EVALUATION FACTORS FOR AWARD

The Proposed Task Order will be awarded to the responsible offeror offering the best value to the Government. To make a determination of Best Value, the Government shall evaluate each offeror on the following criteria:

Non-Cost/Price Evaluation Factors

Factor 1 – Technical Solution Factor 2 – Energy Design Reduction Factor 3 – Past Performance

Price

Factor 1 – Technical Solution

(a) Solicitation Submittal Requirements:

Provide a narrative describing the technical approach to the project that meets the requirements of the RFP. Include the following:

- Interior circulation/adjacencies. Describe how pedestrian access to, and vehicular traffic through, the various areas of the facility are coordinated. Highlight items that illustrate an understanding of the workflow through the overall facility, as well as individual segments of the facility supporting different functional requirements.

- Exterior façade describing how the proposed construction integrates with the surrounding area and existing base facilities design or architectural theme. In addition, describe how the proposed construction will meet Anti-Terrorism/Force Protection and Explosive Arc requirements as outlined in the RFP.

- Site layout including a description of the building orientation, roadways, parking (include ingress and egress), walkways, emergency vehicle access, ATFP standoff distances, and drainage /low impact development (LID). Describe vehicular circulation around the facility, in particular the large, articulated equipment trailers that must navigate the exterior, as well as enter and exit from the facility. Make note how a Marine Lift, as described in the RFP, will be able to move unimpeded from the facility, through the perimeter fencing, to the existing boat dock adjacent to the site.

- Weight Handling Equipment. Describe the type of cranes to be used and their capacities to accomplish the various lifts required as part of this RFP.

- Pool Equipment. Provide a detailed description of the pool system and the various functions it must be able to support, such as fresh/salt water systems, heating and cooling of the pool water to the temperatures outlined in the RFP, sanitation of the pool water, and extraction of particulates and lubricants from submerged equipment.

- Structural Foundations. Provide a description of the foundation systems for the pool, as well as the vehicular circulation aisles. Make note of the pool foundation’s need to support both a full and empty pool, and the resulting change of stresses that need to be supported without failure.

Also make note of the high, rolling stresses imposed by the fully loaded equipment mover through the facility’s drive aisle, as well as the need to fill equipment with water while stationary in the bays of the facility, increasing and decreasing the loads in a cyclical fashion.

- Lighting. Provide a description of how the requirement to generate blackout conditions in the pool area are to be accomplished, while maintaining occupant safety.

Narrative shall not exceed six (6) double-sided pages (or twelve (12) single-sided pages). Up to three (3) conceptual drawings shall be provided to supplement the narrative (i.e., floor plan, exterior elevation, and site plan).

(b) Basis of Evaluation:

The Government will evaluate the narrative and conceptual drawings considering the extent to which the Offeror demonstrates a clear understanding of the architectural and engineering requirements of the project. The Government will evaluate the Offeror’s technical solution to determine adherence to or enhancement of the technical requirements of the RFP.

Factor 2 – Energy Design Reduction

(a) Solicitation Submittal Requirements:

(1) Energy Efficiency Narrative:

The overall facility requires Guiding Principles Validation only. It is to be designed using best practices and maximum energy use reduction/savings where possible, in accordance with UFC 1-200-02 High Performance and Sustainable Requirements.

The facility’s systems must meet the Guiding Principles for Sustainable Federal Facilities. Individual systems, such as HVAC systems, must be commissioned to prove compliance with the design intent.

Provide a detailed narrative describing how the proposed solution will meet at least a 30% energy reduction below the ASHRAE 90.1-2013 baseline. Also describe how the solution will provide baseline ASHRAE 90.1, based on life cycle cost effectiveness.

Organize narrative in four parts: 1) Orientation, Configuration, and Shape; 2) Envelope properties (fenestration, solar heat gain coefficients (SHGC), wall and roof insulation values (U-values), window U-values); 3) Mechanical (HVAC, plumbing, and domestic hot water heating systems, including any solar hot water systems); and 4) Electrical Systems (lighting and control systems, including any interior and exterior lighting systems, renewable energy and control systems).

