1. Section 00 21 16 – Instructions to Proposers, make the following changes:

a. Remove:

If the PIEE portal is down on the date and time of the proposal due date, submit a help desk ticket. Provide a copy, dated prior to the proposal due date and time, along with an emailed copy of the submission to the Government POCs: nancy.m.coffee.civ@us.navy.mil & amanda.r.bonus.civ@us.navy.mil.

And Replace with:

b. Evaluation Factors, remove Factor 1 – Technical Approach:

(a) Solicitation Submittal Requirements: The composition and management of the firms proposed as the design-build (DB) team for this contract will be evaluated in this factor.

The Offeror shall submit the following information:

(1) Provide a simple organizational chart that clearly identifies the lines of authority between the proposed primary construction firms and primary design firms for this contract. Include a brief description of the role and responsibility of each entity not to exceed (1) one single-sided page. If the experience of an entity is being claimed in Factor 2, that entity must be named in the organizational chart.”

“Factor 1 – Technical Approach:

3. Section 00 70 00, Conditions of Contract, make the following changes:

a. Remove: Task Order Specific Provisions and Clauses

Provisions and Clauses cited in Section 00 21 16, 00 45 00, 00 60 00, and 00 70 00 of the solicitation and contract that are specific to individual Task Orders and/or that require fill-in or emphasis are provided with each Task Order RFP by the ACO. All other terms and conditions identified in the basic contract are in full force by reference in the Task Order. Attachment M lists the provisions and clauses that may be applicable at the Task Order level; this list is NOT all inclusive.

Replace with:

“Task Order Specific Provisions and Clauses

Provisions and Clauses cited in Section 00 21 16, 00 45 00, 00 60 00, and 00 70 00 of the solicitation and contract that are specific to individual Task Orders and/or that require fill-in or emphasis are provided with each

b. Remove Task Order Procedures

1. Task Order Procedures

When the Government requires work under the contract, a Request for Proposal (RFP) will be issued as appropriate.

Task Orders will be awarded on a DD Form 1155 (ORDER FOR SUPPLIES AND SERVICES). Task Orders will be issued using a system generated numbering system relating back to the basic contract number.

The Government will not be obligated to reimburse the contractor for work performed or any costs incurred, nor shall the Contractor be obligated to perform or otherwise incur costs except as authorized by executed Task Orders.

Each Task Order shall include as a minimum:

Date of Order Contract Number and Order Number Contract item number and description, quantity, and unit price or estimated cost Delivery or performance schedule Place of Performance Bid guarantee, performance and payment bond (or letter of “bondability” if authorized by the CCO) Any packaging, packing, and shipping instructions Accounting and appropriate data Applicable Wage Determination Method of payment and payment office Invoicing instructions

Task Orders may be modified by the Contracting Officer. Modifications to Task Orders will be issued on a Standard (SF) 30 and cite the Task Order Number. In the event the Contractor is unable to submit a proposal on a particular RFP, the contractor is required to contact the Contracting Officer prior to the Site Visit if they cannot participate in the walk through, or within five days of the proposal due date, if they cannot submit an offer. Notification of “No-bid” will require the Contractor to provide the reason for not proposing on the PTO.

Failure to provide this notification or to submit on a reasonable number of proposals may impact future consideration for proposed Task Orders or exercise of the option.

Task Orders may range from $10,000,000 to $100,000,000 per order. Task Orders under or over the range limitations may be considered if deemed to be in the Government’s best interest.

Task orders awarded on the NW MACCC, with the exception of the Seed Project, require a bid guarantee, performance and payment bonds. Bidders/Offerors are hereby notified that the contract time for purposes of fixing the completion date, default, and Liquidated Damages will be as stated in FAR Clause 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK, regardless of when performance and payment bonds or deposits in lieu of surety are executed.

“Task orders awarded on the NW MACC require a bid guarantee, performance and payment bonds. No bid guarantee, performance and payment bonds are required during Phase I of the solicitation.

Bidders/Offerors are hereby notified that the contract time for purposes of fixing the completion date, default, and Liquidated Damages will be as stated in FAR Clause 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK, regardless of when performance and payment bonds or deposits in lieu of surety are executed.”
