SECTION 01 22 00
MEASUREMENT AND PAYMENT
PART 1 GENERAL
1.1 BASE BID JOB PAYMENT ITEMS
Payment items for the work of this contract for which contract job payments will be made are listed in the CLIN SCHEDULE and described below. All costs for items of work, not specifically mentioned in a particular job or unit price payment item, shall be included in the listed item most closely associated with the work involved. The job price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, safety requirements, monitoring, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
1.1.1 Initial Project Mobilization and Final Project Demobilization
1.1.1.1 Payment
Payment will be made for costs associated with Initial Project Mobilization and Final Project Demobilization, as defined in Section 00 70 00, Clause 252.236-7004 PAYMENT FOR MOBILIZATION AND DEMOBILIZATION, to wit:
(a) The Government will pay all costs for the mobilization and demobilization of all of the Contractor's plant and equipment at the contract lump sum price for this item.
(1) 65 percent of the lump sum price upon completion of the contractor's mobilization at the work site.
(2) The remaining 35 percent upon completion of demobilization.
(b) The Contracting Officer may require the Contractor to furnish cost data to justify this portion of the bid if the Contracting Officer believes that the percentages in paragraphs (a) (1) and (2) of this clause do not bear a reasonable relation to the cost of the work in this contract.
(1) Failure to justify such price to the satisfaction of the Contracting Officer will result in payment, as determined by the Contracting Officer, of:
(i) Actual mobilization costs at completion of mobilization;
(ii) Actual demobilization costs at completion of demobilization;
and
(iii) The remainder of this item in the final payment under this contract
(2) The Contracting Officer's determination of the actual costs in paragraph (b)(1) of this clause is not subject to appeal.

1.1.1.2 Unit of Measure
Unit of measure: Job
1.1.2 MEC Construction Support
1.1.2.1 Payment
Payment will be made for costs associated with MEC Construction Support operations required to discover and identify MEC in the Terrestrial Explosion Area MRS and provide MEC Construction Support in both the Water Explosion Area MRS and Terrestrial Explosion Area MRS when intrusive construction activities are performed under Base Bid items as described in the contract documents, which includes required MEC coordination and reporting. If a MEC item is discovered by the Contractor's operation and MEC avoidance is not an an acceptable construction option, then a MEC response action consisting of either removal and disposal, or blast-in-place will be ordered by the Contracting Officer and paid for under the respective CLIN item.
MEC Construction Support associated with intrusive construction for specific Bid Options will be paid under the respective CLIN item.

1.1.3 Demolition and Deconstruction
1.1.3.1 Payment
Payment will be made for costs associated with Demolition and Deconstruction operations to remove existing Pier 2 as described in the contract documents, which comprises all demolition and deconstruction work not paid under another CLIN item and includes removal and disposal of hazardous materials prior to demolition/deconstruction, salvage of the fender and security system components and navigation warning signs for reuse by the contractor on this project, salvage of pier supported railroad rails with delivery to the Government at the specified MOTCO location, and removal of all debris for recycling or disposal.

1.1.4 Site Civil Work
1.1.4.1 Payment
Payment will be made for costs associated with Site Civil Work necessary to replace/upgrade Pier 2 as described in the contract documents for base bid items, which includes the new West Trestle approach, wick drains, staged surcharge fill construction and monitoring, Pier 2 parking lot improvements including seismic instrumentation ground station and electrical substation concrete pads, White Road pavement section removal and reconstruction from station 18+90 to 25+42, and for the Base Bid reach of White Road:
demolition, salvage of onshore railroad rails with delivery to the government at the specified MOTCO location, removal of the demolished trestle approach fills, drainage improvements, clearing and grading for

1.1.4.1.1 Unit of Measure

1.1.5 Site Mechanical Work
1.1.5.1 Payment
Payment will be made for costs associated with Site Mechanical Work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes onshore firewater, potable water, sanitary sewerage systems, all with connection to the respective MOTCO systems, and the work on these systems required during the West Trestle approach fill construction to maintain or restore uninterruptible utility service.
1.1.5.2 Unit of Measure

1.1.6 Site Electrical Work
1.1.6.1 Payment
Payment will be made for costs associated with Site Electrical Work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes Pier 2 substation, White Road lighting, onshore electrical, communications, security, fire alarm, and lighting systems, all with connection to the respective MOTCO systems, and the work on these systems required during the West Trestle approach fill construction to maintain or restore uninterruptible utility service, spare conduits and the seismic instrumentation ground station.

