H17 ACCESS AND GENERAL PROTECTION/SECURITY POLICY AND PROCEDURES FOR UNCLEARED
NON-CAC ELIGIBLE CONTRACTORS
1. The Contractor shall comply with, and in the instance of contractor/sub-contractor employees, shall ensure compliance with the following instructions when access to the Fort Leonard Wood installation/facilities are required for contract performance. These local instructions are incorporated in this contract, in order to implement local installation antiterrorism/operations security policies and procedures, and to supplement Federal Acquisition Regulation (FAR) clause 52.204-9, which, if applicable to this contract, is located in Section I. In the event of conflict between any portion of this supplement and/or FAR 52.204-9; and any other provision within the SOW, PWS, or specifications; clause 52.204-9 (if listed in Section I) shall take precedence. In the event of conflict between this supplement and any other provision within the SOW, PWS, or specifications, this supplement shall take precedence.
a. An uncleared contractor is an individual who falls into one of two categories: (1) CAC-eligible; and (2) Non-CAC eligible. The Common Access Card (CAC) is the DoD federal personal identity verification credential.
CAC Eligibility is defined in Army Directive 2014-05, dated March 7, 2014.
b. Army Directive 2014-05 provides that all contractor and/or subcontractor personnel who do not possess a CAC, another Federal personal identity verification card, or other authorized DoD identification card and who require unescorted access to Army installations must have a validated need for such access and undergo a vetting process to determine their fitness for access. Accordingly, non-CAC eligible, uncleared contractor and/or sub-contractor personnel requiring access to the Fort Leonard Wood installation and facilities, to perform under this contract, will submit personal identity information through the Fort Leonard Wood Installation Pass implementation system detailed in subparagraph (1) below. There is no charge to the Contractor or employees for this pass.
Request for pass must be submitted a minimum of ten working days prior to date access is planned.
(1) The requesting Contractor personnel and sub-contractor’s personnel shall submit their requests for installation pass to their sponsor via the web based Fort Leonard Wood Installation Pass Application IM3500 Secure Webportal, located at the following web link: https://vcc1.icmvcc.com/im3500/. The minimum information required to complete the pass application at the Fort Leonard Wood Installation Pass Application IM3500 Secure Webportal listed in paragraph b, above, is as follows: 1. Point of Contact Email (Valid sponsor’s email address). A valid sponsor is the COR, COTR, or other Government employee designated in writing by the Contracting Officer (KO) at time of contract award, post award conference, or pre-construction conference; or the KO if no other designation is made. 2. Visitor’s email address; 3. ID Number (Visitor’s Driver’s License Number); 4. ID Jurisdiction (State that issued the visitor driver’s license); 5. Visit Start Date (The first date of visitor’s visit); 6. Visit End Date (The last date of visitor’s visit, not to exceed the length of the contract or one year, whichever is shorter); 7. Visitor’s Name (Last name, First name, Middle name & suffix); 8. Phone Number and Address; 9. Date of Birth; 10. Eye Color; 11. Hair Color; 12. Sponsoring Organization and Applicant’s Company Name. Additionally, vehicle information may be required (Vehicle VIN Number, Plate Number, Plate Jurisdiction, Vehicle Year of Manufacture, Vehicle Make, Vehicle Model, Vehicle Color, and Vehicle Type)
(2) The information collected at this website will be used by the government to query, at a minimum, the National Crime Information Center Interstate Identification Index (NCIC-III) and the Terrorist Screening Database (TSDB) to determine if the person requesting unescorted access presents a potential threat to the good order, discipline, or health and safety on the installation. Army Directive 2014- 05, enclosure 2, establishes Army policy for adjudication and screening standards to control the access of unescorted uncleared contractors (contractor and subcontractor personnel) to Army installations and facilities.
(3) Uncleared contractor personnel will, in the absence of an approved waiver, be denied unescorted access to Fort Leonard Wood should the above mentioned checks contain credible derogatory information indicating that the individual may present a threat to the good order, discipline, or health and safety on the installation. Such derogatory information includes, but is not limited to that provided within Enclosure 2, Army Directive 2014-05 (Policy and Implementation Procedures for Common Access Card Credentialing and Installation Access for Uncleared Contractors), which is available to the public at the following website: http://www.apd.army.mil/ .
c. All contractor and subcontractor personnel performing tasks on this contract shall at all times comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures provided herein and otherwise provided to the Contractor by an authorized Government representative.
