About this file

This is Amendment 0001 to solicitation W9123625B5002 for the Craney Island Eastward Expansion (CIEE) Pre-Dredging Phase 1C project issued by the USACE Norfolk District. The amendment makes several key changes: reduces the government acceptance period from 180 to 120 calendar days, clarifies that the site visit on January 27, 2025 is not mandatory, confirms there are no dredging restrictions for the main dike and access channels, and provides that dredging depth for the main channel will be -41 feet MLLW (correcting drawing sheet G-105).

The amendment includes responses to 25 bidder inquiries addressing topics such as insurance requirements, endangered species monitoring, water quality monitoring parameters, and survey requirements. It deletes three FAR clauses related to printed materials and drug-free workplace requirements. Four new attachments are incorporated providing coordinate and survey data. The bid due date of February 12, 2025 at 2:00 PM ET remains unchanged, with bid opening scheduled for February 13, 2025. The amendment also clarifies that CLIN 0002 covers additional NODS surveys beyond those required in the specifications and allows contractor personnel performing endangered species monitoring to have other concurrent duties.

ProjNet Bidder Inquiries and Corresponding Government Responses:

1. Bidder Inquiry number 11143783:

Regarding the insurance requirements, do you have a requirement for Additional Insured with waiver of subrogation?

Government Response to Bidder Inquiry number 11143783:

The solicitation states the requirements for insurance to be provided by the contractor. There is no requirement for the insurance to name the Government as an additional insured or for a waiver of subrogation.

2. Bidder Inquiry number 11146195:

Is the January 27, 2025 Site Visit, referenced in FAR Clause 52.236-27 SITE VISIT (CONSTRUCTION), mandatory?

Government Response to Bidder Inquiry number 11146195:

The scheduled site visit at the Craney Island Dredged Material Management Area for 27 January 2025, 9 AM EST is not mandatory.

3. Bidder Inquiry number 11154443:

Section 35 20 23, page 5, paragraph 1.4.c states; "Time-of-Year Restriction: There is no dredging restriction for dredging of the main dike and access channels."

The VA DEQ Water Protection Permit dated 26 May 2021, paragraph C.5 states; "At the time of permit issuance, the Time-of-Year restriction to protect anadromous fish was February 15 to June 15 during dredging of the project access channel."

These statements are contradictory. Please clarify if there are any Time-of-Year restrictions associated with this bid.

Government Response to Bidder Inquiry number 11154443:

To clarify, there is no dredging restriction for dredging of the main dike and access channels.

4. Bidder Inquiry number 11154457:

Section 35 20 23, page 15, paragraph 3.2.4 states; "A complete listing of all dredging plant and machinery to be used in the work, including skiffs, barges, and other related equipment, must be submitted."

When is this listing to be submitted? Is it to be submitted with the bid, or is it a pre-construction submittal?

Government Response to Bidder Inquiry number 11154457:

The successful low bidder as part of the pre-award process and in accordance with specification section 00 21 00 - Instructions, paragraph 8(f) may be required to submit an equipment list to demonstrate that they have the necessary equipment to be considered a responsible bidder.

In addition, the successful awardee will be required to submit a complete listing of all dredging plant and machinery to be used in the work prior to commencement of construction activity.

5. Bidder Inquiry number 11154468:

Section 35 20 23, page 8, paragraph 1.8.3 states; "In computing the limiting amount of side-slope dredging an over depth of one foot measured vertically will be used."

The conflicts with the 2-foot overdepth stated elsewhere in the bid documents and drawings.

Please confirm that the overdepth allowance if 2 feet for all portions of this bid.

Government Response to Bidder Inquiry number 11154468:

To confirm, 2 feet of overdepth dredging will be allowed within the contract dredging pay prism, to include channel side slopes.

6. Bidder Inquiry number 11154480:

Section 35 20 23, page 6, paragraph 1.5.4 states; "Soundings must be taken by an acoustic multi-beam swath method. The multi-beam swath survey may be supplemented with dual frequency single-beam acoustic surveys (nominally 24-38 kHz and 200 kHz)."

Are there any areas of the project that USACE anticipates potentially using low-frequency soundings for payment?

Government Response to Bidder Inquiry number 11154480:

Low-frequency soundings will not be used for acceptance of work or for payment.

