288 Amendment
Please provide the most recent Price Proposal Form as noted in Amendment 0008 PPI responses.
Please see Amendment 0011.
289 Solicitation Factor 2 of the Solicitation states, "The schedule shall be based on a contract award date of 31 August 2022." Per Amendment 0001 Phase 1 days to completion is 554 calendar days. 554 calendar days from 31 August 2022 is 06 March 2024 which is when the Contractor needs to be fully demobilized from the project. Amendment 0008 Section 01 14 00.00 22 Work Restrictions revised the Caisson return date to 17 July 2024. Once the Caisson returns the Contractor is required to dewater the dock, remove the temporary suction plugs and then operate the Main Dewatering Pumps for testing. This leaves a gap of approximately 200 calendar days to complete this work from the Phase 1 completion date of 06 March 2024.
We cannot submit a proposal schedule that does not meet the specification requirements, therefore please consider the following:
1. Change the solicitation contract award date to coincide with the new Caisson return date and required subsequent work. Suggested 31 March 2023.
2. Hold the solicitation contract award date but add an additional 200 calendar days to Phase 1 and total contract days in order to hold the same No Work duration between phases.
3. Change the Caisson return date back to January 2024 as stated in Amendment 0006.
Once the project solicitation is awarded, the Contractor will have 1,447 calendar days, including 15 days for bond approval in which to complete the contract requirements.
Work restrictions affecting the contract schedule are listed in the project specifications.
290 Amendment
Amendment 0008 PPI response states, "Government to furnish fuel. Refer to Specification 33 05 55 - 2.1.1." Amendment 0008 Revised Specification Section 33 08 55 deletes paragraph 2.1.1 and replaces it with "The Government will not furnish any materials."
We need to ask again, who is responsible for filling of the fuel tanks for the generators after testing?
The response to PPI 154 is revised to the contractor shall fill all fuel tanks after generator testing. The Government will not furnish any fuel.
291 Amendment

299 Solicitation Factor 2 of the Solicitation states, "The schedule shall be based on a contract award date of 31 August 2022." Per Amendment 0001 Phase 1 days to completion is 554 calendar days. 554 calendar days from 31 August 2022 is 06 March 2024 which is when the Contractor needs to be fully demobilized from the project for the arrival of an aircraft carrier. Amendment 0008 Section 01 14
00.00 22 Work Restrictions revised the Caisson return date to 17 July 2024. Once the Caisson returns the Contractor is required to dewater the dock, remove the temporary suction plugs and then operate the Main Dewatering Pumps for testing. This leaves a gap of approximately 200 calendar days to complete this work from the Phase 1 completion date of 06 March 2024.
Please clarify what work can be completed between Phase 1 and Phase 2.
Once the project solicitation is awarded, the Contractor will have 1,447 calendar days, including 15 days for bond approval in which to complete the contract requirements.

300 Solicitation Due to long lead times associated to the Phase 1 Generators and Drainage Pumps we respectfully request an additional 100 calendar days to complete Phase 1.
See response to PPI number 299.
301 Solicitation In Addendum #8 and #9 1.4.d (3) has been changed and the original language stating "…of the dry dock during the last months of Phase 1 construction in preparation for an aircraft carrier docking in May 2024." has been deleted and replaced. Will an aircraft carrier still be docking after Phase 1? Please clarify.
There will not be a docking of an aircraft carrier after Phase 1. Once the project solicitation is awarded, the Contractor will have 1,447 calendar days, including 15 days for bond approval in which to complete the contract requirements. Work restrictions affecting the contract schedule are listed in the project specifications.
302 Drawings In Addendum #9 it states: Phase 1 Drawings (1) NAVFAC Dwg. No. 12857519 (1-GC101) "Work identified no longer precluded from phase 1 due to consolidation of project schedule" Please clarify how the project schedule has been consolidated as there has been no change to the Phase 1 calendar days, Phase 2 calendar days or the total contract duration calendar days.
See response to PPI number 299.
303 Amendment
It appears in Amendment 10, that there is now no interim Carrier Docking in the project. There is only a docking thru November of 2022. It appears that the project restrictions are generally working in coordination with other Contractors in the area.
With that in mind, are the Phase 1 and 2 durations and LD's applicable? Please confirm the overall duration of 1698 CD and why Phase 1 duration of 552 CD and Phase 2 duration of 692 CD do not combine to equal the 1698 CD if there is no interim Carrier Docking. Amendment 8 seems to indicate there would be a Carrier Docking on page 12 of 14 in the Questions and Answers.
304 Amendment
02 6113 Amendment 9 indicates the Contractor is responsible for testing and offsite Treating of potentially contaminated water. There are existing unit price items for all contamined material except this groundwater. Contractors have no ability to determine what quantity of potentially contamined groundwater will be required to be treated offsite and disposed. We strongly request a unit price be provided to ensure proposals are fairly evaluated and that NAVFAC will pay for only the amount of groundwater that is treated. Please reconsider your position on this item of work as there can be significant costs in this treating.
It is the expectation that collected groundwater will test below action levels and will be discharged onsite.
Do not include offsite treatment of contaminated groundwater in the bid pricing. If contaminated groundwater is encountered during construction activities and must be treated offsite in accordance with the project documents, then pricing will be negotiated at that time. The specifications include provisions for liquids that exceed action levels in order to provide direction in the event that contaminated liquids are encountered.

Please reference Specification Sections 23 13
26.00 25 and 26 11 13.00 20. The paint requirements of these two specification sections limit the number of Switchgear / Substation
None of the major manufacturers offer substations in painted stainless steel. The Tyle 304 enclosure is specified to be painted. These unit manufacturers that can be utilized to provide equipment for this project. These same specification sections, our interpretation of addendum 8, and the UFC’s referenced, require that we provide shake table testing certifications for the Switchgear and Substations, and/or the parts that are utilized to build these pieces of equipment. None of the Switchgear / Substation manufacturers that can comply with the paint specification can provide these certifications or tests. To date no one can providing a responsible and complete Switchgear / Substation package that complies with these specifications. Can you please provide a basis of design, or advise us on how to mitigate this issue?
substations go through the third-party vendors (Myers, Kinney, SPS) for the stainless steel enclosure fabrication and assembly. While the original componentswithin the enclosure may be tested and certified for seismic requirements by their manufacturers, the final assembly which includes the enclosure and bracing may not be certifiable for seismic requirement as of this time yet. This is a new requirement the market has not had time to respond to.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