Where 30% reduction is not lifecycle cost effective, provide highest percent energy reduction that is lifecycle cost effective.

Note: Building performance rating and percent energy reduction are calculated in terms of energy rather than energy cost.

Do not exceed two (2) double-sided pages (or four (4) single-sided pages).

(b) Whole Building Energy Simulation:

The Whole Building Energy Solution requires the use of the following documents included in Part 6 of this RFP:

- Government Baseline Building Performance Rating

- Government Baseline Building Energy Model (input-output) schedules (If the process and receptacle loads are not given in the schedules, assume they are 25% of the total load.)

- Default simulation factors

- Utility Costs (energy rates) for project, based on local unburdened PWD rates

- “Whole Building Energy Simulation” templates

- “Performance Rating Method Compliance Reports”

Use the “Whole Building Energy Simulation” templates to demonstrate the percentage improvement over the “Proposed Building Performance Rating”. Receptacle and process loads are included in the “Whole Building Energy Simulation” as part of the building loads. Submit the Whole Building Energy Simulation in PDF electronic file format.

(c) Basis of Government Evaluation:

1) Energy Efficiency Narrative and Solution: The Government will evaluate the Offeror’s proposed energy efficiency narrative and solution.

2) Whole Building Energy Simulation: The Government will evaluate the Whole Building Energy Simulation to determine the validity of the design assumptions, thoroughness and accuracy of the Whole Building Energy Simulation, and the percent improvement of energy consumption reduction below the Government’s “Baseline Building Performance Rating”.

Factor 3 – Past Performance:

(a) Solicitation Submittal Requirements:

Offerors do not need to provide any information under this factor as the Government will base the evaluation on known past performance on task orders awarded under this Multiple Award Contract (MAC). However, Offerors may provide any information on problems encountered and the corrective actions taken on task orders under this MAC. Offerors may also address any adverse past performance issues under this MAC. Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

(b) Basis of Evaluation:

This evaluation focuses on how well the Offeror performed on projects under this Multiple Award Contract. More emphasis will be placed on task orders that are more similar to the RFP. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the Offeror’s ability to successfully meet the requirements of the RFP.

Offerors lacking past performance information on other task orders under this Multiple Award Contract will not be evaluated favorably or unfavorably in past performance and will receive an Unknown Confidence rating.

Price

(a) Solicitation Submittal Requirements – Offeror shall submit the following:

Cover page that includes:

- Solicitation Number

- Solicitation Title

- Prime Contractor Name

- Prime Contractor Address

- Phone Number

- DUNS

- Cage Code

- Point of Contact Name

- Point of Contact Phone Number

- Point of Contact Email

Price Proposal Form (Attachment D) Amendments Acknowledged (if applicable) Bid Guarantee

(b) Basis of Evaluation – The Government will evaluate price based on the total price proposal including the base price, all options, and all planned modifications. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

a. Comparison of proposed prices received in response to the RFP.

b. Comparison of proposed prices with the Independent Government Cost

Estimate (IGCE).

VI. EVALUATION

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable proposal

2. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.”

3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.

4. The relative order of importance of the non-price evaluation factors is that technical factors (Factors 1 and 2) are equal to each other and, when combined, are of equal importance to the performance confidence assessment (Factor 3). All technical factors and the performance confidence assessment (past performance) rating, when combined, are approximately equal to price.

5. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal.

The evaluation report must document the evaluation board’s assessment of the identified weakness(s) and the associated risk to successful contract performance resulting from the weakness(s). This assessment must provide the rationale for proceeding to award without discussions.

