J J-1 Attachment J.1 is replaced with Section C – Performance Work

Statement (PWS) Conformed thru Amendment 0003 dated 9/30/10.

L Pg 65, L-16, Vol IV, Cost Proposal

The Government has provided estimated hours and estimated cost data in this RFP. The estimates are not to be considered a guaranteed workload.

Therefore, in accordance with the tasking incorporated by Section C and also the historical and projected workload data, oOfferors shall utilize these estimated amounts to provide a proposed estimated cost plus fixed fee for CLINs X001 and estimated cost for CLINs X002 required to carry out these requirements and incorporate their cost/pricing in Section B of this solicitation.

L Pg 66, L-16, Vol IV, Cost Proposal

DoL Wage Determination Rates: The place of performance is across the Continental United States (CONUS), Outside Continental United States (OCONUS) and Hawaii. Therefore, various Wage Determinations will be applicable during the course of contract performance. FOR PURPOSES OF PRICING THIS PROPOSAL, the Government has provided the DoL Wage Determination No. 2005-2456, Revision 7, dated 07 January 2010 (in Attachment J.2). These rates and benefits shall utilized in the offeror’s proposal. C. The Contractor shall provide the names and telephone numbers (to include mobile telephone and pager, as applicable) of the Project ManagerKey Personnel in writing at the start of contract performance. In the event of the replacement of the Project ManagerKey Personnel, the Contractor shall notify the KO or designee, in writing, of such replacement and provide the name(s) and telephone number(s) at least 15 calendar days prior to a planned replacement and within 24 hours following an unplanned replacement.

2. The following questions were received by the Government in response to Solicitation SP3300-10-R-0009. Each question has been redacted to ensure anonymity. The Government response is provided under each question to allow all potential offerors the opportunity to see all communications with industry. Amendment 0001 contained Questions 1-23. Amendment 0002 contained Questions 24-26.

Question 27: Can the Government provide a geographic estimate of what DLA depots or regions will be part of the planned Task Orders? (Attachment J.1, pg C-6, paragraph 1.2.1)

Answer 27: The East Coast region currently consists of California, Washington, Utah, Texas, and Oklahoma. The West Coast region currently consists of Connecticut, Indiana, Pennsylvania, Virginia, North Carolina, Florida, Georgia, and Maryland; but work can be required anywhere outside of the states listed above. The Government cannot project where the work may occur.

Question 28: What percent of the provided annual Labor Hour estimate will be CONUS vs. OCONUS? (Attachment J.1, pg C-4, paragraph D)

Answer 28: The Government cannot project the percentage of annual labor hours that will be CONUS vs.

OCONUS.

Question 29: Can the Government provide an annual forecast by month of the provided labor hour requirement?

(Section B, pg 2)

Answer 29: A labor forecast by month is not available. Estimated labor hours by labor category for each performance period are provided in Section L. These hours shall be utilized for the purposes of pricing CLINs X001.

Question 30: Based on the broad CONUS and OCONUS location requirement, what SCA Wage Determination should be used for CLIN Pricing? (Attachment J.2)

Answer 30: Reference page 66 of the solicitation (conformed thru Amendment 0003) “FOR PURPOSES OF PRICING THIS PROPOSAL, the Government has provided the DoL Wage Determination in Attachment J.2. These rates and benefits shall utilized in the offeror’s proposal. In performance of the contract, the Government will negotiate each Task Order utilizing the DoL Wage Determination that is applicable to the specific location the work will be performed.”

Question 31: Will the Government or Contractor be responsible for the cost of the personnel clearances, CAC background checks, and IT eligibility? (Attachment J.1, pg C-5, paragraph C)

Answer 31: The Contractor is responsible for the cost of performing background checks to ensure an employee is capable of obtaining a personnel clearance, CAC and IT eligibility and for the preparation of documents required to obtain the personnel clearance.

Question 32: Can the Government provide an estimated percentage of labor that will require a secret clearance or above? (Attachment J.1, pg C-5, paragraph C)

Answer 32: At this time the Government cannot estimate the percentage of labor that will require a secret clearance.

