7. This acquisition will be solicited as an unrestricted procurement with an internal small business set-aside with full and open competition. Price evaluation preference will be given to HUBZone firms, in accordance with FAR 52.219-4.
And replace with:
“7. This acquisition will be solicited as an unrestricted procurement with an internal small business set-aside. Price Evaluation Preference (HZ PEP) will be given to HUBZone firms, in accordance with FAR 52.219-4.
The HZ PEP applies for price evaluation purposes on the basic MACC (seed task order). In the event HUBZONE small business(es) are awarded contracts under this MACC, the HZ PEP will also apply to task orders not set-aside for small business under this MACC. Proposed Task Orders estimated $20M and below, the HZ PEP does not apply.

Letter from the Offeror’s Surety. The letter shall verify the Offeror has a minimum $20M in bonding capacity per project. Large Businesses shall have a minimum aggregate bonding capacity of $100M and small businesses shall have a minimum aggregate bonding capacity of $36.5M.
And replace with:

(a) Solicitation Submittal Requirements: The Offeror shall submit the following information:
(1) Construction Experience:
Submit a maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as:
(i) Similar in size: Construction projects with a minimum value of $15,000,000.
(ii) Similar in scope: New construction, renovation, alteration, demolition, and repair work by DB or DBB for administrative facilities, housing facilities, child care centers, recreation/fitness centers, retail complexes, manufacturing and industrial facilities, communication facilities, special access program facilities (SAPF) or sensitive compartmented information facilities (SCIF’s), aviation facilities (i.e. hangars, control towers, etc.), or other similar facilities.
(iii) Similar in complexity: Involving multiple trades, working in areas with limited access, constructing various projects simultaneously, or managing multiple work sites simultaneously.
Projects submitted for the Offeror shall be completed within the past five (5) years of the date of issuance of this
RFP.
And replace with:
“Factor 2 – Corporate Experience:
(a) Solicitation Submittal Requirements: The Offeror shall submit the following information:
(1) Construction Experience:
Submit a maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as:
(i) Similar in size:

(ii) Similar in scope: New construction, renovation, alteration, demolition, and repair work by DB or DBB for administrative facilities, housing facilities, child care centers, recreation/fitness centers, retail complexes, manufacturing and industrial facilities, communication facilities, special access program facilities (SAPF) or sensitive compartmented information facilities (SCIF’s), aviation facilities (i.e. hangars, control towers, etc.), or other similar facilities.
(iii) Similar in complexity: Involving multiple trades, working in areas with limited access, constructing various projects simultaneously, or managing multiple work sites simultaneously.
Projects submitted for the Offeror shall be completed within the past seven (7) years of the date of issuance of this
RFP.”
c. Remove:
(2) Design Experience:
Submit a maximum of five (5) relevant design projects for the design team that best demonstrates design experience on relevant projects that are similar in size, scope, and complexity to the RFP. The Government will only review five (5) projects for design. Any projects submitted in excess of five (5) for Design Experience will not be considered. For purposes of this evaluation, a relevant project is further defined as:
(i) Similar in size: Construction projects with a minimum value of $10,000,000.
(ii) Similar in scope: New construction, renovation, alteration, demolition, and repair work by DB or DBB for administrative facilities, housing facilities, child care centers, recreation/fitness centers, retail complexes, manufacturing and industrial facilities, communication facilities, special access program facilities (SAPF) or sensitive compartmented information facilities (SCIF’s), aviation facilities (i.e. hangars, control towers, etc.), or other similar facilities.
(iii) Similar in complexity: Involving multiple trades, working in areas with limited access, or designing various projects simultaneously.
At least two projects shall demonstrate design-build experience. Failure to provide at least two recent and relevant projects demonstrating design-build experience will result in a deficiency for Factor 2 – Experience. A project submitted under design experience will meet the recency requirement if (a) the construction effort was completed within five (5) years immediately preceding the proposal due date, regardless of the design completion date, OR (b) the construction effort is ongoing, but the design completion date was reached within the five (5) years immediately preceding the proposal due date. Each relevant completion date shall be clearly stated on the Construction & Design Experience Project Data Sheet.
And replace with:
(2) Design Experience:
Submit a maximum of five (5) relevant design projects for the design team that best demonstrates design experience on relevant projects that are similar in size, scope, and complexity to the RFP. (a) Solicitation Submittal Requirements:
The Offeror shall submit the following information:
The Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate; and Total Case Rate (TCR) for the specified five (5) Calendar Years (CY), as well as a safety narrative as described further below. For a partnership, joint venture, the Offeror shall submit separate DART, TCR for the specified five (5) CY for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. Any fatalities experienced within this 5-year timeframe must be explained in detail, to include root cause and corrective actions.
NOTE: DART and TCR shall not be submitted for subcontractors.
(1) DART Rate: Submit five (5) previous complete calendar years’ CY2015, CY2016, CY2018, CY2019, and CY2020 worth of data (not an overall average). If the Offeror has no DART rate, for any year, affirmatively state so and explain why. If the DART rate calculation is 0.0, affirmatively state there were no DART cases during that year.
(2) Should a negative trend occur above moderate risk levels, an acceptable/detailed explanation is required, that includes any corrective actions taken for improvement.
a. Dart cases include injuries or illnesses resulting in death, days away from work, and/or restricted work or transfer to another job days beyond the day of injury/illness.
b. Calculation of DART rate: Multiply the total number of DART cases by 200,000, and then divide by the number of employee labor hours worked.
𝑫𝑨𝑹𝑻 𝑹𝑨𝑻𝑬=Number of DART Incidents x 200,000 Total Number of Employee Labor Hours Worked (3) TCR Rate: Submit five (5) previous complete calendar years’ CY2015, CY2016, CY2018, CY2019, and CY2020 worth of data (not an overall average). The Offeror’s price proposal shall be separate from the technical proposal. Complete and submit the following:
Cover letter in accordance with FAR 52.215-1(c)(2) Instructions to Offerors – Competitive Acquisitions (JAN 2017) that includes:
Phase I:
Solicitation Number Names, titles, telephone, and email addresses of persons authorized to negotiate on the
Offeror’s behalf Name, title, and signature of person(s) authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that authority; and Company (Unique Entity Identification (UEI) and Cage Code numbers (If a JV, then include the UEI Number and Cage Code of JV and for each managing partner under JV) and for Lead Design Firm;

