Miscellaneous text in this section has been added to:
SECTION 00 22 16 QUOTE EVALUATION AND BASIS FOR AWARD
1. GENERAL INFORMATION
1.1. This solicitation is for a Firm Fixed Price Contract. The Government intends to award a single purchase order contract to the lowest priced qualified Small Business quote, determined to be technically acceptable, deemed responsible in accordance with the RFO FAR, and whose quote conforms to all the RFQ's requirements and whose price is determined to be fair and reasonable.
The award will be made based on the lowest priced technically acceptable quote considering price, technical acceptability, and past performance.
1.2. The selection process will be conducted in accordance with RFO FAR Parts 12 and 36. Offers will be evaluated using the criteria listed in "Evaluation Factors for Award." Noncompliance with the RFQ requirements may raise serious questions regarding an offeror's technical ability, past performance and/or pricing and may be grounds to eliminate the proposal from consideration for contract award. Failure to include all information requested may adversely affect the evaluation. A quote that merely reiterates or promises to accomplish the requirements of the RFQ will be considered unacceptable. A quote submission package that is orderly and sufficiently documented will be easy for the Government to understand and will enable the Government to perform a thorough and fair evaluation.
1.3. The Contracting Officer will begin the evaluation process by conducting a quote compliance review for all timely-received quotes for determination of basic quote submission package. Failure to provide a complete quote submission package may result in the quote being removed from further consideration for award. Failure to address any factor Technical, Past Performance and Price or any technical subfactor shall be grounds for elimination from evaluation and consideration for award.
1.4. Technical acceptability will be evaluated on an acceptable/unacceptable basis. Following the quote submission package compliance review, all compliant quotes will be ordered by price from lowest priced quote to highest. At which point the lowest priced quote will be evaluated for technical acceptability (see para. 2.1 for more information). If the lowest priced quote is determined technically acceptable, technical evaluations will end and the contracting officer will proceed to evaluate past performance information. If the lowest priced quote is determined to be unacceptable, the next lowest priced quote will be evaluated for technical acceptability. This will continue until an offer is determined to be technically acceptable
1.5. Past Performance will be evaluated on an acceptable/unacceptable basis. Following the technical evaluation, the lowest priced technically acceptable quote will then be evaluated on past performance. The contracting officer will conduct a cursory past performance check, using any of the past performance techniques listed in RFO FAR Part 9 and/or government databases (e.g.
CPARS, FAPIIS, SPRS). If the lowest priced technically acceptable quote is determined to have acceptable past performance, evaluations will end, and the contracting officer will proceed to determine price reasonableness. If past performance is determined to be unacceptable, that quote will be determined to be unacceptable and the government will the evaluate the next lowest priced quote for technical acceptability (see para. 1.4.). This process will continue until a quote is determined to have acceptable past performance.
1.6. Following the past performance evaluation, the contracting office will then conduct price analysis in accordance with RFO FAR 12.203. After the lowest priced, technically acceptable quote with acceptable past performance information has been determined to be fair and reasonable, an award will be made to that quote and all evaluations will end.
1.7. The Government intends to evaluate quotes and award a purchase order without interactions with offerors. However, the Government reserves the right to conduct interactions with one or some of the offerors if the Contracting Officer, in his/her sole discretion, later determines them to be necessary or appropriate.
1.8. ENFORCEABILITY OF Quote: The quote must set forth full, accurate and complete information as required by this solicitation. By submission of the quote, the Offeror agrees that all items indicated in quote (if applicable e.g., key personnel, subcontractors, etc.) will be utilized for the duration of the contract and any substitutions shall require prior Contracting Officer's approval.
2. EVALUATION FACTORS FOR AWARD
2.1. The evaluation factors are (in no particular order) (1) Technical, (2) Past/Present Performance and (3) Price. The contracting officer will award this solicitation to the lowest priced, technically acceptable quote with acceptable past performance information.
2.2. Factor 1: Technical acceptability. The technical evaluation will be evaluated on an acceptable /unacceptable basis. In order to achieve a technically acceptable rating, the quote must adhere to the solicitation requirements for submission the drawings submitted should show compliance with the statement of work, specifications, and applicable rules and regulations. Technical drawings will also be used to gauge offeror's competency. As such, drawings should be clear, concise, displayed in a professional manor. Technical drawings are limited to ten pages. If the technical package includes more than ten pages, those excess pages will be extracted and will not be reviewed.
2.2.1. Prior to sending the technical drawings to the technical expert for review, contracting officer will redact all company specific information from the drawings to ensure a fair and impartial review.
Accordingly, it is requested that offerors limit company identifying information (e.g. watermarks, logos, headers) on their technical drawings.
2.3. Factor 2. Past Performance: Offerors' past performance will be reviewed using Supplier Performance Risk System (SPRS) along with other available systems (e.g. CPARS, FAPIIS) to determine acceptability of past performance. The contractor is also required to submit at a minimum one (1) past performance submission of like or similar completed within the last 24 months. Past performance will be reviewed on an acceptable/not acceptable/neutral basis. After the lowest priced quote is determined technically acceptable it will be reviewed by the contracting officer using any of the techniques listed in RFO FAR 12.203(a)(2) and RFO FAR Part 9.
2.3.1. To achieve an acceptable past performance rating, past performance information should show a record of satisfactory - or ideally better - performance records, no indicators of significant risk to the government, a general record of integrity, and no adverse information pointing the contrary.
2.3.2. Reasons for an un-acceptable past performance rating could include (but are not limited to):
records that show a lack of satisfactory business ethics/integrity, records of fraud, significant concentration of unsatisfactory performance reports, or records of termination for default/cause.
2.3.3. If there are no records or no past performance information available for the offeror, the contracting officer may request past performance information from the offeror. If past performance information cannot be obtained the contractor will receive a neutral rating. In the event of a neutral past performance rating the contracting officer may review the next lowest priced technically acceptable offer. At that point, the Government will comparatively evaluate Past Performance and Price pursuant to RFO FAR 12.203(c)(2) to determine which quotation represents the best value to the Government. In making that determination, the Government may select other than the lowest-priced quotation where the Government determines that a higher-priced quotation provides additional performance confidence or reduced performance risk that justifies the associated price premium.
2.3.4. Factor 3. Price. The resulting award will be a firm fixed price contract type. Price Reasonableness will be utilized in the evaluation of the Firm-Fixed price effort. Contracting officer will review price quote to ensure price reasonableness. The government may request additional pricing data in order to make this determination.
3. AWARD and DEBRIEFINGS
3.1. Award: A written award or acceptance of quote furnished to the successful offeror within the time for acceptance specified in the quote. A binding contract is formed when the offeror accepts the Government's purchase order, either by written acceptance of the purchase order or substantial performance of the purchase order. The contracting officer may request that the contractor provide written acceptance of the order.
