About this file
This is a 2025 Liquidated Damages Determination document for a federal construction project (SXHT-16-1028) titled "Repair, Renovate PMEL, BLDG 981" under contract FA2521-XX-XX-XXXX. The document establishes daily liquidated damages rates to compensate for contractor delays, calculated based on government oversight and inspection costs. The first day of delay incurs total liquidated damages of $471.76, which includes legal review ($88.57), civil engineering inspection and management ($175.19), and contracting oversight ($208.00). Subsequent days incur $383.19 in daily damages, excluding the legal component. The hourly rates are derived from the 2025 Office of Personnel Management salary tables plus 30% labor burden for personnel at the GS 11/5 through GS 14/5 levels, with vehicle mileage calculated at the 2025 Joint Travel Regulations rate of $0.70 per mile as published by GSA on January 1, 2025.
The damage calculation includes three primary cost categories: legal services (Staff Judge Advocate at GS 14/5), civil engineering (Inspector at GS 11/5 and Engineering/Management at GS 12/5 with vehicle costs), and contracting (Contracting Officer at GS 13/5 and Administrator at GS 12/5 with vehicle costs). The document provides for additional damages related to loss of income, loss of use, or other costs on an individual basis as approved by the Contracting Officer. Currently, no additional damages are assessed, resulting in a total additional damage cost of $0.00.