1.1.7 Pier West Trestle Deck Structure
1.1.7.1 Payment
Payment will be made for costs associated with Pier West Trestle Deck Structure work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes pile caps, precast prestressed slab beams, cast-in-place concrete topping, abutment, safety railings, structural provision for utilities, storm water system, striping and signage.

Structure work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes cast-in-place concrete deck, container crane and mooring appurtenances, fender system with new piles as needed, seismic joint cover system at the east and west trestle interfaces, safety railings, structural provision for utilities, storm water system, aids to navigation, striping and signage.

1.1.9 Pier East Trestle Repairs/Main Platform Transition Ramp
1.1.9.1 Payment
Payment will be made for costs associated with Pier East Trestle Structure work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes deck demolition and reconstruction for the Trestle/Main Platform transition ramp, and repair of concrete spalls, and cracks and expansion joints, selective demolition of existing utilities and structural provision for new utilities along the entire East Trestle.

1.1.10 Pier Mechanical Work
1.1.10.1 Payment
Payment will be made for costs associated with Pier Mechanical Work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes pier main platform, west trestle and east trestle firewater, potable water and sewerage systems, all with connection to the respective onshore systems at the East and West Trestles; except therefrom the building interior mechanical systems paid under the Pier Operations Building CLIN item.

1.1.11 Pier Electrical Work
1.1.11.1 Payment
Payment will be made for costs associated with Pier Electrical Work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes pier main platform, west trestle and east trestle electrical, communications, security, fire alarm, lightning protection, grounding, and lighting systems, all with connection to the respective onshore systems at the East and West Trestles, and the main platform seismic instrumentation; except therefrom the building interior electrical systems paid under the Pier Operations Building CLIN item.

1.1.12 Pier Operations Building
1.1.12.1 Payment
Payment will be made for costs associated with Pier Operations Building work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes architectural, structural, and building interior mechanical, electrical, plumbing, communications, security, and seismic instrumentation systems, all with connection to the respective Pier systems, and building interior furnishing and signage.
1.1.12.2 Unit of Measure

1.2 BASE BID UNIT PRICE PAYMENT ITEMS
Payment items for the work of this contract for which contract unit price payments will be made are listed in the CLIN SCHEDULE and described below.
The unit price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, safety requirements, monitoring, tests and reports, and for performing all work required for each of the unit price items.
1.2.1 Furnish Test Piles
1.2.1.1 Payment
Payment will be made for costs associated with Furnish Test Piles consisting of fabricate, deliver and store at the work site the required lengths of prestressed concrete test piles necessary to replace/upgrade Pier 2 as described in the contract documents, which includes accessory items required to facilitate the test pile driving program.
1.2.1.2 Measurement
The quantity of Furnish Test Piles for which payment will be made will be measured by the length of pile between the cut-off elevation and the tip elevation specified on the plans, plus the required test pileoverlength.
No payment will be made for exceeding the required lengths. No payment will be made for piles damaged during handling, storage or installation if they have been rendered unsuitable for the permanent work as determined by the Contracting Officer. Payment for replacement piles will be made at the applicable unit price.
1.2.1.3 Unit of Measure

1.2.2 Furnish Octagonal Production Piles
1.2.2.1 Payment
Payment will be made for costs associated with Furnish Octagonal Production Piles consisting of fabricate, deliver and store at the work site the required lengths of prestressed concrete production piles necessary to replace/upgrade Pier 2 as described in the contract documents, which includes accessory items required to facilitate pile driving.

