(4) Additional Proposal Requirements

GSA is required to track spending for each of the three appropriations it received under the Inflation Reduction Act of 2022 (IRA) -- for low-embodied carbon (LEC) materials, emerging and sustainable technologies, and high-performance green building measures

-- and has established “budget activities” for each of these appropriations. A contract line item number (CLIN) for each of these budget activities has been included in the

Agreement as necessary. In addition, subCLINs will be used to track spending on each of the LEC materials designated for IRA funding -- asphalt, concrete, glass, and steel.

Offerors must include separate prices for IRA work under the corresponding IRA CLINs and subCLINs.

Amounts for each IRA CLIN should reflect all expenses necessary to accomplish acquisition and installation of IRA work elements. A list of possible expenses follows below; this list is not exhaustive.

● Expenses of acquiring and transporting products and materials required for IRA-funded work to the construction site;

● Labor, general and administrative expenses, and overhead and profit reasonably attributable to installation of IRA-funded work;

● Expenses for materials, tools, riggings and equipment (including safety equipment) required to install IRA-funded work;

● Design, submittal and documentation expenses reasonably attributable to IRA-funded work;

● Demolition and disposal expenses reasonably necessary for and attributable to

IRA-funded work;

● Expenses necessary to return space to its condition preceding IRA-funded work;

● Environmental remediation expenses required in execution of IRA-funded work;

and

● Phasing and commissioning expenses reasonably attributable to IRA-funded work.

II.D. Technical Proposal

FACTOR 1. Prior Experience on Similar Projects 10%

This factor considers the extent of the Firm’s past experience as a firm in providing similar construction services. The Firm must demonstrate successful experience as a General Contractor (GC) responsible for the construction of two (2) similar projects substantially completed within the past twelve (12) years as defined below.

A similar project is defined as a project with all the following characteristics:

Project consisted of core and shell, tenant fit out: electrical, mechanical, plumbing, HVAC, sprinkler installation, fire and life safety systems, telecommunications, security infrastructure systems and utility connections.

The total project construction cost upon completion was not less than $200 million.

Project involved work on a historic site and/or campus. The terms “historic site” and “historic campus” refer to sites or campuses that are listed in or eligible for the National Register of Historic Places, or properties that otherwise have historic significance and required protection of historic elements.

Project included sustainable design (LEED ® certified) effort.

For each project presented in relation to this factor, the Offeror must demonstrate that the project meets each of the above criteria. For each project presented the Firm shall submit the following data/information:

(a) Project Title

(b) Owner and/or Occupants(s)/Tenant(s)

(c) Location

(d) Project description including GSF

(e) Special Features i.e. Security System, Historical Consideration

(f) Contract Award Date

(g) Contract Type and Contractor's Responsibilities (Scope of Work)

(h) Date of Substantial Completion

(i) Contract Cost at Award

(j) Contractor’s key personnel assigned full time to the project

The more experience performing projects meeting the above criteria, the higher the Offeror will be rated.

Evaluation Criteria: This factor will evaluate the past experience of the firm to determine whether they have experience on two (2) “similar” construction projects that were substantially completed within the last twelve (12) years and meets ALL of the above similar characteristics.

Acceptability Standard: This factor will be evaluated based upon the Offeror’s written response to the RFP. However, the Government reserves the right to contact references under this evaluation factor to verify the scope of the project offered. If the Offeror materially misrepresents information relating to its experience, the Contracting Officer may reject the proposal.

FACTOR 2. Past Performance of Offeror 10%

This factor considers the past performance of the Offeror.

Evaluation of Past Performance will be a subjective assessment. The Government is seeking to determine whether the offeror has consistently demonstrated a commitment to customer satisfaction, timely delivery of services, adherence to contract schedules, subcontractor management, safety management, quality control programs, good workmanship, conformance to specifications, and fair and reasonable prices.

Submission Required by Offeror:

The Offeror shall submit one reference (a person or persons who may be contacted regarding the quality of the Offeror’s past performance) for each similar project presented in Evaluation Factor 1: Prior Experience on Similar Projects. (PBS Past Performance Questionnaire is attached for your use. PPQ can be submitted directly to the Contracting Officer or included in the Proposal submission.)