Contractors are warned that Installation area access control plans may require increased vigilance and restrictions on access to military installations in the case of heightened Force Protection Condition (FPCON) levels. If task completion is hampered by temporary Government limitations on access to the Installation, the Contractor and Contracting Officer shall negotiate any extensions on delivery necessitated by emergency situations. In addition, if heightened security requires the submission of additional security information and/or the implementation of additional security measures the Contractor shall fully cooperate with Government security procedures and requests for information.

D. Site Visit. The Government will hold a site visit at Fort Leonard Wood on 19 April 2019 beginning at 10:00am in building 11400, 8112 Nebraska Avenue, Fort, Leonard Wood, MO 65473. All interested firms may attend with a limit of three (3) attendees per firm. Please submit, in writing, the names of attendees to the Purchasing Agent by 2:00 pm on 1 April 2019.
2) GENERAL INSTRUCTIONS
A. The selection of a source for award will be conducted utilizing source selection (negotiated) procedures as delineated in FAR Part 15.3. Offers will be evaluated using the criteria under Section M, “Evaluation Factors for Award”. Noncompliance with the Request for Proposal (RFP) requirements may hamper the Government's ability to properly evaluate the proposal and may result in elimination of the proposal from further consideration for contract award.
B. The Offer. The submission of the documentation specified below will constitute the Offeror's acceptance of the terms and conditions of the RFP, concurrence with the SOW, and the proposed contract type.
C. It is the Government’s intention to award without discussions. Offerors are encouraged to present their best proposal and prices in their initial proposal submission. However, IAW FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold discussions. If this occurs, a competitive range will be determined and Offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306(c)(2).
D. The Proposal Preparation Instructions (Para. L.3.) as set forth below prescribe the format for the proposal and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.
E. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the Offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.
F. If an Offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the Offeror shall immediately notify the Contracting Officer in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
G. Debriefings. The Contracting Officer will promptly notify Offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR
15.505. The Contracting Officer will notify offerors who were in the competitive range of the source but were not selected for award in accordance with FAR 15.503(b). Upon such notification, unsuccessful offerors may request and receive a debriefing in accordance with the requirements of FAR 15.506.
3) PROPOSAL PREPARATION INSTRUCTIONS
A. Offeror’s proposal shall consist of four (4) separate volumes: Volume I – General, Volume II - Technical
Acceptability, Volume III - Past Performance, and Volume IV - Pricing Proposal.
B. Proposal Format:
i. Offerors shall submit an original and the number of copies listed in Table 2 - Volume Details.
ii. Exceptions. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors and elements. Failure to meet a requirement may result in an offer being ineligible for award. If the offeror finds it necessary to take exception to any of the requirements specified in this solicitation, the offeror shall clearly identify the applicable Volume and exceptions with a complete explanation of why the exception was taken, what benefit accrues to the Government (if any), and its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Offerors are cautioned that taking an exception may render the offer ineligible for award. This information shall be provided in the format below.

iii. The proposals shall be organized into four (4) volumes. Each volume of the proposal should be separately bound in a three-ring loose leaf binder which shall permit the volume to lie flat when open.
A cover sheet should be bound in each book, clearly marked as to volume number, title, copy number, solicitation identification and the Offeror's name. The same identifying data should be placed on the spine of each binder. All text shall be single spaced and printed black on white paper (black and white requirement does not apply to graphics, photos, etc., Company stationary and logo’s are acceptable).
Printing shall be easily readable (12-pitch type or 10 point proportional spacing.) Cross-references should be utilized to preclude unnecessary duplication of data between sections. In addition to submitting hard copies of the proposals, digital copies shall be provided on CD-ROM disk in Microsoft Word, PowerPoint, Excel or Adobe PDF. File names to be “Company Name – Initial” for the first submission. File name of later submissions (if necessary), shall be “Company Name – Revision X’ with X indicating the number of the revision. If files are compressed, they must be self-extracting archives (no software required to decompress). If files contain links, the links must be intact and maintained through all revisions. Additionally, spreadsheets must be easily traceable. None of the files submitted shall have any read/write/password protection. Page limitations are as follows:

iv. Proposal Limitation. The proposal shall not exceed the limits stated above. If the page limits are exceeded, the pages in excess of the limit shall be removed and returned, unread, to the Offeror. The Government will not accept any changes to the contractor’s proposal after the closing date of the solicitation (See FAR 15.208 for further information regarding late proposals). If discussions become necessary, page limitations may be placed on responses to Evaluation Notices (ENs). The specified page limits for EN responses will be identified in the letters forwarding the ENs to the Offerors.