Question 33: How often are multiple task orders at multiple locations required? (Attachment J.1, pg C-4, paragraph D)

Answer 33: The Offeror should anticipate that multiple task orders at multiple locations will be required for the duration of the contract.

Question 34: What is the current contract amount total or for each year?

Answer 34: There is no current contract. This is a new requirement.

Question 35: What is the name of the current contractor for this contract?

Answer 35: There is no current contract. This is a new requirement.

Question 36: Have there been any changes to the current contract since the first one that was issued, that may have impact on the Contract price?

Answer 36: There is no current contract. This is a new requirement.

Question 37: Is there currently a charge for employee parking? If so, what is the cost? (Attachment J.1, pg C-18, paragraph 1.5.6)

Answer 37: There is no current contract. This is a new requirement.

Question 38: Is there currently a charge for employee parking? If so, what is the cost? (Attachment J.1, pg C-18, paragraph 1.5.6)

Answer 38: There is no current contract. This is a new requirement.

Question 39: Can “legible” tables, charts, graphs and figures be less than 10 pt font? (pg 59, paragraph L-16, 6.b)

Answer 39: No – 10 pt font is the smallest font allowed.

Question 40: Please provide the missing Section H clause for ordering (as referenced from Section C). (Attachment J.1, pg C-4, paragraph C)

Answer 40: The paragraph has been revised via Amendment 0003 to reference Section I clause FAR 52.216-18.

Question 41: Amendment 0001 replaced the original Attachment J.2 with Department of Labor Wage Determination (WD) No 2005-2455, Revision 11 dated 8/10/2010. However the revised WD is not reflected in Section L.16. Please correct. (Pg 66)

Answer 41: The paragraph has been revised via Amendment 0003 to reference Attachment J.2 rather than the specific Wage Determination.

Question 42: Amendment 0001 replaced the original Attachment J.2 with Department of Labor Wage Determination (WD) No 2005-2455, Revision 11 dated 8/10/2010. However, the labor categories for three of the positions appear to be modifications or abbreviations of the formal SCA labor categories. Is the Government planning to conform the modified labor category names, or will the Government correct the labor category names to match the formal SCA-defined labor category titles? Please correct and re-issue, as appropriate.

Answer 42: The labor category names have been updated to reflect the formal SCA labor category names exactly as they appear in the Wage Determination.

Question 43: The Government’s answer to Question 24 has prompted follow-on clarification. We are a small business, meeting the requirements of the solicitation regarding small business size standard. We have a teaming arrangement with a large business to perform services and the division of work is compliant with FAR 52.219-14.

We interpret the Government’s answer in part “a” to refer to formal or informal agreements to “act collectively” as in a joint venture or partnership. Our interpretation of part “b” of the Government’s answer is that the “not formal” type of agreement refers to the standard prime/subcontractor relationship wherein the prime is awarded the contract and is responsible for overall performance and the subcontractor, as a separate legal entity, performs mutually agreed services. Please confirm that our interpretation is correct. (Amendment 0002, Answer #24)

Answer 43: Confirmed.

Question 44: Please provide a list of the locations (city, state, country) that services may be required under this contract. Offerors need this information to assure that pricing complies with applicable DoL, state and federal regulations and requirements.

Answer 44: As provided in Attachment J.1 (PWS) under paragraph 1.2.1 “The location of services to be performed under this contract shall be anywhere in the area currently covered by the DLA and DLA Distribution or locations not yet established as a DLA and DLA Distribution operated site. The place of performance will include multiple sites across the CONUS and Hawaii and OCONUS.”

Because the exact locations are not presently known, the Government has instructed all offerors to utilize the DoL Wage Determination in Attachment J.2. These rates and benefits shall be utilized in the offeror’s proposal. In performance of the contract, the Government will negotiate each Task Order utilizing the DoL Wage Determination that is applicable to the specific location the work will be performed.

Question 45: Are any of the DLA locations subject to a collective bargaining agreement (CBA)? If so, please provide a list of such locations. This information is needed to assure that pricing complies with FAR requirements related to CBAs.

