About this file

This is a Justification and Approval (J&A) for Other Than Full and Open Competition from the Department of Veterans Affairs for the Notifier fire alarm system components required for the "Renovate 3rd Floor Amb Care for Specialty Care Clinic" project at the Louis Stokes Cleveland VA Medical Center. The J&A seeks approval to sole source Notifier brand fire alarm equipment valued at $65,288, citing that only Notifier parts, software and firmware will integrate with the existing hospital fire alarm system per NFPA 72 requirements.

The justification is based on "Only One Responsible Source" authority under FAR 6.302-1, as no other manufacturer's equipment will properly integrate with the existing Notifier system. While the overall construction contract will be competed as an Invitation for Bid (IFB) on SAM.gov, the fire alarm components must be Notifier brand. The J&A notes that fair and reasonable pricing will be achieved through competition at the prime contract level, as bidders will be incentivized to find the most economical source for the required Notifier equipment. The document is signed by the Design COR Richard Clark and Contracting Officer Brian Kish.

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting Office (NCO)

The 0 dollar 2237 purchase request number for the “Renovate 3rd Floor Amb Care for Specialty Care Clinic” Project is 541-25-1-5986-0003.

2. Nature and/or Description of the Action Being Processed: This project is named “Renovate 3rd Floor Amb Care for Specialty Care Clinic” and this project will renovate the north half of the Ambulatory Care 3rd Floor to create new Specialty Clinic Exam Space. Current use is Mental Health Administrative space and is the only non‐outpatient clinic function in the Ambulatory Care Addition.

This location is in close proximity to the Main Entrance and will better service our outpatient Veteran patients.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The fire alarm notification system and all associated equipment are required by NFPA 72 (National Fire Alarm Code). “Notifier” is the existing fire alarm system in the hospital, and only parts, software and firmware from the same manufacturer will work with the system. Signal devices of another manufacture may work with the “Notifier” panels but are not acceptable based on tested and approved UL listing. The estimated value of the “Notifier” materials is $65,288.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement will be competed and synopsized on SAM.gov (https://sam.gov/) as an Invitation for Bid (IFB) and will indicate the requirement for brand name specification for the Notifier Fire Alarm system. Since the construction contract is being awarded as a firm fixed price contract through competitive sealed bidding, the bidders are incentivized to locate the supplier that will provide the item at the most economical price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: It is anticipated that two (2) or more bids will be received through the sealed bidding process. If two (2) or more bids are received than the cost of the entire project will be considered fair and reasonable to the government based on competition.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No other manufacturer will intergrate with the existing system.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