7. Bidder Inquiry number 11159971:

Section 01 45 00.00 Page 6. Para 3.4.2 CQC System Manager. Please confirm that the CQC System Manager is not required to be present onsite 24 hours per day. Please clarify the required hours.

Government Response to Bidder Inquiry number 11159971:

See amendment 0001. Specification section 01 45 00, paragraph 3.4.2. Will be amended to reflect that the CQC System Manager must be on the site daily during construction for a minimum of one full shift or 8 hours.

8. Bidder Inquiry number 11159994:

Section 35 20 23 Page 6, Para 1.5.4. It is the understanding that a Multi-Beam Method will be used for surveys. Please clarify the average grid sorting that will be used for payment and acceptance i.e. 3' x 3', 4' x 4', etc.

Government Response to Bidder Inquiry number 11159994:

To clarify, with respect to the multi-beam method, data will be sorted using a 3 foot by 3 foot grid for payment and acceptance of work.

9. Bidder Inquiry number 11160094:

Section 35 20 23 Page 11 Para 1.17 Continuity of Work states, "No payment will be made for work done in any area designated by the CO until the full depth required ...is secured in the whole such area, nor will payment be made for excavation in any area not adjacent to and in prolongation of areas where full depth has been secured, except by decision of the Contracting Officer. Should any such nonadjacent area be excavated to full depth during the operations carried on under the contract, payment for all work therein may be deferred until the required depth has been made in the area intervening.

Section 35 20 23 Page 5, Para 1.5.1 Acceptance Sections states, ...must not exceed up to four

(4) acceptance sections for the entire Craney Island Eastward Expansion Phase 1C dredging area.

These could imply Contractor would essentially need to complete 2 acceptance sections before getting paid for the first area. Please clarify these statement that conflict with the monthly partial payment in Section 01 20 00 Pages 4 & 5.

Government Response to Bidder Inquiry number 11160094:

See amendment 0001. Specification section 35 20 23, paragraph 1.17 and reference to continuity of work will be deleted.

10. Bidder Inquiry number 11160116:

Section 35 20 23 Page 14 Para 3.2.3. Please clarify if furnishing ranges is the Contractor's responsibility.

Government Response to Bidder Inquiry number 11160116:

To clarify, it is not anticipated that a range will be required to define the work and to facilitate inspection. However, if for an unforeseen circumstance a range is required to define the work and to facilitate inspection, it will be the responsibility of the Contractor to furnish the range.

11. Bidder Inquiry number 11160344:

Section 00 21 00 Page 6/70, Bid Submission Instructions, states, All bids must be submitted by electronic commerce only (that is by submission via PIEE).

Bids will be submitted through the Solicitation Module of the Procurement Integrated Enterprise Environment (PIEE) suiter at https://piee.eb.mil.

Please post this solicitation (#W9123625B5002) on the PIEE site for Bidders.

Government Response to Bidder Inquiry number 11160344:

Bids must be submitted through the Solicitation Module of the Procurement Integrated Enterprise Environment (PIEE) suite at https://piee.eb.mil in accordance with Section 00 21 00. This solicitation and all amendments are posted to PIEE and sam.gov.

12. Bidder Inquiry number 11160696:

Please confirm if contractor personnel for monitoring are able to hold additional responsibilities on equipment.

Government Response to Bidder Inquiry number 11160696:

The specification requires that the contractor must maintain a bridge watch of the visible action area for endangered species, whales, dolphins, and porpoises (01 57 50, 3.2). This does not preclude any contractor personnel from holding additional responsibilities on equipment.

13. Bidder Inquiry number 11160698:

Please confirm if endangered species monitors are required to be a third party hired by the contractor.

Government Response to Bidder Inquiry number 11160698:

No, the monitors may be contractor personnel.

14. Bidder Inquiry number 11160725:

#19 mentions it being due at both time of bid opening and of low bidder. Can we ask: Section 00 21 00 Instruction to Bidders #19 says a Small Business Subcontracting Plan is due of low bidder at time of bid opening. Please clarify if the Plan is due at the time of bid on 2/12/25, at the time of bid opening on 2/13/25 or only when requested of the apparent low bidder by the Contracting Officer.

