About this file

This is a 2025 Annual Land Use Control Inspection Checklist for Nomans Land Island in Chilmark, Massachusetts, prepared by Tetra Tech for the Naval Facilities Engineering Systems Command (NAVFAC) Mid-Atlantic under Contract N6247016D9008, Task Order WE17. The document certifies compliance with land use controls established in the Record of Decision (ROD) for the site, with a period of performance from October 2024 to October 2025.

The inspection confirms that certified yearly inspection and maintenance records are on file, including field observation reports, UXO observations documentation, safety briefing training certifications, and other maintenance records from June 17, 2025. The site restrictions for land and water remain in place per the Land Use Control Implementation Plan (LUCIP). No activities inconsistent with land use controls, corrective actions, or proposed land use changes were identified during the inspection period. However, significant maintenance issues were documented regarding UXO warning signage, with signs 1, 3, 4, and 5 reported as missing, signs 6, 7, and 9 not inspected, sign 10 intact but only 1 meter from eroding cliff edge, and signs 12 and 13 intact but with obscured fronts. No potential MEC was observed, and no trespassing events were recorded in the past year. The most recent limited MEC surface clearance was completed in 2022, with the next post-ROD five-year review scheduled for 2027. The U.S. Fish and Wildlife Service (USFWS) does not have plans to transfer the property within the next six months.

Brian Willard (USFWS)

McKenzie Hartman (USFWS)

Mike Jones (Mass Wildlife, Natural Heritage and Endangered Species Program)

Michela Coury (Mass Wildlife, Natural Heritage and Endangered Species Program)

Laura Ludwig (Center for Coastal Studies)

Summary:

We departed from Waquoit Bay at 8am on the USFWS Landing Craft and arrived at Nomans

Land Island NWR around 930am. We departed the island around 330pm and returned to Waquoit

Bay around 530pm (after a detour to fuel the Landing Craft).

Grace Bottitta-Williamson and Laura Ludwig walked the perimeter of the island to collect observations of marine debris. No UXO / MEC were definitively identified. Marine debris was abundant and varied, and many photos were taken to document the extent of the debris.

Stephanie Koch walked the interior east and west loops of the island to record erosion, check on integrity of signs and wetlands, record invasive species, and record evidence of nesting birds and

New England cottontail. She also walked portions of the northern shoreline to record nesting birds. Photos and notes about sign integrity are listed below. A few signs were not inspected because they could not be seen from the upland loops. Evidence of New England cottontail was found in several places. Double-crested cormorants were nesting in big numbers in several places

(but complete surveys were not done). No terns or piping plovers were seen on this trip. At least

1 pair of American oystercatchers (likely 2) were on the north side of the island’s shoreline.

Mike Jones, Trina Wantman, Michela Coury, and Regina Peters tracked and captured spotted turtles. Seven radios which had been deployed in 2024 were retrieved and 16 additional spotted turtles were encountered.

Joe Geyster, Brian Willard, and McKenzie Hartman were boat operators and remained with the boat for the duration of the trip.
