepperweed, and restoration in place for wetlands disturbed during construction to provide a more continuous intertidal to upland marsh habitat dominated by native species. The associated Shoreline Protection Plan details the plan for prevention of erosion of the shoreline west of Pier 2 and repair of the shoreline rock revetment along White Road and includes an estimated approximately 0.25-acre area of unavoidable impact to intertidal wetlands. The Habitat Restoration Plan provides for no net loss of wetlands and a 2:1 wetlands mitigation ratio (approximately 0.57 acres).
These plans also will be submitted to the U.S. Army Corps of Engineers and the San Francisco Bay Regional Water Quality Board as part of the Clean Water Act Section 404 and 401 permitting for the Pier 2 project.
The following additional details are provided to supplement the June 3, 2016 letter with additional information as requested by NMFS and USFWS during the August 10, 2016 conference call.
Use of Cushion Blocks. The Army remains committed to the use of cushion blocks made of wood or a composite material, such as Micarta™, to reduce impact pile driving noise. The June 3, 2016 letter updated the noise analysis to reflect newer guidance against applying a specific sound level reduction credit for the use of a cushion block.
No Simultaneous Pile Driving. Pile driving will occur at the same rate as analyzed in the BO (4-5 piles per day, on average). The June 3, 2016 letter included analysis that assumed that two pile driving rigs may be used for an approximately 15-day period. The BO did not specify number of rigs and the Army’s noise analysis in the BA was based on one rig being operational at any given time. The June 3, 2016 letter analyzed a worst-case scenario assumption involving simultaneous strikes of two pile drivers. However, the Army is committed to implementing management practices to ensure piles will not be driven simultaneously by these rigs. Specifically, the contractor will be required to ensure that there is communication between the two operations that will allow one rig to commence pile driving activities while the second is positioning and staging the next pile installation during the approximately 15-day period. Thus, contemporaneous rig operations will not result in additive sound pressure levels experienced by species in the vicinity of the work area.
As indicated in the updated conceptual schedule for the project, Enclosure 1, much of the pile driving work would occur during the approved salmonid work window of June 1st through November 30th. This updated work schedule is similar to the notional schedule that the Army provided in the August 2014 Addendum to the Army’s Biological Assessment for the Pier 2 project. The approximately 15-day contemporaneous pile driving at the West Trestle and Main Platform is scheduled for August 2018.
Summary Differences Between the Pier 2 Redesign as Compared to the Project as Defined in the EFH and BO.
• Reduced total Pier 2 footprint (the new pier will be reduced by
30,942 square feet under the existing Pier 2 footprint, which is approximately 15,963 square feet smaller than the footprint of the previous design).
• New West Trestle. Under the redesign, the west trestle would be combined with the forklift trestle, thus eliminating the second trestle approach footprint (see Enclosure 2). The habitat impacts of the new west trestle footprint would be offset by the removal of structures associated with the existing west trestle, forklift trestle, and pedestrian trestle and associated habitat restoration. Therefore, the overall trestle footprint would be over a similar sized area and within the project footprint as addressed in the BO.
• Fewer piles (the redesign includes installation of 793 24-inch octagonal concrete piles, whereas the BO included 876 of these piles).
• No dredging.
• Less extensive repairs to White Road (the redesign would repair 1,350 linear feet; the BO included approximately 8,500 linear feet of this road).
• Please see the June 3, 2016 letter for additional detail.
Conclusion. The Army believes the determinations of potential impacts to species analyzed in the BO and EFH Consultation remain unchanged with the Pier 2 redesign.
These conclusions are restated as likely to adversely affect but not likely to jeopardize the continued existence of Central Valley steelhead, Central California Coast steelhead, Sacramento River Winter-run Chinook, Central Valley Spring-run Chinook, or North American green sturgeon. The Pier 2 project is likely to adversely affect but not likely to jeopardize the continued existence of these species or destroy or adversely modify Sacramento winter-run Chinook or green sturgeon designated critical habitat. With respect to EFH, these conclusions were that the Pier 2 project would have an adverse effect to Pacific Groundfish, Pacific Coast Salmon, and Coastal pelagic EFH:
The Army remains committed to continued adherence to the reasonable and prudent measures, terms and conditions, and conservation recommendations of the BO pursuant to Section 7 of the Endangered Species Act and the EFH Conservation Recommendations pursuant to the Magnuson-Stevens Fishery Conservation and Management Act.