Answer 45: In performance of the contract, the Government will negotiate each Task Order utilizing the DoL Wage Determination and/or Collective Bargaining Agreement that is applicable to the specific location the work will be performed. For purposes of pricing the proposal, utilize the DoL Wage Determination in Attachment J.2.

Question 46: In Section L of the solicitation, the government requires original and 2 copies, and 2 CDs, of the price proposal. This section also states that 1 copy of the price proposal and 1 CD be provided to the cognizant DCAA office. Is the DCAA copy and CD included in the 2 copies and 2 CDs, or is the DCAA copy and CD in addition to the 2 copies and 2 CDs? (Pg 59, L-16)

Answer 46: The DCAA copy is in addition to the 2 copies required to be delivered in New Cumberland, PA.

Question 47: The government’s guidance for pricing information for Other Direct Costs is confusing. The government in some part of the solicitation states that the offeror should price materials at the government estimate plus applicable G&A or Materials Handling costs. In other places, the government states that the offeror should price materials costs using the offeror’s estimates. Pertinent solicitation statements follow.

a. Page 64 of the conformed solicitation through Amendment 1 – “The Government has provided estimated hours and estimated cost data in this RFP. The estimates are not to be considered a guaranteed workload. Therefore, in accordance with the tasking incorporated by Section C and also the historical and projected workload data, offerors shall provide a proposed estimated cost plus fixed fee for CLINs X001 and estimated cost for CLINs X002 required to carry out these requirements and incorporate their cost/pricing in Section B of this solicitation.”

b. Page 65 of the conformed solicitation through Amendment 1 – “Other Direct Costs (Material Support Costs/Travel/Training/Conferences): For pricing purposes, these costs are estimated as indicated in Schedule B for CLIN X002. Offerors should also note that the amount estimated for CLIN X002 does not include any indirect rate application (i.e. overhead and/or G&A).”

Answer 47: The language has been revised to be consistent. Offerers shall utilize the Government Provided Estimated Cost dollar amount provided by the Government (in Section B and Section L) and apply their indirect rate as appropriate to establish the Ceiling Price.

Question 48: On page 65 of the conformed solicitation through Amendment 1, it states, “DoL Wage Determination Rates: The place of performance is across the Continental United States (CONUS), Outside Continental United States (OCONUS) and Hawaii. Therefore, various Wage Determinations will be applicable during the course of contract performance. FOR PURPOSES OF PRICING THIS PROPOSAL, the Government has provided DoL Wage Determination No. 2005-2456, Revision 7, dated 07 January 2010 (Attachment J.2). These rates and benefits shall utilized in the offeror’s proposal. In performance of the contract, the Government will negotiate each Task Order utilizing the DoL Wage Determination that is applicable to the specific location the work will be performed.”

Attachment J.2 is Wage Determination 2005-2455, Rev 11, dated 8 August 2010. Which WD should offerors use?

Answer 48: Offerors should use the current Wage Determination in Attachment J.2. As stated in Q/A #41, this paragraph has been revised via Amendment 0003 to reference Attachment J.2 rather than the specific Wage Determination.

Question 49: The PWS on pages 42 and 43 stipulates that the Government will reimburse the contractor for travel and per diem associated with travel in support of contractor-provided training. Should offerors price any travel costs in CLIN 0004 (Phase-in Training), or will the Government’s reimbursement be over-and-above the Firm Fixed Price for CLIN 0004?

Answer 49: All costs (including travel) associated with Phase-in Training shall be priced under CLIN 0004, Phase-in Training. No payments beyond the firm-fixed-price will be made for costs associated with Phase-In.

The travel referenced in your question (for contractor-provided training) would be reimbursed under CLINs X002.

Question 50: The PWS on pages 42 and 43 stipulates that the Government will reimburse the contractor for labor hours for off-site training, and for the training team employees required to attend training at New Cumberland, PA when DLA Distribution changes DSS software systems or implements systems changes. Should offerors price any labor costs for such off-site/New Cumberland training in any CLIN? Or will the Government’s reimbursement be over-and-above the pricing included in any CLIN?