The Offeror shall provide the name, title, company name, current address, current phone number, current email address, and current fax number for the reference.

Offeror is responsible for the accuracy of this information.

Evaluation Criteria: This factor evaluates the past performance of the Offeror to determine responsibility.

Acceptability Standard: This factor will be evaluated based upon the Offeror’s past performance record that demonstrates satisfactory performance on the comparable project submitted under Factor 1: Prior Experience on Similar Projects. The Government intends to contact individuals provided as references but may solicit other sources including, but not limited to, Federal, state, and local agencies, better business bureaus, published media, and electronic databases as references for information on the identified projects presented by the offeror, if deemed necessary. The Government may choose to contact additional customer(s) not provided by an offeror and may obtain additional information through other sources, such as System for Awards Management (sam.gov), and phone interviews using all SAM Unique Entity ID (UEI) numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the firm.

Any proposal which does not demonstrate satisfactory performance on the similar projects submitted under Factor 1: Prior Experience on Similar Projects will not be considered technically acceptable and will be scored accordingly.

If the firm is a joint venture, information submitted for a party to the joint venture will not be evaluated to the extent that the terms of the joint venture agreement limit such party's performance or financial obligations as a party to the Contract contemplated by this Solicitation.

Notice to Proceed January 2024 Substantial Completion June 2026 Project Completion January 2027

EVALUATION FACTOR 5. Sustainability 15%

Background and Overview

This project is funded in part by Section 60503 of the Inflation Reduction Act of 2022

(IRA), which provides funding for purchase of construction materials with substantially lower levels of embodied greenhouse gas emissions.

GSA’s Interim IRA Low Embodied Carbon Material Requirements establish numeric global warming potential (GWP) limits for certain EPA-approved construction materials: concrete (and cement), asphalt, steel, and glass (IRA-Eligible Materials). For each material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits), and better than industry average (Better Than Average Limit).

This Evaluation Factor calls for Offeror commitments to furnishing IRA-Eligible Materials with the lowest possible GWP values. IRA Limit commitments proposed under this evaluation factor will be incorporated into the successful offeror’s resultant contract.

Individual materials’ GWP values may be found on individual manufacturers’ environmental product declarations (EPDs). EPDs must meet the standards reflected in

GSA’s Interim IRA Low Embodied Carbon Material Requirements (see Compliance

Documentation criteria listed for each IRA-Eligible Material).

Technical Acceptability and Scoring

Offerors will only meet the standard for technical acceptability under this Factor if they commit to furnish all required IRA-Eligible Materials with a GWP better (lower) than each

IRA-Eligible Material’s Better Than Average Limit.

Offerors meeting the standard for technical acceptability will receive a number of Raw

Scores, one for each IRA-Eligible Material required by the Contract:

● Offerors will receive a Raw Score of 100 for each IRA-Eligible Material commitment that is better (lower) than GSA’s Top 20% Limits.

● Offerors will receive a Raw Score of 40 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Top 40% Limits.

● Offerors will receive a Raw Score of 20 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Better Than Average Limit.

Offerors shall self-score* this Factor by filling out the table below with: the applicable

IRA Limit they commit to meet for each IRA-Eligible Material; the associated Raw Score;

and the Weighted Score.

Total Weighted Score (sum of Weighted Scores)

* The Weighted Score for each material must be rounded to the nearest hundredth decimal (i.e., two decimal places to the right of the whole number). The Total Weighted

Score (sum of Weighted Scores) must be rounded to the nearest whole number in accordance with generally accepted rounding methods (i.e., numbers 5 through 9 are rounded up to the next whole number; numbers 1 through 4 are rounded down to the next whole number).

** Required construction product assemblies (such as window assemblies) are included in IRA-Eligible Materials categories and will be bound by IRA Limit Commitments. At least 80% of the assembly’s total cost or total weight must be composed of compliant

IRA-Eligible Materials.

*** Where provision of concrete that qualifies under these GSA IRA Limits is impractical, GSA’s IRA Limits for cement may be applied to the cement being used in the concrete mix.

In addition, for each IRA-Eligible Material identified in the table above, offerors shall submit compliant EPDs listing that material’s GWP.

