About this file
This is a Justification and Approval (J&A) document for a sole-source procurement by the Department of Veterans Affairs, VISN 04, at the Pittsburgh VA Medical Center (Acquisition Plan Action ID: 36C244-26-AP-3238).
The VA seeks to procure fire alarm detection systems, plumbing, and HVAC control connected systems as part of a renovation of Sterile Processing and Logistics space (Project 646-21-101 UD SPS AHU & RO Upgrade). The contracting officer justifies restricting competition to Johnson Controls International (JCI) under the statutory authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1(c), citing that only one responsible source exists to satisfy agency requirements. JCI holds the proprietary data and licensing necessary to operate life-critical fire detection and alarm systems and the facility's Direct Digital Control (DDC) systems that govern all HVAC equipment, temperature controls, and facility monitoring. The acquisition is authorized as a sole-source action because replacing the JCI system with an alternative manufacturer would require converting all sensors and controls throughout the entire facility, canceling existing JCI maintenance contracts, and retraining VA staff—resulting in significant costs, delays, and potential disruption to patient care. While this procurement will be sole-sourced to JCI, the larger construction project will be competed under full and open competition, which the contracting officer indicates will result in fair and reasonable pricing. No market research was conducted beyond the technical analysis supporting the sole-source determination. The Requirements Certification was signed by Bunny Adair, Healthcare Engineer, on 6/25/26, and the Contracting Officer Certification was executed by Elijah McIntosh on 6/25/26.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (<SAT)
Acquisition Plan Action ID: 36C244-26-AP-3238
1. Contracting Activity:
a. Department of Veterans Affairs, VISN 04, VAPHS, University Drive Campus, Pittsburgh, PA 15215
2. Nature and/or Description of the Action Being Processed:
This facility has a requirement to renovate Sterile Processing and Logistics space. As part of the renovation, the replacement and installation of fire alarm detection systems, plumbing and HVAC control connected systems that are required. The solicitation for this procurement shall be advertised for a minimum of 30 calendar days in order to obtain competition from qualified concerns. This Sole Source Product and Services for the Johnson Control International (JCI) fire, plumbing and HVAC DDC control system this action will be awarded as part of the new contract requirement as described above 646-21-101 UD SPS AHU & RO Upgrade.
3. Description of Supplies/Services Required to Meet the Needs:
Johnson Controls is the contract holder for the testing and maintenance of the Fire Detection and Alarm System. JCI holds the proprietary data necessary to run any testing required to life critical fire systems, and the DDC control systems. The equipment work does not necessarily require JCI testing, except on equipment that interacts or is connected with the JCI installed system.
Any vendor conducting the installation would need to coordinate with JCI to ensure compatibility with existing fire alarm devices & monitoring system and the DDC Control System not being upgraded with this SOW. The only alternative to eliminating this interaction would be to replace the entire system with one from another manufacturer. Replacing the system would require converting all sensors and controls in the entire facility, as well as cancelling and resoliciting existing maintenance contracts with JCI. This would be a significant undertaking, costing the Government both time and money in addition to potential impacts to patient care while VA staff is trained on a different system. It would be in the best interest of the Government to sole source this portion of the work to JCI under the above-mentioned project.
4. Statutory Authority Permitting Restricted Competition:
( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements ( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5. Demonstration that the Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The acquisition is authorized pursuant to 10 U.S.C. 2304 (c)(1), and is implemented by FAR 6.302-1 (c), Only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable due to JCI Metasys being the only manufacturer able to provide all necessary functions without converting the entirety of controls in the Pittsburgh VA Medical Center. JCI holds the proprietary data necessary to run any testing required to life critical fire systems, equipment work does not necessarily require JCI testing, except on equipment that interacts or is connected with the JCI installed system. JCI Metasys system has all proprietary licensing and ownership of technologies that support this system to include all hardware and software Proprietary design and engineering not available from any alternative source or vendor.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
JCI Metasys direct digital control system and Fire Detection and Alarm System provides all functions to the entire facilities heating, air conditioning, ventilation and refrigeration systems and fire alarm integrated system. The DDC system provides operation controls for all primary and secondary HVAC mechanical equipment to include Air Handlers, Pumps, Heat Exchangers, Chillers and Refrigeration.
The system provides Control and Command hardware and software temperature control and monitoring of all facility rooms, patient care treatment and patient care housing.
Replacing the system with another source would require converting all sensors and controls in the entire facility, as well as cancelling and resoliciting existing maintenance contracts with JCI. This would be a significant undertaking, costing the Government both time and money in addition to potential impacts to patient care while VA staff is trained on a different system. It would be in the best interest of the Government to sole source this portion of the work to JCI under the above-mentioned project.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: This item is being sole sourced under a larger construction project that will be competed under Full and Open competition. Therefore, competition is expected to result in Fair and Reasonable pricing when comparing proposed prices in response to the solicitation.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Further market research was not conducted based on the same content provided in paragraph 6 above.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A