v. Page Limit Includes: All appendices, charts, graphs, diagrams, tables, photographs, drawings, etc.
vi. Page Limit does not include the Executive Summary, covers for volumes, tables of contents, glossary of abbreviations and acronyms, indices, title pages, cross reference indices, and section dividers/tables if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal. They will be counted if they contain any other information, i.e., diagrams, extraneous data, etc. Pages marked “This page intentionally left blank” will not be counted.
vii. What Counts As A Page? A page shall be an 8 ½ X 11” sheet of paper. When both sides of a sheet display printed material, it shall be counted as two pages. Letter size and spacing requirements for illustrations and tables can be at the discretion of the Offeror but must be easily readable. Fold-outs will be counted as the appropriate number of pages based on an 8 ½ X 11” sheet of paper. Use at least 1 inch margins on the top and bottom and 3/4 inch side margins. The Contractor shall number each page in order to eliminate any confusion. In the event the contractor creates an ambiguity in their numbering of pages, the Government may exercise its own discretion in counting pages.
viii. Indexing. Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify sections.
ix. Glossary of Abbreviations and Acronyms. Each volume shall contain a glossary of all abbreviations and acronyms used, with an explanation for each.
C. Proposal Content
i. Volume I – General. Offerors are required to submit a completed SF 1442 (including acknowledgment of Amendments), Section B, and Section K. All final monetary extensions shall be in whole dollars only. Failure to follow the below Contract Proposal preparation instructions may cause your proposal to be deemed unacceptable by the Government. The General Volume shall be organized as follows and contain the identified information.
TAB A, Exceptions/Assumptions (if required) - Identification and explanation of any exceptions or deviations. Additionally, any assumptions used in the proposal preparation must be identified.
TAB B, SF 1442 - The SF 1442 shall be fully completed upon submission. The offeror is cautioned that the SF 1442 must contain an original signature in block 30 A, B, and C of the form. The contractor shall acknowledge any amendments to the RFP in accordance with the instructions on the SF 1442 with Section L, FAR 52.215-1 (b), Instruction to Offerors—Competitive Acquisition. The offeror shall provide the name, title and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.
TAB C, Section B (Supplies or Services and Prices/Costs) - Section B shall be submitted fully completed and error free. It shall contain the offeror’s prices for the established Contract Line Items (CLINS).
TAB D, Section K (Representation, Certifications, and Other Statements of Offerors) – The offeror shall ensure that Section K is submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely.
ii. VOLUME II – TECHNICAL ACCEPTABILITY: The Technical Acceptability
Volume shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. Legibility, clarity and coherence are very important. Your responses will be evaluated against the Technical Acceptability Factor as defined in Section M, Evaluation Factors for Award. The proposal should not simply rephrase or restate the Government's requirements; the proposal shall provide convincing rationale to address how the Offeror intends to meet these requirements. Statements that the Offeror understands, can, or will comply with the SOW (including referenced publications, technical data, etc.); statements paraphrasing the SOW or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will be considered unacceptable and will negatively impact the Offerors rating under the Technical Acceptability factor. Offerors shall assume that the Government has no prior knowledge of their facilities and experience, and will base its evaluation on the information presented in the Offeror's proposal. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired.

TAB D - Technical Acceptability Content – The Technical Volume shall, at a minimum, be prepared in a form consistent with the Statement of Work (SOW) and the evaluation criteria for award set forth in Section M of this solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the contractor’s technical competence and ability to comply with the contract task requirements specified in the SOW. The offeror shall address as specifically as possible the actual methodology you would use for accomplishing the SOW tasks. The volume shall be organized according to the following general outline:
a. TAB D1 - Sub-Factor 1: Organizational Structure
1.1. Organizational Chart/Management Approach. (This sub-factor element is applicable to both the overall IDIQ contract and sample task order).