Government Response to Bidder Inquiry number 11160725:

See amendment 0001. Solicitation section 00 21 00, paragraph 19 regarding Small Business Subcontracting Plan submittal.

15. Bidder Inquiry number 11163835:

When does the Government anticipate issuing contract award and NTP?

Government Response to Bidder Inquiry number 11163835:

It is the Government's intent to award the contract during the normal course of business, soon after bid opening. It is the Government's intent to issue the NTP during the normal course of business, soon after contract award.

16. Bidder Inquiry number 11163852:

This section states, "If at any point water quality monitoring indicates that permit-specified water quality criteria are being exceeded, the Contractor must modify operations as necessary to reduce the turbidity. If directed by the Contracting Officer, the Contractor must immediately modify operations as necessary to reduce turbidity or other water quality impacts. Modifications could include varying cutter-head speed (in the case of hydraulic dredging); slowing operations; using alternate equipment (i.e. closed, sealed or smaller-sized buckets in the case of clamshell dredging); avoidance of certain tidal conditions; stopping overflow of the disposal scow; fix, maintain, or upgrade floating silt curtains; repositioning dredging or placement operations in such a way as to ensure future exceedances do not occur; modifying work schedule; and/or temporarily stopping the work to allow turbidity to dissipate." Any of the above mitigation measures listed would severely impact the contractor's bid production rates and could also increase costs. Please provide the water quality parameter exceedance levels that could trigger any of the mitigation measures listed above.

Government Response to Bidder Inquiry number 11163852:

Delete "If at any point water quality monitoring indicates that permit-specified water quality criteria are being exceeded, the Contractor must modify operations as necessary to reduce the turbidity."

No replacement. The existing second sentence will drive the requirement.

17. Bidder Inquiry number 11163961:

The Water Quality Plan requires that 3 samples be taken at each of the 8 River locations – surface, mid, and bottom depth. The water quality parameter measurements will vary at each depth. As such, are the 3 samples averaged for a more accurate picture of the entire water column before determining an exceedance? Please provide all exceedance criteria and, if necessary, exceedance levels for each parameter at surface, mid, and bottom depth.

Government Response to Bidder Inquiry number 11163961:

Reference specification section 01 57 19, 3.3.1 "Water Quality Monitoring", sub-item "h. USACE environmental staff and the contracting officer will be notified immediately if the dissolved oxygen level observed during in-river monitoring at any sampling depth is below 5.0 mg/L.". Data generated from sample locations and depths should be reported discretely and not averaged.

Reference specification 01 57 19 3.3.1 "Water Quality Monitoring" regarding information that must be recorded and submitted.

18. Bidder Inquiry number 11163962:

180 days (or 6 months) for government acceptance creates excessive risks for contractors. Six months of exposure to resource and fuel price fluctuations with no ability hedge between bid submission and award is not reasonable. Please reduce the number of days for government acceptance of the offer to 60.

Government Response to Bidder Inquiry number 11163962:

See amendment 0001. Standard Form 1442, block 13.D regarding Government acceptance.

19. Bidder Inquiry number 11163963:

Page 1 of 30 shows the Permit expiring on March 08, 2025. Please provide the status of renewal.

Please also confirm that no terms regarding this contract will be changed in the renewed/new permit and that this expiring permit will not affect contract award or NTP.

Government Response to Bidder Inquiry number 11163963:

The DEQ VWP permit is expiring on 8 March 2025 and will not be renewed. All relevant requirements of the permit were incorporated into the specifications and will not change. The expiration of the permit will not affect contract award or NTP.

20. Bidder Inquiry number 11163965:

Is CLIN 0002 intended to cover the required Pre-Placement, Post-Placement, and Monthly Conditional Surveys of NODS described in Section 35 20 23 along with the cost of the Contracting Officer Directed NODS Surveys?

Government Response to Bidder Inquiry number 11163965:

To clarify, CLIN 0002 is for additional NODS surveys beyond the required surveys outlined in specification section 35 20 23, paragraph 3.5.2.1.

CLIN 0002 requirements are outlined in specification section 35 20 23, paragraph 3.5.2.2 and specification section 01 20 00, paragraph number 1.3.2.

