NIHOF2016102 – Amendment 0003

The purposes of this amendment are to:

1) Revise Section M to add paragraph f within Factor 3 to address the basis for awarding the task orders included in the solicitation as identified in the Pre-Proposal Conference:

Factor 3: Price

f. The task orders included in the solicitation will be awarded for the lowest aggregate total while awarding at least one task order to each awardee. In the event there are 4 awardees, each awardee will be awarded one of the task orders included in the solicitation. In the event there are 3 awardees, one awardee will be awarded two task orders included in the solicitation and the other 2 awardees will be awarded one task order each. In the event there is more than one combination that totals the same aggregate total for the Government, the Government will document the combinations and draw lots of the combinations. The Government will award the task orders based on which lot was drawn

2) Provide a revised Attachment 1 – Statement of Work

3) Provide a revised Attachment 3 – Specification Section 01 33 00

4) Provide a revised Attachment 4 – Specification Section 01 35 26

5) Provide a revised Attachment 5 – Specification Section 01 45 00

6) Provide Attachment 15 – Specification Section 01 32 01

7) Provide Attachment 16 – Specification Section 01 78 00

8) Provide a revised Section L

9) Provide a revised Attachment L2

10) Provide a revised Attachment L8 – C104418 – Statement of Work

11) Provide a revised Section M

12) Provide answers to the following questions:

Q.1: With regard to C104418, can the COR please clarify the location of the valves on the drawings? It isn’t very clear to the exact locations.

A.1: A revised Statement of Work with additional information included is attached.

Q.2: Are we required to submit the “Additional Information” as outlined on page 96-97 of the solicitation (General Experience, Organizational Experience Related to this RFP, Performance History, Pertinent Contracts, and Pertinent Grants)? If so, which volume should it go into and how will it impact the maximum page limits?

A.2: Yes this information is required. It is to be included in Volume 3 – Price and Administrative.

Volume 3 does not have a page limitation.

Q.3: Per the solicitation, on page 86 it states our Cross Reference Matrix is not included in the page count. Can we please have a sample Cross Reference Matrix so all appropriate information is submitted?

A.3: The Cross Reference Matrix identified in the solicitation referred to an example of a document an offeror could create to provide guidance to the Government on where specific items in the proposal were. There is not a Government standard or sample that was created by the Government for use, nor is there a requirement to provide a Cross Reference Matrix or any documentation which identifies where items are in the proposal. Section L has been revised to delete this reference.

Q.4: In lieu of the PPQ form [Attachment L3] provided, can we substitute with a CPARS rating for a proposed project?

A.4: No, a Past Performance Questionnaire is required for each contract citation.

Q.5: Since bid bonds are not required for the seed task orders – does NIH require a letter from the Surety stating single and aggregate bonding capacity to be submitted as part of the proposal?

A.5: Yes, this was intended to be included in the Financial Capacity section. This paragraph in Section L has been revised to specifically request this information.

Q.6: Is a travel policy required for all teaming and major subcontractors? If no policy is in place, will a letter signed by an officer of their company stating that any per diem and travel will be paid in accordance with the FAR 31 and GSA Per Diem posted rates be sufficient for this requirement?

A.6: A letter stating that would be acceptable in the event an offeror (or any proposed subcontractor) does not have a written travel policy.

Q.7: Is the “commitment letter” required for all teaming partners and major subcontractors?

A.7: Yes. The language in Section L has been revised to include both teaming partners and subcontractors.

Q.8: If a company does not have Government property in its possession – will a letter stating such be required and filed within Volume 3 – Pricing and Administrative?

A.8: If an Offeror does not have Government property in its possession they shall state so in some way (a letter would be acceptable). The language in Section L has been revised to specifically request this.

Q.9: Has an asbestos survey been conducted on all insulation, if so, will the contractors be provided a copy of the survey results?

A.9: A printed copy of the asbestos survey is not available. NIEHS Health and Safety Branch keeps a log of all known areas containing asbestos and areas previously abated. See revised SOW, paragraph 9 for additional information.

Q.10: Will the awardees receive a designated location in which to set-up a mobile office? If a mobile office is allowed aboard the complex which area will be established to accommodate the facility? Also, will the contractor be required to pay for utilities required for the mobile office?

A.10: The Contractor may install and maintain an onsite construction trailer at the Contractor's own expense for the duration of the contract as required for the effective management and administration of individual task orders. See Article H.22 which identifies the specific requirements associated with location, Government provided utilities, Contractor provided utilities, etc.

Q.11: It was discussed at the MATOC Pre-Conference that a CPARS evaluation would be conducted in the first awarded task order. As such, the results of that CPARS would determine whether the company receives additional work. What is the dollar limit and performance requirement on CPARS from the first awarded task order to receive further work?

