About this file
This document is a Surety Forms requirement document for the County of Ocean, New Jersey, establishing mandatory bonding standards for bidders on the Ocean County Administration Building HVAC and Roof Upgrades project. Bidders are required to submit a Consent of Surety and a Certificate of Surety Company completed by an authorized representative of the surety firm. The surety company must comply with New Jersey Public Law 1996, Chapter 384, which establishes specific authorization and financial requirements for all surety companies providing performance and payment bonds on County projects. The certificate confirms that the surety meets applicable capital and surplus requirements and is authorized to issue the required bonds.
The Surety Disclosure Statement and Certification form requires comprehensive documentation of the surety's financial capacity, including current capital and surplus amounts certified by public accountants, underwriting limitations (either established by the U.S. Secretary of the Treasury or pursuant to New Jersey law), and the total bond amount. If the bond amount exceeds the surety's underwriting limitation, details of any reinsurance agreements must be provided, including reinsurer names, addresses, participation amounts, and certification that each reinsurer meets credit requirements under New Jersey law. Failure to provide a completed Certificate of Surety Company is identified as a non-waivable defect resulting in bid rejection. If the successful bidder fails to deliver compliant performance and payment bonds from a qualified surety, the County of Ocean reserves the discretion to rebid the project or award the contract to the next lowest responsible bidder.