1.2.2.2 Measurement
The quantity of Furnish Octagonal Production Piles for which payment will be made will be measured by the length of pile between the cut-off elevation and the tip elevation specified on the plans or directed by the Contracting Officer based on the results of the Test Pile Program, plus the required production pile overlength. No payment will be made for exceeding the required lengths. No payment will be made for piles damaged during handling, storage or installation if they have been rendered unsuitable for the permanent work as determined by the Contracting Officer. Payment for replacement piles will be made at the applicable unit price.
1.2.2.3 Unit of Measure

1.2.3 Install Test Piles
1.2.3.1 Payment
Payment will be made for costs associated with Install Test Piles consisting of remove from storage and drive the required lengths of prestressed concrete test pile necessary to replace/upgrade Pier 2 as described in the contract documents, which includes pile dynamic tests, data analysis, pile driving records, report submittal, redrive if required to meet specified driving criteria, pile cut-off or pile buildup if required to obtain specified cut-off elevation for the permanent work, in order to install test piles to the specified driving criteria, within specified driving tolerances.
1.2.3.2 Measurement
The quantity of Install Test Piles for which payment will be made will be measured by each test pile installed per the Test Pile Program requirements. No payment will be made for test piles damaged during handling or driving, or for test piles that have not been installed in conformance with the driving requirements if they have been rendered unsuitable for the permanent work as determined by the Contracting Officer. Payment for replacement piles will be made at the applicable unit price.

1.2.4 Install Octagonal Production Piles
1.2.4.1 Payment
Payment will be made for the costs associated with Install Octagonal Production Piles consisting of remove from storage and drive the required lengths of prestressed concrete production pile necessary to replace/upgrade Pier 2 as described in the Contract Documents, which includes pile driving records, pile cut-off or pile buildup if required to obtain specified cut-off elevation, in order to install production piles to the specified driving criteria within specified driving tolerances.

1.2.4.2 Measurement
The quantity of Install Octagonal Production Piles for which payment will be made will be measured by each production pile installed per the driving requirements. No payment will be made for production piles damaged during handling or driving, or for production piles that have not been installed in conformance with the driving requirements if they have been rendered unsuitable for the work as determined by the Contracting Officer. Payment for replacement piles will be made at the applicable unit price.

1.3.1 Pier East Trestle Pavement Renewal
1.3.1.1 Payment
Payment will be made for costs associated with Pier East Trestle Pavement Renewal work necessary to replace/upgrade Pier 2 as described in the contract documents, which includes AC surface removal for recycling or disposal, salvage of railroad rails with delivery to the Government at the specified MOTCO location, repair of trestle expansion joints, and new AC surfacing with striping and signage.

1.3.3.1 Payment
Payment will be made for costs associated with White Road 'West' Reconstruction necessary to replace/upgrade Pier 2 as described in the contract documents, which includes pavement section removal and reconstruction from Station 11+95 to 18+90, and for the Bid Option 3 reach of White Road: demolition, salvage of railroad rails with delivery for storage at the specified MOTCO location, removal of the demolished trestle approach fills, the Port Chicago Naval Magazine National Memorial Shoreline Protection System and Pathway, striping and signage, and MEC Construction Support for intrusive construction activities under this item.

1.3.4.1 Payment
Payment will be made for costs associated with East Approach Roadway Reconstruction (vicinity White Road station 37+00) necessary to replace/upgrade Pier 2 as described in the contract documents, which includes pavement section removal and reconstruction, salvage of railroad rails with delivery for storage at the specified MOTCO location, and bollards, striping and signage, and MEC Construction Support for intrusive construction activities under this item.

