SECTION B - CONTINUATION FROM SF 1449
B.1. Brief Description of Services: The U.S. Department of Housing and Urban Development’s (HUD’s) Office of Single Family Asset Management (SFAM), requires Real Estate Owned (REO) case management support services via a web-based Software as a Service (SaaS) subscription service. SFAM directly requires a web-based SaaS subscription service to fulfil its mission-essential functions of performing property disposition tracking, reporting, and hosting of its public facing retail listing/bid site HUD Home Store for HUD REO single-family properties. The Contractor shall provide SFAM with the use of specific SaaS applications, application data management, data backup and sharing––including networks, servers, operating systems, storage, and user applications to process specific workflow automation to assist with the analysis, management, and operational procedures associated with the Single- Family disposition process. The Contractor’s web-based SaaS subscription service shall provide SFAM, HUD staff, and its business partners with the capability to send, receive, distribute, analyze, maintain, and manage information relative to HUD specific case management and workflow tracking processes. The Contractor shall ensure that there is no lapse in services during the transition period.
The Government is not seeking subscription services from an Offeror whose web-based SaaS applications, for REO case management support services, are still under development. The Offeror’s FedRAMP compliant commercial web-based SaaS subscription service shall have applications that are operational (i.e., not under development), functional (i.e., able to provide and support basic business processes listed in section 5 of the Performance Work Statement (PWS)), and generally available by the due date of the proposal. Only one (1) award is anticipated as a result of this solicitation.
B.2. Acquisition Approach: This requirement is being competed on a full and open competitive basis utilizing the policies and procedures of Federal Acquisition Regulation (FAR) Part 12 - Acquisition of Commercial Items in conjunction with FAR Part 15 - Contracting by Negotiation, as supplemented by HUD Acquisition Regulation (HUDAR) Part 2415. The Government will utilize a “Best Value Tradeoff” source selection process to award a single contract resulting from this solicitation to the responsible Offeror, whose offer, conforming to the solicitation, represents the overall best value (i.e., the most advantageous offer, price and non-price factors considered) to the Government.
B.3. Contract Type: A hybrid contract consisting of Firm Fixed Priced (FFP) and Indefinite Delivery Indefinite Quantity (IDIQ) Line Item Numbers (LINs) is anticipated. Only FFP task orders will be issued off the IDIQ LINs.
B.4. Period of Performance: The period of performance shall consist of a 1-year base period [(September 1, 2022 – August 31, 2023) includes a 3-month transition-in period (September 1, 2022 – November 30, 2022) and a 9-month full performance period (December 1, 2022 – August 31, 2023)] with four 1-year option periods.

(a) Section 508 Compliance Statement
All Electronic and Information Technology (EIT) procured through this Performance Work Statement / Bill of Materials and any resulting contract, contract, delivery order, or purchaser order must meet the applicable accessibility standards at 36 CFR §1194, U.S. Architectural and Transportation Barriers Compliance Board (Access Board) under the authority of Section 508 of the Rehabilitation Act Amendment of 1998.36 CFR 1194, unless an agency exception to this requirement exists. 36 CFR §1194, U.S. Architectural and Transportation Barriers Compliance Board (Access Board) is viewable at http://www.section508.gov. The Contractor shall indicate for each line item in the schedule whether each product or service is compliant or noncompliant with the accessibility standards at 36 CFR §1194. Further, the proposal must indicate where full details of compliance can be found (e.g., vendor’s website or other exact location).

(b) Audit Record Retention
The Contractor (and/or any subcontractor) shall maintain all information in accordance with National Archives and Records Administration (NARA) records retention policies and HUD-specific policies.
(c) Information Security Categorization
In accordance with Federal Information Processing Standards (FIPS)-199, Standards for Security categorization of Federal Information and Information Systems and following the guidance in National Institute of Standards and Technology (NIST) Special Publication (SP) 800-60 Rev.2, Guide for Mapping Types of Information and Information Systems to Security Categories and based on information provided by the Information System Security Officer (ISSO) or other security representative, the Security Level for each Security Category and the Overall Security Level, which is the highest level of the three factors (Confidentiality, Integrity, and Availability), the information or information system relative to this contract are categorized as follows:

(d) Baseline Security Requirements
The Quoter shall comply with ALL security requirements listed in PWS Section 1.3.
(e) Controlled Unclassified Information (CUI)
All information about the systems gathered or created under this contract shall be considered as Controlled Unclassified Information (CUI) and marked appropriately.
CUI, sensitive/proprietary data, and/or equipment will only be disclosed to authorized personnel on a Need-To-Know basis.
Contractors (and/or any subcontractors) processing CUI incidental to developing a product or service for HUD or storing government information on a system that has not been authorized by the agency must meet the requirements of NIST SP 800-171 Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations (http://csrc.nist.gov/publications/).
When no longer required, this information and/or data will be returned to HHS control, destroyed, or held until otherwise directed. Destruction of information and/or data shall be accomplished by following NIST SP 800-88, Guidelines for Media Sanitization (http://csrc.nist.gov/publications/).
(f) Data Rights
The government has unlimited rights to all documents/material produced under this contract to the extent permitted by the data rights clauses. The parties mutually acknowledge their understanding that this is the government’s intent. All data collected in the system is the property of the government. All documents and materials produced under this contract shall be government owned and are the property of the government with all rights and privileges of ownership/copyright belonging exclusively to the government. These documents and materials may not be used or sold by the Contractor without written permission from the contracting officer. All materials supplied to the government will be the sole property of the government and may not be used for any other purpose. The government will maintain the right to request full copies in a format that is readily accessible through predominant industry and/or open data formats to which federal agencies agree at any time. This right does not abrogate any other government rights.
(g) Ordering Procedures for IDIQ LINs
Orders issued under this contract will be placed electronically.
The Contracting Officer (CO) is authorized to issue orders against the IDIQ LINs. The Contract
Specialist (CS), Contracting Officer’s Representative (COR), and the Program Manager (PM) must receive approval from the CO to place orders against the IDIQ LINs.
The services under the IDIQ LINs to be ordered are pre-priced under the contract.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the
Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