Note: By submitting an offer, Offerors consent to GSA sharing supplier names and the

GWP values associated with supplier materials with the successful offeror. Technical solutions, supplier pricing and supplier-offeror terms and conditions will not be shared.

EVALUATION FACTOR 6. Small Business Participation 10%

This factor is used to evaluate (a) the offeror’s past performance indicating the extent to which the offeror attained applicable goals for small business participation under contracts that required subcontracting plans and (b) the offeror’s proposed approach to small business participation under this requirement.

Submission:

Offerors shall submit a Small Business Participation Plan which describes how small businesses, including SDBs, WOSBs, VOSBs, SDVOSBs and HUBZone, will play an active role throughout the life of this contract. Include a demonstration of your company’s commitment to small businesses under similar contracts.

Evaluation criteria:

This factor will evaluate:

a) The extent to which small business firms are specifically identified in the proposal,

b) The extent of commitment to use such firms (enforceable commitments are to be weighted more heavily than non-enforceable ones),

c) The complexity and variety of the work small firms are to perform,

d) Past performance of the offerors in complying with requirements of the clauses at

FAR 52.219-8, Utilization of Small Business Concerns, and 52.219-9 Small Business Subcontracting Plan,

e) The extent of participation of such firms in terms of the value of the total award, and

f) The realism of the proposal.

Based on the submitted Small Business Participation Plan, offerors will receive a rating commensurate to the level of effort as evaluated by the Board.

Acceptability Standard:

This factor will be evaluated based upon the Offeror’s written Small Business Participation Plan and its demonstration for use of small businesses under the resultant contract, and its compliance with FAR 52.219-8, Utilization of Small Business Concerns.

Greater weight will be given to offerors who:

●Identify specific small businesses meeting at least one socio-economic category

●Have enforceable commitments with identified small businesses

●Demonstrate corporate commitment to all types of small businesses, such as through successful partnering under similar contracts or through participation in federal agencies’ small business mentor-protege programs.

Specifically identified small businesses will be listed in the resultant contract.

NOTE: SUBCONTRACTING PLAN SUBMISSION

[A Subcontracting Plan is submitted as a matter to be eligible to receive a contract award (basis for award). As such, subcontracting plans are not “evaluated” as part of the source selection but are assessed for acceptability and may be negotiated, if necessary, to achieve acceptability.]

Submit an individual subcontracting plan which identifies, in terms of dollar value and percentage of total proposed price, the extent of work performed by the prime contractor. The plan states the extent of work, including type and percentages, to be subcontracted to LB, SB, SDB, WOSB, HUB Zone, VOSB, and SDVOSB firms.

GSA is committed to assuring that maximum practicable opportunity is provided to small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns to participate in the performance of this contract consistent with its efficient performance. GSA expects any subcontracting plan submitted pursuant to FAR 52.219-9, Small Business Subcontracting Plan, to reflect this commitment. Consequently, an offeror, other than a small business concern, before being awarded a contract exceeding $750,000 ($1,500,000 for construction), must demonstrate that its subcontracting plan represents a creative and innovative program for involving small, HUBZone small, small disadvantaged, women-owned, veteran-owned, and service-disabled veteran owned small business concerns as subcontractors in the performance of this contract.

GSA's Fiscal Year 2023 Subcontracting Goals:

• 21 percent of subcontracts for small businesses

• 5 percent of subcontracts for small-disadvantaged businesses

• 5 percent of subcontracts for women-owned small businesses

• 3 percent of subcontracts for HUBZone small businesses

• 3 percent of subcontracts for service-disabled veteran-owned small businesses

Submit a narrative in the plan which supports the proposed goals, and which meets all the requirements for the plan outlined in FAR 52.219-9.

Failure to submit and negotiate a subcontracting plan which reflects the “maximum practicable opportunity for SBs, SDBs, WOSBs, VOSBs, SDVOSBs and HUBZone to participate in the contract” shall make the Offeror ineligible for award of the contract.

EVALUATION FACTOR 7. Project Labor Agreement 15%

A proposal submitted subject to the PLA requirements set forth in this solicitation will receive full credit under this evaluation factor. A proposal submitted not subject to such PLA requirements will receive no credit under this evaluation factor.
