Section M – EVALUATION FACTORS FOR AWARD
1. Basis for Award
The Government intends to award multiple IDIQs to the responsible Offeror(s) whose proposal represents the best value to the Government.
Phase I, Written Questions
Phase II, Slide Presentation/Six Elements/Interactive Dialogue
Phase III, Pricing
Phase I Evaluation Criteria, when combined, are equally important as Phase II evaluation criteria. All non-price evaluation criteria, when combined, are significantly more important than Phase III – Price. As the nonprice merits of competing Offeror’s written answers and slide presentations approach equal, price will become more important in the award decision. However, award may not necessarily be made to the lowest priced proposal.
2. Evaluation Criteria
Both the voluntary advisory evaluation (Phase I) and the Phase II will be performed using confidence ratings (Table 1).

Low Confidence
The Government has low confidence that the Offeror understands the requirement, does not propose a sound approach, or will be successful in performing the contract even with Government intervention.
Offerors are strongly encouraged to submit their best technical solutions and price in response to this RFP.

2.1. Phase I and Phase II, Criteria 1
The Offeror’s technical approach will be evaluated based upon their understanding of the objectives of the SOW and planned execution of the project. This refers to the manner in which the Offeror proposes to plan, manage, control, and provide the services and deliverables. The extent to which the Offeror demonstrates a solid understanding of addressing anticipated problems, issues, constraints, organizations and system(s) involved and the approach and methodologies proposed to ensure successful accomplishment of all tasks in the SOW will be evaluated. The Government will evaluate the Offeror’s proposed technical approach based on their demonstrated understanding of the objectives of the SOW and planned execution of the project and will be assigned a confidence rating. The following elements will be evaluated:

2.2. Phase II, Criteria 2
The Government will assess its confidence that the Offeror will successfully perform the work, by evaluating the Offeror’s demonstrated performance from three contracts/orders performed within the past five (5) years (from the date of this RFP release). Prior performance will be evaluated to assess the expectation of successful outcomes based on the extent to which the Offeror has successfully performed on systems similar to the portal requirements described in the Statement of Work.
1. This portion will be evaluated by the Contracting Officer relative to contractor responsibility prior to award on a pass or fail basis. The past performance evaluation factor assesses the Offeror's ability to supply products and services that meet USMS' needs, based on a demonstrated record of performance.
Offerors shall submit up to (3) past performance summaries of Government projects worked on within the past five (5) years of similar size, scope, and complexity. Each narrative past performance summary shall contain the following information:
a. Contract/task order title
b. Contract/task order number
c. Type of contract (e.g., CPAF, FFP, T&M, etc.)
d. Planned period of performance
e. Actual period of performance
f. Original value
Past Performance will be evaluated on a pass/fail bases and verified utilizing assessments from the Contractor Performance Assessment Reporting System (CPARS)

The offeror has demonstrated a satisfactory or better rating in CPARS for each of the past performance projects that have been submitted.
FAIL
The offeror has one or more ratings in CPARS that is less than satisfactory for one or more of the past performance projects that have been submitted
UNKNOWN
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror will not be evaluated favorably or unfavorably. Therefore, the offeror shall be determined to have unknown past performance. In the context of Pass/Fail, “Unknown” shall be considered “Pass”
2.3. Phase III, Criteria 3, Price
The Government will perform a price analysis of the offeror’s business/price proposal in accordance with FAR Part 15. The Government will also evaluate proposals to determine price reasonableness pursuant to FAR Subpart 15.4, Contract Pricing.
For evaluation and award purposes only, the offeror shall apply the published Collective Bargaining Agreements (CBA) for hourly wage and benefit rates for the period October 1, 2022 through September 30, 2023, for the base year and at offeror discretion most advantageous to the Government, proposed escalation rate for all ordering periods. A price adjustment may be requested in accordance with FAR 52.222-43, Fair Labor Standards Act and Service Contract Act – Price Adjustment (Multiple Year and Option Contracts) as new CBA rates are published.
The Government also requires the offeror to provide fully burdened hourly rates for the Circuits proposed to include all sites designated under a given Circuit.
Offerors are also cautioned that partially submitted or omitted price offers will be evaluated as unacceptable and may be disqualified from further consideration for award. The Pricing Template and Pricing Schedule shall be completed in its entirety, see Section J Attachment 1(D) and Attachment 1(E).
For award purposes, the Government will independently evaluate each Circuit/District and the offeror’s overall price for the base period and the respective four ordering periods plus one six-month option period via FAR 52.217-8. This information must be presented on the Pricing Template provided in Section J – Attachment 1(E). The total evaluated price will consist of the following:
NOTE: For evaluation purposes, the base period will consist of 12 months. Likewise, each subsequent option period will consist of 12 months.
(1) Base Contract Period The unit prices proposed for the Fully Burdened Hourly Rate, listed in Section J, Attachment 1(D), shall be multiplied by the corresponding estimated number of positions.
(2) Ordering Periods The price for each Option Period will be determined in the same manner as those for the Base Contract Period using the same CBA rates as described above.

(3) Price Proposal The Offerors’ price proposal will be used to determine whether the ceiling rates proposed for each labor category are fair and reasonable in order to establish ceiling rates for sole-source Time and Material/Labor Hour contract types per Circuit.
All offers with separately priced line items or subline items shall be analyzed to determine if the prices are unbalanced. Unbalanced pricing exists where the prices of one or more line items are significantly overstated or understated, despite an acceptable total evaluated price. Offers may be rejected if the CO determines the lack of balance poses an unacceptable risk to the Government.
(4) Exchanges The Government does not intend to hold discussion but reserves the right to hold them if necessary.