The offeror shall provide an organizational chart that clearly illustrates the management, construction teams, and key positions to be utilized in executing task orders under the contract. In addition, offerors shall describe their overall management approach with regard to organization which demonstrates an understanding of construction processes, coordination, monitoring, and control of construction projects. A clear, logical and effective approach shall identify the lines of authority and communications between home office, construction teams, subcontractor operations, Government project managers, contracting officials, inspectors, and users. Offerors methodology to subcontracting managing multiple task orders of varying size and complexity issued simultaneously, and interfacing with the Government shall be included. The offeror shall possess the skills and licenses required to perform construction projects and design/build projects required under the resulting contract or have a viable plan to obtain any skills and/or licenses lacking.
1.2. Key Personnel and Key Subcontractors. Shall provide a representation of the employees that will be utilized to perform under this contract.
1. Project Manager: The Offeror shall fully describe the Project
Manager’s role in the organization and how the Project Manager will ensure successful completion of all construction task orders issued under the resulting contract. The Project Manager shall have a minimum of 5 years of experience as a Project Manager on similar size and type construction contracts which included the major trades that are part of this contract. The individual must be familiar with the requirements of the EM 385-1-1 and have experience in the areas of hazard identification and safety compliance.
2. Superintendent: The superintendent is responsible for the day to day safety and Quality Control (QC) at the project site. The superintendent and alternate shall meet the requirements of Section 01 45 00 paragraph 1.5 Subparagraph 2.
3. Quality Control Manager (QC): The QC Manger is responsible for the overall quality control program for the company. The QC Manger is responsible for managing and coordinating the three phases of control and documentation performed by others. The QC Manager shall meet the qualification and training requirements of Section 01 45 00 paragraph 1.5.
1.3. Payment and Performance Bonds. The Offeror shall provide proof of bonding capacity for the potential estimated annual amount of $15 million aggregate and a capacity to bond $5 million per task order, with verification from the Securities or Bonding Company.
1.4. Sample Task Order. (STO) The offeror shall submit their approach for accomplishing the STO from commencement to completion. The approach shall describe the Offeror’s understanding of the work required utilized the SOW, specifications, and drawings.
b. TAB D2 – Sub-Factor 2: Project Execution
1.1. Critical Path Method (CPM). Provide a Critical Path Method Schedule that would be used to manage the sample project. The CPM is a system of construction management that involves the complete planning and scheduling of a project and the development of a diagram showing each activity, its appropriate place in the time table, and its importance relative to other tasks and the complete project. The offeror shall submit a CPM schedule that shows that the offeror fully understands the scope of work for the task order, the specifications, and any additional relevant task order documentation (e.g., drawings) to complete the task order successfully.
1.2. Quality Control Plan (QCP). Provide a quality control plan that sets out logical and effective processes and methods to ensure that the work to be accomplished shall be with only high quality materials, thereby assuring high quality workmanship. Further, the offeror’s quality control plan must clearly define the methodology and/or tools it will employ to identify and correct substandard work either by its own personnel or subcontractors. Such methodology and tools must be fully described in the quality control plan and demonstrate that they are logical, feasible, and reflect a sound management approach. Finally, the quality control plan must fully describe the procedures and processes the offeror will use to track work progress, to include interface with the Government from commencement to completion of the work for concurrent multiple task order(s) under the basic contract and the sample task order.
iii. Volume III - Past Performance: The Past Performance evaluation will be accomplished by reviewing aspects of an Offeror's recent and relevant Past Performance, focusing on and targeting performance which is relevant to the effort as it directly relates to the work being procured under this solicitation and as defined in Section M. Past Performance information described herein is required on the offeror and all subcontractors, teaming partners, and/or joint venture partners proposed to perform 25% of the proposed effort based on the total proposed price. The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.
a. Early Proposal Information. The offeror is requested to submit the Past Performance
Volume by 01 May 2019, to the Contracting Officer at the address specified in L.1(1).
b. The offeror shall include documentation regarding their relevant past performance as it directly relates to the work being procured under this solicitation. The offeror SHALL NOT go back any farther than six (6) years for the submitted data. The past performance data shall document a successful history of past contract performance.
c. In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance Volume and information obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems, Defense Contract Management Agency (DCMA) and commercial sources. Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offerors.
Proposals that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).
Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
d. Submission Requirements. The offeror shall submit a Past Performance Volume containing the following:
Table of Contents Summary Page describing the role of the offeror and each subcontractor, teaming partner, and /or joint venture partner that the offeror is required to provide Past Performance Specific Relevant Contract Reference Sheets for the past performance experience in accordance with Attachment 1.