1.4 BID OPTION UNIT PRICE PAYMENT ITEMS
1.4.1 Production Pile Dynamic Tests
1.4.1.1 Payment
Payment will be made for costs associated with Production Pile Dynamic Tests ordered by the Contracting Officer consisting of dynamic test measurements, data analysis and report submittal necessary to replace/upgrade Pier 2 as described in the Contract Documents, which includes items incidental to the tests in order to confirm successful production pile installation.
1.4.1.2 Measurement
The quantity of Production Pile Dynamic Tests for which payment will be made will be measured by each production pile tested and passed per the Test requirements. No payment will be made for pile tests that reveal a defective production pile installation.
1.4.1.3 Unit of Measure
Unit of measure: Each
1.4.2 Production Pile Redrive
1.4.2.1 Payment
Payment will be made for costs associated with Production Pile Redrive ordered by the Contracting officer consisting of redrive for a production pile that has been installed to the specified tip elevation, and whose installation has been interrupted to allow "set up" in order to achieve specified driving resistance, which includes items incidental to the redrive procedure.
1.4.2.2 Measurement
The quantity of Production Pile Redrive for which payment will be made will be measured by each production pile redriven following the ordered setup
01 22 00 - 10 Amendment 0002 period. Payment will be made for Pile redrive even if the pile fails to achieve the specified driving resistance when driven to tip elevation allowed by the maximum pile buildup.
1.4.2.3 Unit of Measure

1.4.3 Pile Spudding (or Predrilling)
1.4.3.1 Payment
Payment will be made for costs associated with Pile Spudding (or Predrilling) ordered by the Contracting Officer consisting of spudding (or predrilling) to facilitate installation of a test or production pile that has encountered an obstruction during initial installation and cannot be readily relocated or otherwise installed without spudding (or predrilling) the obstruction, and includes removal and redriving of the pile and items incidental to the spudding (or predrilling) procedure.
1.4.3.2 Measurement
The quantity of Pile Spudding (or Predrilling) for which payment will be made will be measured by each pile spudded (or predrilled) upon encountering an obstruction. Payment will be made for Pile Spudding (or Predrilling) even if the operation fails to penetrate the obstruction to allow successful pile installation.
1.4.3.3 Unit of Measure

1.4.4 MEC Removal and Disposal
1.4.4.1 Payment
Payment will be made for costs associated with MEC Removal and Disposal ordered by the Contracting Officer consisting of remove and dispose of the MEC item discovered by the Contractor as a result of the MEC construction support operations conducted under another CLIN item, and includes work suspension costs and any other work incidental to the removal and disposal procedure.
1.4.4.2 Measurement
The quantity of MEC Removal and Disposal for which payment will be made will be measured by each action resulting from a single MEC discovery;
multiple MEC items discovered at the same location including up to three
(3) items if each item does not exceed the NEW of a 7" shell as described in the Munitions Response Site documents, and no two objects in the group are farther than 2'-0" apart will constitute a single action.
1.4.4.3 Unit of Measure

1.4.5 MEC Blast-in-Place
1.4.5.1 Payment
Payment will be made for costs associated with MEC Blast-in-Place ordered by the Contracting Officer consisting of destruction of a MEC item in situ discovered by the Contractor as a result of the MEC construction support operation conducted under another CLIN item and deemed unacceptable to move, and includes move out, move in and standby costs for Contractor equipment and personnel required to conduct the Blast-in-Place procedure and any other work incidental to the procedure.
1.4.5.2 Measurement
The quantity of MEC Blast-in-Place for which payment will be made will be measured by each action resulting from a single MEC discovery; multiple MEC items discovered at the same location will constitute a single action.
1.4.5.3 Unit of Measure
Unit of Measure: Each
1.4.6 Pruitt Road Rail Crossing Line and Surface Track
1.4.6.1 Payment
Payment will be made for costs associated with Pruitt Road Rail Crossing Line and Surface Track ordered by the Contracting Officer consisting of concrete crossing removal, line and surface track, crossing reinstallation, and approach pavement repair.
1.4.6.2 Measurement
The quantity of Pruitt Road Rail Crossing Line and Surface for which payment will be made will be measured by each complete line and surface procedure ordered.
1.4.6.3 Unit of Measure
Unit of Measure: Each
1.4.7 Roadway and Utility Subgrade Overexcavation and Replacement
1.4.7.1 Payment
Payment will be made for costs associated with Roadway and Utility Subgrade Overexcavation and Replacement with engineered fill ordered by the Contracting Officer consisting of removing and disposing of soft soils below the design neat lines shown on the plans and furnishing, compacting engineered fill in its place, and MEC Construction Support for intrusive construction activities under this item.
1.4.7.2 Measurement
The quantity of Roadway and Utility Subgrade Overexcavation and Replacement with engineered fill for which payment will be made will be measured by the cubic yard within the neat lines of the overexcavation ordered.