Answer 50: If the Government requires training team employees to attend training outside the Phase-In, that cost would be reimbursed under CLINs X002.

Question 51: The PWS, Section C-4: Contractor Furnished Equipment, Material, and Training Support Services, lists numerous items of contractor-furnished equipment and possible contractor-furnished warehouse space. Are the costs associated with these equipment and space requirements included in the Government’s estimated costs shown for CLIN X002? Or should offerors provide costs for these requirements? If the offerors should provide such costs, please identify in which CLIN these costs should be priced?

Answer 51: Yes – all support costs are included in the Government Provided Estimated Costs for CLINs X002.

Question 52: Para 1.1. Scope of Work: Do we need a teaming partner with experience in loading and shipping containers, ship load planning, stowing? (Attachment J.1, pg C-5)

Answer 52: Yes.

Question 53: Para 1.2.3.(B): On those days, is the contractor paid or are they required to use vacation time?

(Attachment J.1, pg C-6)

Answer 53: The Government will not pay the Contractor for those days.

Question 54: Para 1.2.3.(B): On those days (when the Federal Government is closed via Executive Order), is the contractor paid or are they required to use vacation time? (Attachment J.1, pg C-6)

Answer 54: If the KO or designee determines that services are not required for that day, the contractor will not be reimbursed for any work performed that day.

Question 55: Para 1.3 (A): Does “local” hire apply to OCONUS? What type of work do you anticipate in OCONUS locations? (Attachment J.1, pg C-6)

Answer 55: Yes. Work required will be within the scope of the contract.

Question 56: Para 1.4 (B): What are anticipated travel costs? Will this include travel for both CONUS and OCONUS? (Attachment J.1, pg C-7)

Answer 56: All support costs are included in the Government Provided Estimated Costs for CLINs X002. This includes both CONUS and OCONUS requirements.

Question 57: Para 1.4.1 (B): What type of HAZMAT do we anticipate transporting? (Attachment J.1, pg C-7)

Answer 57: Any hazardous material that is regulated for transportation.

Question 58: Para 1.5 (C): Additional cost for increased security to contractor? What is the scope of security anticipated under these conditions? Are there any specific requirements for armed/unarmed guards? (Attachment J.1, pg C-14)

Answer 58: As stated in the PWS, this requirement is in the event of a strike by Contractor personnel. The Contractor will pay for any costs incurred by the Government as a result of this strike. Requirements for armed/unarmed guards are not within the scope of this contract.

Question 59: Will government vehicles be provided?

Answer 59: Should the Government furnish vehicles for use by the Contractor, those requirements will be addressed in the Task Order.

Question 60: Para 4.7.1. Assuming that this two-deep policy applies by location, can you identify the specific locations that require HAZMAT certified personnel? (Attachment J.1, pg C-47)

Answer 60: IAW C-1.2.1, the location could be anywhere within the CONUS or OCONUS.

Question 61: Will ammunition personnel be required to operate Ammunition Supply Points at various locations and will they be full time. Will the personnel also be required to support field exercises and range support? (Attachment J.1)

Answer 61: Handling Ammunition or operating Ammunition Supply Points is not within the scope of this contract.

Field exercise and range support is not within the scope of this contract.

Question 62: Will weapons repair personnel be required at the various logistics sites and will they be full time? Will the personnel also be required to support field exercises and range support? (Attachment J.1)

Answer 62: Weapons repair is not within the scope of this contract. The Contractor may be required to perform distribution functions associated with small arms. Field exercise and range support is not within the scope of this contract.

Question 63: Will Explosive Ordnance support be required in support of range activities? (Attachment J.1)

Answer 63: Explosive Ordnance support is not within the scope of this contract.

Question 64: Should the “training team” be located at one centralized DLA work location? (Attachment J.1 Para 1.4, sub para B page C-7, Para 1.4.2, sub para A item 2, page C-8)

Answer 64: Location of the Training Team is at the discretion of the offeror.

