About this file

This is a Justification and Approval (J&A) document for Other Than Full and Open Competition from the Department of Veterans Affairs VISN 10 Network Contracting Office for the Louis Stokes Cleveland Medical Center. The document justifies sole-source procurement of Tridium building automation system components as part of a $114,189 project to renovate the 3rd Floor Ambulatory Care for Specialty Care Clinic.

The J&A explains that Wade Park facility is heavily invested in the Tridium centralized building automation system, which was selected after extensive investigation of facility needs. While sensors, meters and other devices can be competitively sourced, the Tridium software, programming/analytics, and Vykon JACE 8XXX components are proprietary and must be sole-sourced to maintain system compatibility and single point of access for building automation. The procurement will be competed and synopsized on SAM.gov as an Invitation for Bid (IFB) with the brand name specification for the Tridium Vykon system. The justification cites authority under 41 USC §3304(a)(1) and FAR 6.302-1 for "Only One Responsible Source."

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C250-25-AP-0603

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting Office (NCO)

10, Louis Stokes Cleveland Medical Center will enter into a construction contract that requires the procurement of this item which requires justification for other than full and open competition. The 0 dollar 2237 purchase request number for the “Renovate 3rd Floor Amb Care for Specialty Care Clinic” Project is 541-25-1-5986-0003.

2. Nature and/or Description of the Action Being Processed: This project is named “Renovate 3rd Floor Amb Care for Specialty Care Clinic” and this project will renovate the north half of the Ambulatory Care 3rd Floor to create new Specialty Clinic Exam Space. Current use is Mental Health Administrative space and is the only non‐outpatient clinic function in the Ambulatory Care Addition.

This location is in close proximity to the Main Entrance and will better service our outpatient Veteran patients.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Wade Park is heavily invested in a centralized building automation system called Tridium. Tridium was selected after extensive investigation of the facility needs and products available. This extensive investigation was performed as a separate project with the sole focus on determining the best path forward for building automation without eliminating competition for installation and maintenance. A sole source justification was submitted previously which facilitated the initial purchase of the Tridium equipment through an energy program project which. The Tridium system is currently operational and requires that on each subsequent project where there is a need for HVAC control, Automation for Lighting, Power Monitoring, Energy Metering, etc. that Tridium will be the platform required in these contracts. The software, programming/analytics, Vykon JACE 8XXX are proprietary and are the only portion of the Tridium system that needs to be sole sourced currently. All of the devices such as sensors, meters, etc. that tie into the Tridium system can be purchased with full and open competition by various open source vendors. This system needs to remain a strictly controlled single point of access for building automation for the main campus and all VA controlled properties that will eventually tie into the main campus. Engineering Services was impacted and would be again if they had to procure, train, monitor and maintain on several separate access control systems.

The estimated value of materials for this project is $114,189.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302‐1.

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): It was found that Tridium Niagara software allows for easy integration of our existing various, electric meters, gas meters, steam meters, flow meters, lighting control, boiler plant controls, chiller plant control, HVAC controls, etc. at Wade Park. Tridium offers an overarching building automation system with one easy to use interface for engineering service, police service to monitor and control. For those reasons this system was purchased and installed in the facility and is continuing to be upgraded and expanded.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement will be competed and synopsized on SAM.gov (https://sam.gov/) as an Invitation for Bid (IFB) and will indicate the requirement for brand name specification for the Tridium Vykon system. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentivized to locate the supplier that will provide the item at the most economical price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The anticipated cost should be fair and reasonable to the government based on the overall project is being competed. Reference FAR 8.404 (d), “GSA has already determined the prices of items under schedule contracts to be fair and reasonable.”
