DPS’ management team has assessed the solicitation’s requirements for Construction Experience and find the Criteria for projects restrictive for small businesses. We would ask that the Government consider the following changes in the criteria for Small Business project experience:
1. Consider changing the “completion” criterion to projects completed within the past 10 years from the date of issuance of the RFP (rather than 5 years).
2. Consider changing the “completed projects” criterion to projects that are 75% or more complete (rather than 100%).
3. Consider changing the “similar in size” criterion to “all projects with a minimum of $10M or more with at least three projects over $15M” rather than requiring a minimum value of $15M for all projects.
These requests are based on the fact that small businesses typically do not have the ability to complete five or more projects worth a minimum of $15M relevant projects during a five-year period.

Per the RFP, Construction Projects submitted for the Offeror shall be completed within the past five (5) years of the date of issuance of this RFP.
Will NAVFAC consider an extremely relevant project that is more than 80% complete in the construction phase and has a recent PPQ, acceptable.

Amendment 3 Attachment 1 (60 day automatic extension for SAM.gov renewals) seems to apply to existing businesses.
The same delays are occurring for new business UEI issuance. Can the government confirm how this extension will also apply for new Joint Ventures? Both partnering firms can submit their current UEI and cage codes but it is unlikely that the UEI numbers for the JV will be issued prior to the proposal due date.

Due to the noted delay in UEI issuance by GSA, the Government will accept proposals awaiting assignment of the UEI number and subsequent SAM.gov registration. This is ONLY if the SAM.gov registration can’t be completed due to the delay in the UEI issuance and the offeror has requested the UEI number at least 15 days prior to proposal due date. If a firm or JV has not been issued an UEI number this must be annotated on the technical and price proposal cover letters.
Additionally, documentation must be submitted that indicated the date and time of the UEI submission request. For JV, each of the JV partners must provide their current UEI numbers, as well as the above.
As soon as the UEI number and SAM.gov registration are accomplished they must be provided to the Government. The UEI and SAM.gov registration are required for contract award, thus any firm not having both will be determined to be ineligible for award.

Amendment 4 issued a revised Attachment D Safety Data Sheet with a previous RFP Number (N44255-21-R-200) Is it permissible for us to change the number to the correct RFP number (N44255-21-R-4000) ?

Reference PPI 045 in Amendment 003. PPI 045 asked “Please clarify if Offeror’s are to provide a standalone narrative or should we use Attachment A – Offeror Team Composition and Management (updated to Attachment B in amendment 002), provided with the RFP documents for this section?” The PPI response stated “Revised via Amendment 0002.”
Amendment 002 addressed the page count allowed for the Factor 1 Roles and Responsibilities question; however, it is still unclear if Offerors need to include a 2-page narrative and complete Attachment B – Offeror Team Composition and Management, or if Attachment B fulfills the requirement for the 2-page narrative. Please clarify if a narrative is required in addition to Attachment B, or if only Attachment B is required.

Amendment 3 clarifies the HUBZone 10% Price preference will be applicable for all unrestricted task orders, but does not clarify the past performance requirements for the HUBZone SB protégé partner. The language below was included in the NAVFAC NW BEQ, BLDG 2701 Renovation at Whidbey Island (N4425522R2001). This paragraph gives clear direction that all SBA approved Mentor-Protégé HUBZone JV’s are allowed to propose on the Solicitation.
Would the Government please include this language to provide clear direction?
Solicitation language in the BEQ, BLDG 2701 Renovation at Whidbey Island (Amendment 0008) If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, relevant projects shall be submitted for each Joint Venture member. In accordance with 13 C.F.R. 125.8(e), if the joint venture is an SBA approved Mentor-Protégé joint venture, the partners of the joint venture in aggregate must demonstrate the relevant project experience necessary to perform the contract.
With the exception of the SBA approved Mentor-Protégé joint venture, Offerors who fail to submit relevant experience for all Joint Venture members will be assigned a deficiency and will be rated Unacceptable.

In Amendment 3, #7. Section 00 50 00 Contracting Forms and Supplements, Attachment K was added as a replacement to the previous list of items in that Section.
When Attachment K is opened it is titled Attachment D on the new form provided in Amendment 3.
Are we to use this form for our Factor 4 – Safety?
If so, do you want us to add EMR rates to the form?
Do you still want a separate 2-page narrative? This form does NOT count in the 2-page limit, correct?

Justification: Many emerging small businesses that can financially support the RFP requirements have seen significant delays in projects due to the ongoing COVID 19 pandemic and those projects don’t meet the solicitation’s completion requirement. Many of the projects have also experienced one or even two years of delays due to the pandemic associated project shutdowns or suspensions, shortage of raw materials and serious extended lead times of critical equipment and systems.

Request: The Government’s Amendment #0003 extended the Past Performance Period to 7 years (from 5 years). We respectfully ask that the Past Performance Period be extended to 10 years.
Justification: It is difficult for many small businesses to have larger design build projects for past experience.
Additionally, many emerging small businesses that can financially support the RFP requirements have seen significant delays in design build projects due to the ongoing COVID 19 pandemic and those projects don’t meet the solicitations completion requirement. Many of the projects have also experienced one or even two years of delays due to the pandemic associated project shutdowns or suspensions, shortage of raw materials and serious extended lead times of critical equipment and systems.
Please reconsider this request.

Amendment 0003, page 9 provides a list of RFP attachments. This list includes Attachment B – Offeror Team Composition & Management. However, the RFP Instructions to Proposers does not state where Attachment B should be submitted.
Please clarify where Attachment B should be submitted in the proposal.

The Phase 1 Proposal Submission requirements listed in Amendment 0004 include the Attachment G – Financial Questionnaire form. The Attachment G form states, “Upon completion of the questionnaire, it is requested you email the completed questionnaire directly to d nancy.m.coffee.civ@us.navy.mil and jason.a.lewis34.civ@us.navy.mil forward it to the Offeror shown below.” Is the intent to say “or” forward to the offeror shown below? Please confirm that the form can be included in our submission and does not have to be forwarded directly to Ms. Coffee or Mr. Lewis.

A file titled Attachment K – Safety Data Sheet Safety Narrative was included in Amendment 0003. The file, when opened, is labeled Attachment D. Additionally, while Amendment 0003 clarified the submission requirements for the Safety metrics (Calendar Years 2016 -2020), there is still no mention of using any attachments for the information.
Please confirm the submission requirements for the Factor 4 Safety section, and which attachments (if any) are required to be submitted.

a) Attachment G Financial Questionnaire directs the offeror's bank to email this form directly to Nancy Coffee and Jason Lewis. Please confirm this is acceptable and offerors are not required to place Attachment G Financial Questionnaire in the Price Proposal due to its sensitive nature. b) If so, we respectfully request that the Government provide confirmation of receipt to offerors via email to the offeror’s POC listed within Attachment G Financial Questionnaire.

Amendment 0003, Attachment C includes a form for submitting required construction contractor and design firm experience. The form includes a field for the entity’s DUNS number.
According to sam.gov, DUNS numbers are no longer to be used and have been replaced with the Unique Entity Identification (ID) number assigned by sam.gov.
Please clarify which identification number should be included in this field.

Attachment G Financial Questionnaire We are submitting a proposal as a joint venture. Does NAVFAC want a Financial Questionnaire to be returned for each member of the joint venture team?
