a.

Please confirm if the top 20% limit is a requirement per specification section 018113.13, or is it the contractors discretion to include IRA limits per category on the Interim IRA b.

West Campus, SE WASH DC

A: Specification Section 018113.13 Embodied Carbon Design Requirements to be revised.

A: GSA goes by which EPD is used for the material or product at issue. The raw material (e.g. from Nucor, Steel Dynamics, Cascade etc.) is typically formed into different shapes by smaller, more regionally-distributed fabricators. GSA has EC3-generated lists of products in both categories, and which qualify for GSA’s three GWP limits.

A: These assumptions about what constitutes fabrication are correct. Please see additional insight in the following answer.

A: EPDs identify whether a product is fabricated or unfabricated, and are categorized in EPD databases such as EC3 accordingly. The EPD’s indication of whether a steel product is fabricated governs which GWP limit applies. GSA recognizes that unfabricated steel EPDs may be more prevalent, and has received input from the steel industry on fabrication being a geographically-distributed process at smaller firms -- and one which contributes less to GWP than the steel’s original (unfabricated) manufacturing.

Low Embodied Carbon Material Requirements Form and within IRA Limit Commitment Table found within the Solicitation (pg. . 15, 16 of 40)?

Per the Interim IRA Low Embodied Carbon Material Requirements Form and within IRA Limit Commitment Table found within the Solicitation (pg. . 15, 16 of 40) there are products listed under Steel as 'fabricated' and 'unfabricated'. Please provide definition as to what is classified as 'fabricated' and 'unfabricated' for these specified products.

9.

Per the Interim IRA Low Embodied Carbon Material Requirements Form and within IRA Limit Commitment Table found within the Solicitation (pg. . 15, 16 of 40) there are products listed under Steel as 'fabricated' and 'unfabricated'. i.e., Hollow Structural Sections. It is our assumption that 'unfabricated' will be (Step 1): steel mill casting steel plate, or does it also include (Step 2): Shaping the steel plate into a tube? We would also assume that (Step 3): a 'fabricator' who would receive tube stock and add plates, caps, connects, etc. would be classified in the 'fabricated' category.

Please confirm these assumptions are correct, or provide definition of each.

10.

Per the Interim IRA Low Embodied Carbon Material Requirements Form and within IRA Limit Commitment Table found within the Solicitation (pg. . 15, 16 of 40) there are products listed under Steel as 'fabricated' and 'unfabricated'. i.e., Hot-Rolled Sections.

11.

It is our assumption that 'unfabricated' would be inclusive of the hot-rolled sections directly from a steel mill. If this assumption is correct, please provide information on how the 'fabricated' IRA [GWP limit] is to be calculated.

a.

As this project is primarily miscellaneous metals and not structural steel, we request definition on how the GWP Value for IRA limits are to be calculated for the 'fabrication' process as miscellaneous steel fabrication shops are generally smaller with less ability to track and calculate the true GWP Value.

b.

West Campus, SE WASH DC

A: There are no FAR clauses associated with the IRA Low Embodied Carbon requirements.

If a contractor fails to provide the proposed materials that are subsequently incorporated into the contract, the Government may take appropriate action for noncompliance and failure to meet the terms and conditions of the contract.

To further clarify RFI 411, we were wondering how GSA handles it if the Contractor fails to meet the requirements. Is there a penalty or Liquidated Damages associated with this item? Is funding still provided under the IRA, and how is that handled? Is the submittal rejected until it meets the requirements? If the trade specifications do not have a submittal requirement, does it not apply?

Also are there any FAR clauses associated with Embodied Carbon?

12.

Our biggest concern is associated with having so many suppliers that will provide material on this project that we are not sure all of them will meet the requirements (hence RFI 411). An example would be steel – most trades have some elements of steel associated with them and are all manufactured at different mills. If the trades specifications reference one of the related work specifications noted in 018113.13 1.3 for their products, does that mean they are to meet the carbon thresholds required?

13.

Subcontractors’ materials in these four categories must meet GSA’s IRA GWP limits if the materials are used in a way that does not consume or generate energy.