In addition to the Phase I Cover Letter, provide the following with your Phase I Proposal:

Phase II:
In addition to the Cover Letter (update POC information if needed), provide the following with your Phase II Proposal:
Seed Project, Task Order N44255-21-R-4000/X001, Bid Schedule, complete pricing for all CLINs;
Bid Bond (in the amount of 20% of the proposal price for Proposed Task Order X001 or $3,000,000, whichever is less). Bid Bond (Class Deviation 2020-O0016 Original Documents, Signatures, Seals, and Notarization) in accordance with FAR 52.228-1 Bid Guarantee (SEP 1996); and
Standard Form (SF) 1442 (Solicitation). Complete blocks 14, 15, 16, and 18; and Acknowledgement of all Phase II amendments.
Failure to submit a Bid Bond conforming to the requirements of the solicitation may result in an Offeror's proposal being rejected as unacceptable.
5. Contract Provisions and Clauses, make the following changes:

6. Section 00 70 00 – Conditions of the Contract, make the following changes:
Limitations on Subcontracts and Subcontracting Responsibilities
The Contractor is required to track and certify that it is meeting the limitations of the subcontracting clause of this contract. The North American Industrial Classification Code for this contract is the General Construction NAICs of 236220. FAR 52.219-14 (Deviation 2021-O0008) requires the Small Business Contractor to perform 15% of the work not including materials.
The Contractor shall notify the Contracting Officer and receive approval from the SBA to subcontract with each Task Order. The required forms are provided as Attachments J and K as listed in Section 00 50 00, Contracting Forms/Attachments, for both Task Order pre-award notification and for required post-award contract reporting. The completed pre-award form is to be provided with the Contractor’s Task Order proposal and will be submitted to the SBA for approval prior to Task Order award. The post award report is due every six (6) months during the life of the contract and shall include all awarded actions under the contract. The full requirements for compliance of Limitations on Subcontracting is found in DFARS 252.219-7009 and FAR 52.219-4.
The Contractor shall be responsible for the management and performance of all subcontracts. The Contractor shall ensure subcontractors are competent and capable of handling all assigned work and shall review subcontractor proposals for reasonableness prior to submission to the Contracting Officer. The Contractor shall ensure Task Orders are completed within the stated requirements
And replace with:
