l. Introduction:
SOPA(ADMIN)INST 5090. l H
1 7 MAY 2018
a. Authoritv. Per reference (b) of SOPA(ADMIN)MYPTINST 5090. I H, NAVST A Mayport developed this Regulated Waste Management Plan (R\VMP) to comply with all applicable federal, state and local regulations. This RWMP provides policy and guidance for all commands as well as contractors working aboard NAVSTA Mayport property.
b. Scope and Applicabilitv. The Resource Conservation and Recovery Act (RCRA) authorized the Environmental Protection Agency (EPA) to implement hazardous waste (HW) management regulations from the point of generation through the final treatment and disposal, that is, "Cradle to Grave." The U.S. Congress waived sovereign immunity for Department of Defense (DoD) facilities subjecting them to full regulation including assessment of fines and penalties. The EPA granted the Florida Department of Environmental Protection (FDEP) the authority to implement and enforce HW regulations for identification, packaging, labeling, storing, transporting, treatment and disposal standards.
c. Pumose. The purpose of this R WMP is to provide instructions and guidelines for management of Regulated Waste (RW) aboard NAVSTA Mayport. This RWMP does not address the management of the RCRA permitted HWSF, as it operates within the provisions of the pen11it issued by FDEP.
d. Applicable federal and state regulations. These regulations mandate the procedures and requirements set forth in this instruction, and therefore, they are not discretionary. There is the potential for fines or criminal liability for personnel involved in violating rules.
(!) 40 CFR 760-266. 268. :no. '273 HW Regulations. EPA regulations establish a "Cradle-to-Grave" approach for the collection, storage, treatment and disposal of waste including: waste characterization, the manifest system, standards for generators, treatment, storage, and disposal facilities; and recycled materials.
(2) Florida Administrative Code IF AC) Chapter 62-730. FDEP HW re1,'lllations incorporate by reference the EPA regulations. FDEP regulations are eqnal to or more stringent than federal EPA regulations. FDEP is the enforcement agency for HW violations.
(3) 40 CFR 279. FAC Chapter 62-710 and Florida Statute 403. 751. EPA and FDEP regulations for the management of used oil and used oil filters including reporting, storage, disposal, recycling, and burning for energy value standards and requirements.
(4) 40 CFR 260 Military Munitions Rules. EPA regulations and exemptions for DoD munitions including HW identification and management, explosive emergency responses and transportation manifest exemptions.
Enclosure (I)
SOPA(ADMIN)INST 5090.1 H
(5) 49 CFR Parts 171-180. Department of Transportation (DOT) regulations for transportation ofHW on public roads (including transport between non-contiguous sites) and includes: container marking, labeling, packaging and shipping requirements; manifests, waste shipment records, and bill oflading requirements; and training requirements.
(6) Florida Administrative Code. Chapter 62-701. FDEP Solid Waste (SW) regulations for the management and disposal of solid waste. FDEP regulations are equal to or more stringent than federal EPA regulations. FDEP is the enforcement agency for SW violations.
e. Hazardous.Waste Minimization
( 1) Federal, state and local regulations require generators to reduce both the amount and toxicity ofRW. To meet these requirements, reference (a) and reference (b) of SOPA(ADMIN)MYPTINST 5090. l H direct all Navy activities to reduce waste generation by implementing the following. listed in priority order:
(a) Eliminate and reduce the use of Hazardous Materials (HM) at the source by changing the process, requirement, or materials used.
(b) Substitute a less hazardous and toxic HM.
( c) Reduce or eliminate waste by process or equipment changes.
( d) Recycle or recover and reuse HM whenever possible.
( e) Reduce or eliminate excess and expired-shelf life HM.
(f) Improve housekeeping in the waste generating process.
(2) Disposal is a last resort. The long-tenn goal is to reduce waste generation to the maximum extent possible by eliminating the use of HM or by implementing Best Management Practices (BMPs) and best available technologies.
2. Definitions
a. Accumulation Start Date (ASD)
(I) ASD in a< 60 Day Waste Storage Area
(a) The ASD is the date that the first drop or item is placed into a HW container; or
2 Enclosure ( 1)
(b) The date on which the container exceeds 55 gallons of waste in a satellite accumulation area (SAA) and is dated and transferred to a< 60 day waste storage area, whichever occurs first.
(2) ASD at an SAA
(a) If the activity does NOT have a< 60 day waste storage area, the accumulation start date for HW stored in a SAA is the date that the total amount ofHW exceeds the 55 gallon limit; or
(b) The date the fill level of the container reaches 90%; or
( c) The date the HW is picked up for disposal, whichever occurs first.
b. Aqueous Film Forming Foam (AFFF). AFFF is a highly efficient type of fire suppressant agent used to attack flammable liquids.
c. Best Management Practices (BMPs). BMPs describe practical work techniques that limit the introduction of pollutants into the environment. BMPs achieve a compromise between the environmental ideal (no pollution whatsoever) and what is realistic and practical from an economic and operational standpoint. Emphasis, however, is on the best environmental solution.
d .. Characterization. Waste "characterization" is the process of identifying waste components and their chemical concentrations, along with the work process used to generate the waste. Waste characterization is required to ensure the correct identification and use of EPA HW codes necessary for the safe and proper handling, treatment and disposal of R W.
e. Electronic Waste (e-waste). Consumer and business electronic equipment that is at or near the end of its useful life. Common electronic wastes include computer and television monitors, CPUs, hard drives, fax machines, photo copy machines, cell phones, and other miscellaneous electronic equipment.
f Emptv Container. HM containers (except a compressed gas) are empty only when all material (solid or liquid) is removed by pouring, pumping, wiping or scraping using BMPs for the type and size of the container.
g. Excess Hazardous Material (EHM). EHM means properly sealed, partial or full containers of material, that exceed the needs of the department or ship, or that may be used by another ship, within the shore establishment, or by a commercial industry.
h. Fluorescent Lamps. For the purposes of this instruction, fluorescent lamps are light bulbs that contain mercury or lead (e.g. High Intensity Discharge (HID) Lamps - High Pressure

p. Less than ( <) 60 Day Waste Stora!!e Areas. < 60 day waste storage areas are designated waste storage sites where R W is stored for up to 60 days before transfer to the NA VST A Mayport HWSF; there is no limit on the amount ofRW that can be stored inside a< 60 day \vaste storage area.
5 Enclosure (I)
SOPA(ADMIN)!NST 5090. l H
q. Militarv Munitions IMM). The tenn "military munitions" includes all ammunition products and components produced for or used by DoD for national defense and security. The Military Munitions Rule (MR) defines when munitions become waste and provides management procedures for disposition or disposal. Appendix B establishes procedures, responsibilities and guidelines for the management of military munitions waste.
r. Non-Halogenated Solvents. A solvent not containing one of the halogens listed in the definition of halogenated solvent. Non-halogenated solvents include methyl ethyl ketone, alcohol, xylene, toluene, acetone and benzene.
s. NAVST A Mayport Pennitted HWSF. A facility with a RCRA "Part B" permit is allowed to store RW for up to one year from the container's storage start date. NAVSTA Mayport's pennitted HWSF is located at Building 1986.
t. Pharmaceutical Waste. Any chemical product, vaccine or allergenic (including any product with the primary purpose to dispense or deliver a chemical product, vaccine or allergenic), not containing a radioactive component, that is intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease or injury, or that affects the structure or function of the body. This definition includes products such as transdermal patches, and oral delivery devices such as gums or lozenges. This definition does not include sharps or other infectious or biohazardous waste, dental amalgams, medical devices not used for delivery or dispensing purposes, equipment, contaminated personal protective equipment or contaminated cleaning materials.
u. Point of Generation. The point of generation identifies both the date and place a material first becomes subject to the regulations or when the waste is offloaded from the ship with the intention of disposal.
v. Regulated Waste (RW). Any hazardous, non-hazardous, industrial process waste (also known as special waste), or off-specification HM, which because of its physical characteristics, chemical make-up or biological nature requires either special handling procedures and pennitting, or pose an unusual threat to human health, equipment, property, or the environment.
Examples include (but are not limited to) liquid sludge, pastes, or filter cakes, chemical compounds or petroleum products, fine powders or highly dusty materials, spent blast media or grit, demolition wastes from industrial facilities, debris or residues from spill cleanup work, underground storage tank remediation mate1ials, pollution control wastes, ash from fires, furnaces, boilers or incinerators, off-specification products, other materials that have the potential to be a hazardous waste. All R W may be used, unused, or excess materials, and laboratory analysis may be required to verify the waste is not a RCRA hazardous waste.
6 Enclosure ( 1)
w. Regulated Waste Generator
I 7 MAY
(I) NAVST A Mayport is a large quantity generator (LQG) of waste. While there are numerous entities performing work that generates R W on board NA VST A Mayport, all generators' waste is disposed under the NAVST A Mayport LQG identification number.
(2) RW generator means any person, by site, whose act or process first causes the waste to become subject to regulations. Commands working aboard NAVSTA Mayport (departments, tenant commands, and contractors) whose work occurs on NA VST A Mayport property and produces R W are generators.
(3) Ships are not generators; Navy policy with regulatory agencies' agreement.
established that ships generate used hazardous material (UHM) and UHMs are not regulated until the receiving command declares them waste subjecting them to regulations. Ships' forces become R W generators when they perform work processes at any ashore location.
x. Reportable Quantitv (RQ). The RQ identifies the amount of material (pounds or gallons) that when spilled or released to the environment, triggers a reporting requirement to the regulatory agencies. RQ amounts are specific to each material.
y. Satellite Accumulation Areas (SAA). SAAs are designated locations, at or near the point of generation, where HW is temporarily accumulated before transfer to a< 60 day waste storage area or the NA VST A Mayport HWSF. This is not a specified time limit for HW in an SAA;
however, no more than 55 gallons (cumulative total of all types ofHW) maybe stored in a SAA.
This 55 gallon limit does NOT include universal waste, used oil, or non-hazardous waste.
z. Solid Waste. Any garhage; refuse; sludge from a waste treatment plant, water supply treatment plant or air pollution control facility; and other discarded materials, including solid, liquid, semisolid, or contained gaseous materials resulting from industrial, commercial, mining, and agricultural operations, and from co1m1mnity activities.
aa. Universal Waste (U\V). UW includes batteries, some pesticides, unbroken fluorescent lamps and intact mercury containing devices when recycled. The ASD for UW is the date UW is first placed into a container and UW has a maximum storage time of one year at NAVST A Mayport. This storage time limit is not extended for UW transferred to the NA VST A Mayport
HWSF.
ab. Used Hazardous Materials (UHM). The term UHM applies only to Afloat Commands generating waste aboard a ship. UHM includes all used and unused HM with no reuse potential, 7 Enclosure (I)
1 7 or HM whose shelflife cannot be extended. UHM includes liquid or solid paints, oil filters, spent oxygen breathing apparatus, oily rags, paint debris, paint rags, etc.
NOTE #1: UHM becomes a R\V when transferred to the waterfront and is subject to all applicable regulations.
NOTE #2: \Vaste generated by ships' forces and stored inside a conex box is not UHM and is subject to full regulation.
ac. Used Oil. For the purposes of this instruction, any petroleum-based product that contains less than 1,000-parts per million (ppm) halogenated solvents and has not been contaminated with a listed waste is considered to be a used oil. Used oils include organic and s:,~1thetic oils, hydraulic oils and other oils as identified in 40 CFR Part 279. Used oil does not include bilge waler, cleanup liquids or other oil water mixtures that are mostly water. Fuels including aircraft and marine diesel are managed as off-specification fuel and must be labeled specifically for the drum contents. Example: Label off-specification JP-5 as "off-specification JP-5" and label off specification marine diesel as "oft~specification Marine Diesel."
CAUTION: Catapult hydraulic fluid is ethylene glycol based, not petroleum based; and is not a used oil.
ad. Waste Detennination. A waste detennination is the process used to characterize waste as RCRA RW. This requires verification that the waste is a solid waste, the waste is not specifically excluded from RCRA, the waste is a "listed" HW, or the waste is exhibits a characteristic ofHW.
ae. Waste Profile Number (WPN). The Vv1'N identifies and classifies commonly generated waste streams, and are based on analytical testing and generator knowledge of that specific process. WPNs reduce waste management costs by allowing similar wastes to be managed and disposed as one waste stream, rather than testing individual waste streams, significantly reducing analytical costs.
af White Goods. Microwaves, dishwashers, washing machines, dryers, and other miscellaneous types of appliances are a special category of waste and must be recycled.
3. Responsibilities
a. NA VST A Mayport CO must bear ultimate responsibility for environmental compliance and related liabilities affecting installation operations.