1.2 DEFINITIONS
1.2.1 Environmental Pollution and Damage
Environmental pollution and damage is the presence of chemical, physical, or biological elements or agents that adversely affect human health or welfare; unfavorably alter ecological balances of importance to human life;
01 57 20 - 3 Amendment 0002 affect other species of importance to humankind; or degrade the environment aesthetically, culturally and/or historically.
1.2.2 Environmental Protection
Environmental protection is the prevention/control of pollution and habitat disruption that may occur to the environment during construction. The control of environmental pollution and damage requires consideration of land, water, and air; biological and cultural resources; and includes management of visual aesthetics; noise; solid, chemical, gaseous, and liquid waste; radiant energy and radioactive material as well as other pollutants.
1.2.3 Contractor Generated Hazardous Waste
Contractor generated hazardous waste means materials that, if abandoned or disposed of, may meet the definition of a hazardous waste. These waste streams would typically consist of material brought on site by the Contractor to execute work, but are not fully consumed during the course of construction. Examples include, but are not limited to, excess paint thinners (i.e. methyl ethyl ketone, toluene etc.), waste thinners,excess paints, excess solvents, waste solvents, and excess pesticides, and contaminated pesticide equipment rinse water.
1.2.4 Land Application for Discharge Water
The term "Land Application" for discharge water implies that the Contractor must discharge water at a rate that allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, discharge into defined drainage areas, or discharge into the "waters of the United States" may occur. Land Application must be in compliance with all applicable Federal, State, and local laws and regulations.
1.2.5 Surface Discharge
The term "Surface Discharge" implies that the water is discharged with possible sheeting action and subsequent soil erosion may occur. Waters that are surface discharged may terminate in drainage ditches, storm sewers,creeks, and/or "waters of the United States" and would require a permit to discharge water from the governing agency.
1.2.6 Waters of the United States
All waters which are under the jurisdiction of the Clean Water Act, as defined in 33 CFR 328.
1.2.7 Wetlands
Those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, and bogs. Official determination of whether or not an area is classified as a wetland must be done in accordance with
WETLANDS DELINEATION MANUAL.
1.3 GENERAL REQUIREMENTS
Minimize environmental pollution and damage that may occur as the result of

The environmental resources within the project boundaries and those affected outside the limits of permanent work must be protected during the entire duration of this contract. Comply with all applicable environmental Federal, State, and local laws and regulations.
Any delays resulting from failure to comply with environmental laws and regulations will be the Contractor's responsibility.
1.4 SUBCONTRACTORS
Ensure compliance with this section by subcontractors.
1.5 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for Contractor Quality Control approval. Submit the following in accordance with Section 01 33 00
SUBMITTAL PROCEDURES:

Submit the Preconstruction Submittals no less than 30 calendar days prior to the start of on-site construction activities. Work at the site will not be allowed to commence until all required Preconstruction submittals have been reviewed and approved by the Government. Note that the Hydroacoustic Monitoring Plan component of the Environmental Protection Plan must be approved at least 90 days prior to the initiation of pile driving at Pier
2. The Army will provide the final Environmental Protection and any other construction-related plans consisting of envrionmental BMPs to U.S. Fish and Wildlife Service (USFWS) at least 30 days prior to the start of construction actions.
1.6 ENVIRONMENTAL PROTECTION PLAN
Prior to commencing construction activities or delivery of materials to the site, the Contractor must submit an Environmental Protection Plan for review and approval by the Contracting Officer (KO). The purpose of the Environmental Protection Plan is to present a comprehensive overview of known or potential environmental issues that the Contractor must address during construction. Issues of concern must be includedwithin the Environmental Protection Plan as outlined in this section. Contractor shall address each topic at a level of detail commensurate with the environmental issue and required construction task(s). Various elements of the Plan will be developed by the Contractor and others, where noted, will be supplied by the Army. Topics or issues that are not identified in this section, but are considered necessary, must be identified and discussed after those items formally identified in this section. For additional details regarding pertinent environmental issues, please refer to the corresponding portion of Section 3 EXECUTION. Prior to the final submittal of the Environmental Protection Plan, Contractor shall meet with the Contracting Officer for the purpose of discussing the implementation of the initial Environmental Protection Plan; possible subsequent additions and revisions to the plan including any reporting requirements; and methods for administration of the Contractor's Environmental Plan. The Environmental Protection Plan must be current and maintained onsite by the Contractor.