21. Bidder Inquiry number 11163966:

Please confirm that the contractor's personnel who will be monitoring the visible action area from the dredge plant can also perform their normal, concurrent job duties and that a dedicated Endangered Species Monitor is not required.

Government Response to Bidder Inquiry number 11163966:

The specification requires that the contractor must maintain a bridge watch of the visible action area for endangered species, whales, dolphins, and porpoises (01 57 50, 3.2). This does not preclude any contractor personnel from holding additional responsibilities on equipment.

22. Bidder Inquiry number 11163967:

"...Scows must travel at a speed of 1 to 3 knots during placement." This is an excessively slow speed range for a tug towing a barge in open ocean conditions. Speeds this slow can be hazardous to safe navigation and barge control during most normal ocean wave and wind conditions and would only be reasonable on the calmest days. Please revise this language to "Scows must travel at a speed of 1 to 3 knots or slowest safe navigable speed during placement."

Similar safe speed language is typical in other USACE districts on the east coast.

Government Response to Bidder Inquiry number 11163967:

See amendment 0001. Specification section 35 20 23, paragraph 3.5.1 will be amended to include the recommended language "Scows must travel at a speed of 1 to 3 knots or slowest safe navigable speed during placement."

23. Bidder Inquiry number 11164237:

On Sheet G-105 of the plans, the main channel required dredge depth is identified as -42'. Please confirm this should be 41' as per the specifications.

Government Response to Bidder Inquiry number 11164237:

See amendment 0001. Drawing sheet G-105 will be amended to indicate a required dredging depth of -41 feet MLLW within the main channel dredging prism.

24. Bidder Inquiry number 11164238:

Please provide the northing and easting coordinates for all the toe of slopes inflection points for the Main Dike dredge area, Southern Access Channel and Central Access Channel. There currently isn't any way to map the dredge prism, especially the irregular dredge prism boundaries between Main Dike stations 0+00 and 10+00.

Government Response to Bidder Inquiry number 11164238:

See amendment 0001. The requested northing and easting coordinates will be provided by amendment in the form of an ASCII file.

25. Bidder Inquiry number 11164239:

Please provide the latest bathymetric survey(s) of all project dredge areas in XYZ format (ASCII file).

Government Response to Bidder Inquiry number 11164239:

See amendment 0001. The requested surveys will be provided by amendment in the form of an ASCII file.

SECTION 00 10 00 - SOLICITATION

The offeror acceptance period has decreased by 60 from 180 to 120.

SECTION 00 21 00 - INSTRUCTIONS

The following have been modified:

INSTRUCTIONS TO BIDDERS

1. TOTAL EVALUATED PRICE (TEP)

Total Evaluated Price (TEP) = ALL Base CLINs Apparent Low Bidder is determined by the TEP TOTAL BASE CLINs (CLIN 0001 – CLIN 0005 ): $____________________

2. PROJECT DESCRIPTION

Required work includes new work dredging by mechanical or bucket plant at the southeastern cell of the CIEE. The southeastern cell main dike footprint is being deepened to a required depth of -41 feet mean lower low water (MLLW). Also, the central and southern access channel footprints are being deepened to a required depth of -25 feet MLLW. Two feet of allowable over depth dredging will be part of the contract dredging pay prism for both the main dike and access channel footprints. A main dike footprint not to exceed depth of -46 feet MLLW will be observed for this project. A central and southern access channel footprints not to exceed depth of -30 feet MLLW will be observed for this project. Material removed from the dike footprint will be received by ocean-going scows and placed at the Norfolk Ocean Disposal Site (NODS). The scope requires a 3-year US Environmental Protection Agency USEPA Section 103 concurrence, and the estimated volume to be placed at NODS is 3-million cubic yards.

The Contractor shall be responsible for the following: dredging within the designated areas to the proposed and allowable pay depths, placing the removed material in ocean-going barges, transporting the ocean-going barges with the collected material to NODS, depositing the collected material at NODS, and communicating with the Port of Virginia maritime users to minimize impacts to vessel traffic and other dredging operations.

3. MAGNITUTDE OF CONSTRUCTION

In accordance with DFARs 236.204(ii), the estimated Magnitude of Construction for this project is between $25,000,000.00 and $100,000,000.00.