Consent Letters executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing the release of past performance information so the offeror can respond to such information. A sample consent letter is attached as Attachment 2).
Client Authorization Letters for each identified effort for a commercial customer authorizing release to the Government of requested information on the offeror’s performance.
Organization Structure Change History— Organizational Structure Change History. Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant present or past efforts or between conclusion of recent past efforts and this source selection.
As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing all such changes in the organization of your company. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government intends to consider present and past performance information provided by other sources as well as that provided by the offeror(s), your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.
Specific Relevant Contracts Format - Specific Relevant Contracts Format - Sheets in accordance with Attachment 2 and are limited to 3 pages per reference. The offeror shall provide documentation outlining the offeror’s past performance with contracts, as a prime or major subcontractor, which is the same or similar in nature, size, and complexity to the services being procured under this Solicitation. The submittal shall include rationale supporting your assertion of relevance and how it was determined that the work performed previously was the same or similar in nature, size, and complexity to the work specified by this solicitation. Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort, and to what aspects of the proposed effort they relate.
e. Past Performance Questionnaire - See Attachment 3, Past Performance
Questionnaire. For the contracts identified on each Specific Relevant Contract Reference, the offeror shall forward a copy of the Past Performance Questionnaire to the points of contact responsible for monitoring performance under such contracts. The points of contact shall return the questionnaires directly to Contracting Officer at the address specified in L.1 by 3 May 2019.
Any questionnaires not returned directly to the KO will not be reviewed and evaluated. The information contained in the questionnaires will be used to evaluate the offeror’s past performance. New entities that have no past customers shall annotate on the Summary Page that they have had no previous clients and that the minimum number of questionnaires cannot be provided.
iv. VOLUME IV – Price Proposal: Volume IV shall consist of the Price Proposal and must be clearly marked “VOLUME IV –PRICE PROPOSAL, W911S7-19-R-0008.”
Electronic versions of the Price Proposal should be submitted on a CD in MS Office Excel format, and shall not be read only or password protected. All formulas, lookup tables, and links should be intact, and no links shall exist to files not included with the submission. Spreadsheets shall not contain hidden worksheets. PDF or flat files will not be considered adequate. The hard copy version will take precedence for any differences noted between the hard and electronic versions of the contractor’s proposal. Failure to follow the below Contract Proposal preparation instructions may cause your proposal to be deemed unacceptable by the Government.
Tab A – Price Proposal. The contractor shall submit the following documents as part of the Price Proposal:
a. Section B (Supplies or Services and Prices/Costs) – Price-Section B shall be submitted fully completed and error free. The price proposal is based on the sample task order for “Bldg 844 Renovation, Fort Leonard Wood, MO” using firm-fixed pricing. (Attachment 11). Pricing for the sample task order will be used for evaluation purposes.
b. Offerors shall prepare pricing information for the Sample Task Order, provided at
Attachment 11 - Contractor’s Price Schedule Worksheet, using firm-fixed pricing.
Offerors shall complete the subsequent worksheets, listing the work elements, number of units for each work element, pricing for material, equipment, labor, labor burden, general and administration costs, profit, bonds, and all other charges that the offeror intends to recover and perform. No other format will be accepted.
c. The Government reserves the right to request Certified Cost or Pricing Data and
Other Than Certified Cost or Pricing Data if the Government deems it necessary in order to determine price reasonableness. The offeror may provide background information, other than the pricing data that is required, concerning its pricing methodology. This information might include details of the methodology applicable to your offer. The data, if submitted, would be used by the government to better understand their pricing.
ATTACHMENT 1
SUBCONTRACTOR/TEAMING PARTNER CONSENT FORM FOR THE RELEASE OF PAST
PERFORMANCE INFORMATION TO THE PRIME CONTRACTOR
Past performance information concerning subcontractors and teaming partners cannot be disclosed to a private party without the subcontractor's or teaming partner's consent. Because a prime contractor is a private party, the Government will need that consent before disclosing subcontractor/teaming partner past and present performance information to the prime during exchanges. In an effort to assist the Government's Past Performance Evaluators in assessing your past performance relevancy and confidence, we request that the following consent form be completed by the major subcontractors/teaming partners identified in your proposal. The completed consent forms should be submitted as part of your Past Performance Volume III Proposal.