1.6.1 Compliance
No requirement in this Section will relieve the Contractor of any applicable Federal, State, and local environmental protection laws and regulations. During Construction, the Contractor will be responsible for identifying, implementing, and submitting for approval any additional requirements to be included in the Environmental Protection Plan.
1.6.2 Contents
Contractor shall include in the environmental protection plan, but not limit it to, the following elements (further description of these requirements can be found in corresponding portions of Section 3):
a. Name(s) of person(s) within the Contractor's organization who is(are) responsible for ensuring adherence to the Environmental Protection Plan.
b. Name(s) and qualifications of person(s) responsible for manifesting hazardous waste to be removed from the site, if applicable.
c. Names and qualifications of the biologist (s) assigned to fulfil Biological Monitoring Function and to provide environmental protection training to Contractor personnel. (See section 1.9 for Biological Monitor qualification)
d. Description of the Contractor's environmental protection training program (Section 3.13).
e. A Contractor-developed Storm Water Pollution Prevention Plan (SWPPP) that meets the requirements of the Clean Water Act Section 402 National Pollutant Discharge Elimination System (NPEDES) Constrution General Permit obligations in California, including identification of the type and location of the erosion and sediment controls to be provided, such as in an Erosion and Sedimentation Control Plan, and monitoring and reporting requirements to assure that the control measures are in compliance with the SWPPP and Federal, State, and local laws and regulations. (A Storm Water Management Plan (SWMP) may be substituted for this plan.) Must be in compliance with Clean Water Act permit requirements.
f. A Contractor-developed set of drawings showing locations of proposed temporary excavations or embankments for haul roads, stream crossings, material storage areas, structures, sanitary facilities, and stockpiles of excess or spoil materials including methods to control runoff and to contain materials on the site. Contractor to include information for some of these areas as available in existing project environmental documentation and identified in Contractor Survey Report (see Section 1.7).
g. A contractor-developed Traffic control plan, including measures to reduce erosion of temporary roadbeds by construction traffic, especially during wet weather. Plan shall include measures to minimize the amount of mud transported onto paved public roads by vehicles or runoff. Contractor to utilize haul and installation egress routes as designated in existing project environmental documentation.
Movement of heavy equipment to and from the project site shall be restricted to established roadways to minimize habitat disturbance.
Workers are to use the parking lot near Gate 1 and be shuttled to the work site. Should Gate 1 become unavailable for this use at any time
01 57 20 - 6 Amendment 0002 during project implementation, another centralized worker parking site would be established at another appropriate and existing site approved for supporting MOTCO's construction staging and parking needs. Gates 2 and 5 would be used for truck traffic, with Gate being the primary truck traffic route, and Gate 5 used occasionally for oversized materials and equipment throughout the project.
h. A Contractor-developed Work area plan showing the proposed activity in each portion of designated areas and identifying the areas of limited use or nonuse (see Sections 1.7 and 3.2.1). Plan should include measures for marking the limits of use areas including methods for protection of features to be preserved within authorized work areas.
i. A Contractor-developed Spill Protection, Control, and Countermeasures P lan (SPCC or Spill Control Plan) that outlines the procedures, instructions, and reports to be used in the event of an unforeseen spill of a substance regulated by 40 CFR 68, 40 CFR 302, 40 CFR 355, and/or regulated under State or Local laws and regulations. The SPCC supplements the requirements of EM 385-1-1 and is included in the SWPPP. See Section 3.5 for additional detail. Include in this plan, as a minimum:
(1) The name of the individual who will report any spills or hazardous substance releases and who will follow up with complete documentation. If a reportable quantity is released to the environment, this individual will immediately notify the Contracting Officer and Facility Fire Department Facility Environmental Office in addition to the legally required Federal, State, and local reporting channels (including the National Response Center 1-800-424-8802). Include in the SPCC Plan a list of the required reporting channels and telephone numbers.
