About this file
This document is an evaluation and award criteria section from a federal contract solicitation for an Indefinite Delivery/Indefinite Quantity (IDIQ) contract.
The Government will make basic IDIQ contract awards to all small business concerns whose proposals receive an "Acceptable" rating on Technical Proposal Conformance (Factor 1) and all four sub-factors. This is a price-excluded procurement under FAR 15.304(c)(1)(ii)(A), meaning no price evaluation or price-technical tradeoff will occur for initial IDIQ parent contract awards. The award pool is open-ended, creating evaluative parity—every small business achieving an "Acceptable" rating on all sub-factors will receive a contract award. Proposals will be evaluated using objective, binary pass/fail ratings only; the Government will not assess qualitative merits, feasibility, or quality of the proposed technical approach. The Government intends to make awards without discussions, clarifications, or exchanges, and offerors must submit complete, conforming proposals without assuming an opportunity for revision.
The four evaluation sub-factors address conformance to specific plan requirements: Sub-Factor 1A requires a MATOC Program Management Plan containing an organizational chart with Key Personnel, a signed Project Manager commitment letter, and a designated point of contact for the Contracting Officer; Sub-Factor 1B requires a Quality Control System Plan with written descriptions of three-phase controls and a signed Quality Control Manager commitment letter; Sub-Factor 1C requires a Site Safety and Health Plan including a Personal Protective Equipment Program, Confined Space Entry Procedures, and a signed Site Safety and Health Officer commitment letter; and Sub-Factor 1D requires an Environmental Protection Plan with written procedures for hazardous and solid waste disposal and a plan for compiling and submitting Solid Waste Diversion reports. An "Unacceptable" rating represents objective documentary non-conformance and does not constitute a responsibility determination, so no Small Business Administration Certificate of Competency referral is required.

M.1 BASIS FOR CONTRACT AWARD
M.1.1 Open-Ended Award Pool: Award will be made utilizing streamlined, objective Pass/Fail (Acceptable/Unacceptable) proposal conformance evaluation procedures.
Competing proposals will be evaluated IAW the DoD Source Selection Procedures (August 20, 2022). The Government will make basic IDIQ contract awards to all small business concerns whose proposals are determined to be technically conforming (conformance rated ‘Acceptable’). Because this is a price-excluded procurement under FAR 15.304(c)(1)(ii)(A), no price-technical tradeoff will be conducted, and price will not be evaluated for the initial IDIQ parent contract awards.
M.1.2 Evaluative Parity and Open Pool: To ensure a legally defensible and non-arbitrary source selection process, the award pool is open-ended. Every small business concern that successfully achieves a rating of ‘Acceptable’ for Factor 1 and all Sub- Factors (1A – 1D) will receive a contract award.
▪ Evaluation Factors and Sub-Factors: Competing proposals will be evaluated under one (1) evaluation factors (the Seed Project and Past Performance has been deleted as a basis of evaluation):
▪ Volume I; Factor 1: Technical Proposal Conformance ▫ Sub-Factor 1A: MATOC Program Management Plan Conformance ▫ Sub-Factor 1B: Quality Control System Plan Conformance ▫ Sub-Factor 1C: Site Safety and Health Plan (SSHP) Conformance ▫ Sub-Factor 1D: Environmental Protection Plan (EPP) Conformance
M.2 EXCHANGES WITH OFFERORS AFTER PROPOSAL SUBMISSION
M.2.1 Award without Discussions: Offerors are advised that the Government intends to make award of basic IDIQ contracts without clarifications, exchanges, or discussions.
Offerors are to submit their best offer, with complete and conforming proposals. Offerors must NOT assume an opportunity to clarify or revise proposals will occur. The Government reserves the right to award with, or without, Discussions.
M.3 PROPOSAL EVALUATION (RATINGS)
The Government will evaluate the Technical Proposal Conformance Factor and all Sub- Factors using the following objective, binary Acceptable/Unacceptable rating method:
Adjectival Rating Description
Acceptable
Proposal meets the requirements of the solicitation.
Unacceptable
Proposal does not meet the requirements of the solicitation.
M.4 VOLUME I; FACTOR 1: TECHNICAL PROPOSAL CONFORMANCE
The evaluation under Factor 1 is strictly limited to verifying the presence and completeness of required technical plans. The Government will not evaluate the qualitative merits, feasibility or quality of the proposed technical approach. Any ‘Unacceptable’ rating under these sub-factors represents a rejection based on the objective, documentary non-conformance of the proposal itself, and does not constitute a responsibility determination. Therefore, no SBA Certificate of Competency (CoC) referral is required.