A.11: At the Pre-Proposal Conference it was stated that CPARS evaluations would be done, but not for the first awarded task orders. A CPARS evaluation will be done for the overall contract as well as individual task orders valued at $650,000 or more. See Article G.9 for additional information.

Q.12: Will each building have a designated lay down area or is there one lay down area for the entire MATOC awardees?

A.12: There is one laydown area for the NIEHS campus located near the softball field southwest of Building 101. If there will be a separate laydown area for an individual task order, that individual task order Statement of Work will identify that.

Q.13: Is it a requirement that the contractor provide a Site Superintendent, Safety, and Quality Assurance person on each project or can one individual perform all three functions as a triple hat?

A.13: See the revised Statement of Work that is attached. The Project Manager can act as the Site Security Manager. The Project Superintendent can act as the Site Safety and Health Officer and the Quality Control Manager unless otherwise stated in an individual task order. If a contractor is awarded multiple projects then it will be up to that contractor to manage their workload

Q.14: Will the contractor incur liquidated damages on the task orders?

A.14: If an individual task order will contain liquidated damages it will be identified in the Statement of Work for that individual task order. Liquidated damages are not included in any of the task orders included in the solicitation (C103451, C104415, C104417, or C104418).

Q.15: Will safety requirement be in accordance with the EM 385-1-1 [Nov 14]?

A.15: Yes, safety requirements shall be in accordance with all applicable EM 385-1-1 requirements, see revised SOW paragraph 4.1.5. The latest edition of the EM 385-1-1 in effect at the time of a task order proposal due date is considered applicable for an individual task order.

Q.16: Will the contractors be allowed access to the building to work on weekends? If so, what is the procedure to request access for weekend work?

A.16: Yes, contractors are allowed access to the building to work on weekends when coordinated in advance. A request to perform weekend (or Holiday) work shall be made using the “NIH Project/Temporary Access Form,” see revised SOW paragraph 4.1 for additional information.

Q.17: In the case of a medical emergency, what is the procedure to get immediate treatment for employees working on site?

A.17: Contractors shall arrange for their own emergency medical treatment in accordance with revised SOW paragraph 1.11. All medical emergencies shall be reported to Security at 919-541-2800 for coordination of Emergency Medical Services to the area of need while onsite in accordance with the NIEHS “Occupant Emergency Plan,” see revised SOW paragraph 4.1.5 for additional information.

Q.18: On page 91 of the solicitation it states the following:

3. Subcontractors If subcontractors are proposed, please include a commitment letter from the subcontractor detailing:

a. Willingness to perform as a subcontractor for specific duties (list duties).

b. What priority the work will be given and how it will relate to other work.

c. The amount of time and facilities available to this project.

d. Information on their cognizant field audit offices.

e. How rights to publications and patents are to be handled.

This seems excessive for a subcontractor commitment letter especially for small businesses – can this requirement be relaxed to just stating their willingness to perform with proposed the agreed upon scopes?

A.18: After reviewing this again, d. and e. are excessive for this requirement. Therefore, Section L has been revised to eliminate those requirements.

Q.19: Subcontractors who are getting PPQs filled out for jobs on which they were a subcontractor to a prime, who is required to fill out their PPQ?

A.19: The contract citations are for work performed by prime contractors, teaming partners, and Joint Venture partners. If the work was done by a major subcontractor that will be identified as a legal teaming partner, Part A of the Past Performance Questionnaire can be filled out by the major subcontractor or the prime contractor. For clarification purposes, as stated in Section L, “Past performance of any major subcontractor who is not identified as a legal teaming partner will NOT be evaluated and should not be included”.

Q.20: The solicitation mentions a technical proposal to include general experience, performance history, pertinent contract, etc. The solicitation doesn’t mention if the technical proposal is to be included as a part of one of the three volumes or if this is just a separate proposal on its own. Also, some of the information to be included in the “technical proposal” is already included in Volumes 1 and 2.

Please direct best path forward for the technical proposal.

A.20: The language in Section L within the Technical Proposals section has been revised. The Additional Information section has been deleted. Volume 1 is to include all information associated with Past Performance. Volume 2 is to include all information associated with the Management Plan. Volume 3 is to include all information associated with Price as well as Administrative information identified on pages 90-91 of the solicitation (see revised Section L that is attached).

Q.21: Attachment L2 (Transmittal Letter and Past Performance Questionnaire) states that responses have to be returned by May 11, 2017 at 4:30 pm EST. The instructions on Page 87, Paragraph (e), Past Performance Questionnaire, states that they are to be received by the Government no later than the due date.

A.21: Attachment L2 has been revised. The responses are to be received by the Government no later than the due date which is now May 16, 2017.