(2) The name and qualifications of the individual who will be responsible for implementing and supervising the containment and cleanup.
(3) Spill Training requirements for Contractor's personnel and methods of accomplishing the training.
(4) A list of materials and equipment to be immediately available at the job site, tailored to cleanup work of the potential hazard(s) identified.
(5) The names and locations of suppliers of containment materials and locations of additional fuel oil recovery, cleanup, restoration, and material-placement equipment available in case of an unforeseen spill emergency.
(6) The methods and procedures to be used for expeditious contaminant cleanup.
j. A Contractor-developed Non-Hazardous Solid Waste Disposal Plan identifying methods and locations for solid waste disposal including clearing demolition and construction debris and schedules for disposal.
Plan shall also include any additional provisions necessary for the removal, transport, and proper disposal of creosote-treated pilings in a facility licensed by the state of California to accept treated wood waste (TWW). See Section 3.5 for additional detail.
01 57 20 - 7 Amendment 0002
(1) Identify any subcontractors responsible for the transportation and disposal of solid waste. Submit licenses or permits for solid waste disposal sites that are not a commercial operating facility.
(2) Evidence of the disposal facility's acceptance of the solid waste must be attached to the Solid Waste Disposal Plan and records maintained throughout the construction.
(3) As part of Solid Waste Disposal Plan, Contractor shall develop a Recycling and Solid Waste Minimization Plan, including a list of measures to reduce consumption of energy and natural resources.
Detail in the Plan the Contractor's actions to comply with and to participate in Federal, State, Regional, and local government sponsored recycling programs to reduce the volume of solid waste at the source.
(4) Quarterly Diversion Reports shall be submitted to the Contracting Officer for the previous quarter on the first working day after the first quarter that non-hazardous solid waste has been disposed and/or diverted (e.g. the first working day of January, April, July, and October) Indicate in the report the total amount of waste generated and total amount of waste diverted in cubic yards or tons along with the percent that was diverted. Attach a copy of each of the Non-hazardous Solid Waste Diversion Reports to the Solid Waste Disposal Plan.
k. A Contractor-developed Air Pollution Control Plan detailing provisions to assure that dust, debris, materials, trash, etc., do not become air borne and travel off the project site. In addition, a Contractor-developed Air Quality Control Plan must demonstrate compliance with local and state air quality laws and regulations, as required by the Bay Area Air Quality Management District (BAAQMD) and California Air Resources Board (CARB), see paragraph 3.4.4 Air Quality Control Plan for further details.
l. A Contractor-developed Hazardous Material Management Plan (HMMP) that:
identifies potentially hazardous substances to be used on the job site;
identifies the intended actions to prevent introduction of such materials into the air, water, or ground; and details provisions for compliance with Federal, State, and local laws and regulations for storage and handling of these materials. Hazardous Waste Management measures required to handle and dispose of any hazardous waste or excess hazardous materials shall be part of the HMMP. In accordance with EM 385-1-1, a copy of the Material Safety Data Sheets (MSDS) and the maximum quantity of each hazardous material to be onsite at any given time must be included in the HMMP. Update the plan as new hazardous materials are brought onsite or removed from the site. A Hazardous Communication (HazCom) Plan/Program shall be prepared as part of the HMMP and the Accident Prevention Plan (APP) as required by EM 385-1-1, 06.B.01 (USACE 2014). See section 3.5 for additional detail.
m. A Contractor-developed Waste Water Management Plan (WWMP) that identifies the methods and procedures for management and/or discharge of waste waters that are directly derived from construction activities, such as concrete curing water, clean-up water, and water used in flushing of lines. The WWMP will be in accordance with the requirements stated in the 401 Certification.
n. Contractor will integrate procedures determined in existing project