1.2 GENERAL BID NOTES

a. a. Award will be made on the total sum of Contract Line Items (CLINs) 0001AA and 0001AB. For CLIN 0001AB, enter unit price and extend total in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

b. The Government reserves the unilateral right to award CLIN 0002, CLIN

0003 and CLIN 0004 to the Contractor at the proposed price at award or within 120 calendar days after the contract award. Firm fixed price is required for CLIN 0002, 0003 and 0004. CLIN 0001AB will be awarded at the unit prices indicated if these conditions are encountered during construction. No provision is made for economic price adjustment. If Option is exercised within 120 calendar days after the contract award, the contract completion date remains unchanged.

c. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206(b) Evaluation, not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the Option(s) and planned modifications to the total price for CLIN 0001. In accordance with FAR 52.217-5 Evaluation of Options, evaluation of Options will not obligate the Government to exercise the Option(s).

d. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the Base Price, Unit Prices, and Options.

An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

e. Bonding is required for all CLIN 0001 items. If CLIN 0002, 0003 or 0004 is awarded, adjustment to bonding and consent of surety is required.

Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.

1.2.1 PLANNED MODIFICATION BID NOTES

These notes apply to Planned Modification CLINs.

a. The estimated amounts for FF&E, A/V, and ESS have been supplied by the

Government, to provide offerors with the projected magnitude of effort.

The estimated amount includes the actual cost of the FF&E, A/V, and ESS including freight and installation charges. The Government FF&E, A/V, and ESS estimates are only estimated amounts.

b. If awarded, line items will be funded separately after completion of

FF&E, A/V, and ESS design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in RFP Sections, E20 FURNISHINGS, E10 EQUIPMENT, and D503005

SECURITY SYSTEMS.

c. Bonding is not required for the design, procurement and installation of

FF&E, A/V, and ESS equipment.

d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E, A/V, and ESS not to exceed 5 percent. The Contractor will only be evaluated on the HAR rate applied to the Government Estimate. The actual total cost of the awarded planned modification will be the total of the accepted Final design packages for FF&E, A/V, and ESS plus their respective HAR rates included in the CLIN schedule. This fee shall account for administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E, A/V, and ESS. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E, A/V, and ESS. The proposed HAR is a fixed rate.

e. The Government is not obligated to award Planned Modification line items. Should the Government choose to award a Planned Modification, the line item will be awarded as a negotiated modification to the contract. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E, A/V, and ESS.

f. If awarded, the FF&E, A/V, and ESS modifications will be awarded at least six months prior to the contract completion date. The Contractor's schedule must assume the award of the FF&E, A/V, and ESS as modifications. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award a Modification less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that accepted Final FF&E, A/V, and ESS packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E, A/V, and ESS are not available due to cause outside the Contractor's control or the Government's award of the modification is in the period less than the last six months of the contract.

1.3.1 Planned Modification-specific Bid Notes

a. FF&E: Design of the FF&E is performed under CLIN 0005. Upon Government approval of the preliminary design and best value analysis, a Best Value Determination (BVD) will be made and will be the rationale for selecting the FF&E vendor(s) for the project. Accordingly, the price(s) provided by the selected vendor(s), using predominately negotiated price schedules from BPA, GSA or other Federal contracts, will be the basis for the actual cost of the Final FF&E Package.

Submit the Final FF&E package, including pricing and vendor selection, not later than nine months prior to building completion.

b. A/V: Design of the A/V is performed under CLIN 0006. Infrastructure for A/V is performed under Base Bid included in CLIN 0001AA.

Infrastructure for A/V includes, but is not limited to: conduits, wireways, junction boxes, pull stations, conduit and wireway supports, and pull string in conduits and wireways for A/V equipment wiring.

c. ESS: Design of the Physical Security Equipment (PSE), which includes the ESS is performed under CLIN 0007. Infrastructure for ESS is performed under Base Bid included in CLIN 0001AA.

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January

1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year

2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the

Davis-Bacon Related Acts, including those set forth at 29 CFR

5.1(a)(2)-(60). Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the

Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses

(29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate

(weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or

""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010

08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour

Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the

Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the

Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations

Wage and Hour Division

U.S. Department of Labor

200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator

(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator

U.S. Department of Labor

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative

Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board

U.S. Department of Labor

4.) All decisions by the Administrative Review Board are final.