Question 65: Para 4.3.A : Can the government provide a minimum-maximum estimate for contractor furnished temporary warehouse space? (Attachment J.1 pg C-46)

Answer 65: That information is unknown at this time.

Question 66: Para 4.3.B: Will the contractor furnished temporary warehouse space be located at the contractor’s discretion or will the government dictate the space location? (Attachment J.1 pg C-46)

Answer 66: That information would be determined when the Government has a known requirement.

Question 67: Para 3.0: Will the listed material in the Task order already be staged at the facility? If not, what is the projected weekly delivery quantity? (Attachment J.3 pg 3)

Answer 67: Yes, the material is already staged at the facility.

Question 68: Para 10.C & D: Is there a minimum requirement for the number of Warehouse Tractors and Trailers required for the sample Task Order? (Attachment J.3 pg 3)

Answer 68: No, the Offeror shall determine the number of Warehouse Tractors and Trailers required for the sample Task Order.

Question 69: Para 10.F: If the contractor is required to furnish a 2 ½ T Stake Truck we can assume there is a transportation requirement to move material off-site for storage after processing. What is the distance that would be driven to deliver material to the storage or delivery location? (Attachment J.3 pg 3)

Answer 69: A 2 ½ T Stake Truck may be required to move material from one point to another point within the distribution center or installation and not necessarily off-base.

Question 70: Upon contract award, is the government able to provide the contractor with a list of former employees (either contractor employees or government employees) who have performed work under the duty descriptions listed in attachment J.1 section C 1.4.2 Labor Categories, and who have been employed at the relevant DLA Distribution locations within the previous 5 years? Does the government agree that providing such a list would be in the best interest of the government, as it would identify potential contractor personnel already familiar with DLA site locations? (Attachment J.1, C.1.4.2)

Answer 70: The Government does not maintain records of contractor employees working on previous contracts. It is the Offeror’s responsibility to develop and implement a recruiting program as well as to explore the labor markets to identify potential employees with previous work experience related to the contract requirements.

Question 71: Is any of the work to be done under the projected task orders currently being performed under different contracts? If so, which contracts?

Answer 71: No.

Question 72: TECHNICAL EXHIBIT 3.1 GOVERNMENT-FURNISHED DATA SYSTEMS; Shows a number of systems needed to be supported by the team. Are the government furnished systems operated through a mainframe or through distributed systems or both and is there a requirement for personnel to know JCL or other computer languages in order to troubleshoot as per troubleshooting guidelines in technical exhibit 3.3?

Answer 72: The Contractor is required to perform basic troubleshooting tasks that do not require access to any mainframes and the Contractor’s personnel are not required to know JCL. Any tasks outside of troubleshooting identified in TE 3.3 are referred to the site information systems helpdesk personnel.

Question 73: During the Pre-Solicitation meeting we were told to price the labor for this contract using the SCA with the place of performance as unknown (May 1989). Is this a pricing requirement for all competitors to use? If not, how does the government plan on comparing this cost?

Answer 73: Because the exact locations are not presently known, the Government has instructed all offerors to utilize the DoL Wage Determination in Attachment J.2. These rates and benefits shall be utilized in the offeror’s proposal.

Question 74: It was stated in the Pre-Solicitation meeting that if the position description does not match and SCA position then that position would be considered exempt. Without knowing all of the position requirements, how does the government suggest we price these exempt positions?

Answer 74: The Prime Labor Tables for CLINs X001 (located in Section L, pgs 68-72) identify each labor category by the DoL Wage Determination Code or state “Exempt”. It is at the discretion of the offeror to price the “Exempt” positions.

Question 75: It was discussed during the Pre-Solicitation meeting that the contractor may be responsible for providing the equipment and supplies. How can we prepare a cost for equipment and supplies that are unknown?

Answer 75: All support costs are included in the Government Provided Estimated Costs for CLINs X002. Offerers shall utilize the Government Provided Estimated Costs dollar amount provided by the Government (in Section B and Section L) and apply their indirect rate as appropriate to establish the Ceiling Price.

Question 76: How does the government suggest we prepare travel costs for the training team to unknown CONUS and OCONUS destinations?