01 57 20 - 8 Amendment 0002 documentation provided by the Army into the Contractor's Environmental Protection Plan (see Section 1.7). Contractor will include specific plans for identifying and protecting historical, archaeological, and cultural resources; biological resources; and wetlands known to be on the project site and/or identifying procedures to be followed if historical archaeological, and cultural resources; biological resources; and wetlands not previously known to be onsite or in the area are discovered during construction. Include in the Plan methods to assure the protection of known or discovered resources and identify lines of communication between Contractor personnel and the Contracting Officer (see Section 3.8).
o. A Contractor-developed Pesticide Treatment Plan, as necessary. Include in the plan: sequence of treatment, dates, times, locations, pesticide trade name, EPA registration numbers, authorized uses, chemical composition, formulation, original and applied concentration, application rates of active ingredient (i.e. pounds of active ingredient applied), equipment used for application and calibration of equipment. Federal, State, Regional and Local pest management record keeping and reporting requirements as well as any additional Installation Project Office specific requirements are the Contractor's responsibility in conformance with DA AR 200-1 Chapter 5--Pest Management, Section 5-4 "Program requirements" for data required to be reported to the Installation. Must be in compliance with the installation's Integrated pest Management Plan, the Habitat Restoration Plan, and Clean Water Act permit requirements. Rodenticides, pesticides, and herbicides will not be utilized by the Army and/or their contractor(s) in the action area without prior review and approval by the USFWS.
p. An Army-developed Water Quality Monitoring Plan (WQMP), as approved through the Clean Water Act 401 Certification process, and implemented by the contractor throughout the duration of the project during sediment-disturbing in-water activities. This Plan ensures the project's compliance with Clean Water Act Section 401 Water Quality Certification requirements. Water quality data from locations upstream versus downstream of project activities will be used to determine the extent of project-related effects on water quality such as turbidity and contaminants and to limit such effects in accordance with criteria set forth in the certification. The WQMP shall specify sample locations, depths, constituents, and objectives during in-water construction work. The WQMP will also specify when work will be suspended for water quality exceedances and potential BMPs to comply with turbidity requirements stated in the 401 Certification.
q. A Contractor-developed Hydroacoustic Monitoring Plan shall be submitted to the Contracting Officer for review/approval by the National Marine Fisheries Service (NMFS) and USFWS at least 90 days prior to the initiation of pile driving at Pier 2. The Monitoring Plan must, at minimum, include underwater sound measurements at 10 meters distance from pile driving operation. It is anticipated the Hydroacoustic Monitoring Plan will include noise measurements from 10 percent of the smaller 18-inch square fender piles and 1 to 2 percent of the larger 24-inch octagonal piles throughout the depth range. To the extent feasible, it is anticipated that a vibratory hammer will be used to drive the concrete piles to reduce underwater sound from impact pile driving. Likewise, if two boats are performing in water construction activities on the same day, Contractor will ensure that pile driving will not occur simultaneously. In addition, cushion blocks made of wood
01 57 20 - 9 Amendment 0002 or a composite material such as Micarta will be used to reduce impact pile driving noise. (See Section 3.3 for further details). The Biological Monitor must make data from the hydroacoustic monitoring program available to the KO on a real-time basis (i.e., daily monitoring data should be accessible to USFWS and NMFS upon request).
If hydroacoustic monitoring detects elevated sound levels during pile driving above a maximum peak of 178 dB, 155 dB SEL, and 166 dB RMS for 10% or more of the strikes associated with installation of a pile, the Contractor must notify the KO as soon as possible so that the Army, in turn, notifies Gary Stern of NMFS (phone 707-575-6060 or email gary.stern@noaa.gov) within 24 hours of the exceedance event.
Hydroacoustic monitoring data shall include:
(1) the locations (depths and distance from point of impact) where monitoring was conducted,
(2) the total number of pile strikes per pile,
(3) total number of strikes per day,
(4) the interval between strikes,
(5) the peak/SPL, RMS and SEL per strike, and
(6) accumulated SEL per day.
1.6.3 Appendix
Attach to the Environmental Protection Plan, as an appendix, copies of all environmental permits, permit application packages, approvals to construct, notifications, certifications, reports, and termination documents.
1.7 PROTECTION FEATURES
