About this file
This notice provides information on a proposed design-build contract for Hurricane Florence recovery facilities at Marine Corps Air Station Cherry Point in North Carolina. The contract would consolidate five military construction projects into a single award with an anticipated completion time of 1,826 calendar days and total value between $100-250 million. The projects include construction of a provost marshal office, motor transportation/communication shop, two fire stations, a range operations center, and academic facility/auditorium. A two-phase solicitation process will be utilized, evaluating technical approach, experience, past performance, safety, technical solutions, project management, and small business participation. Phase one responses are due in October 2019, with phase two amendments and price proposals expected to be issued in February 2020. The award is scheduled for July 2020, and the solicitation is open to all competitors.

Proposal copies from eight to nine and font size from 12pt to 10pt
- Factor 1 – Technical Approach, (i) Solicitation Submittal Requirements: (3) Adds language for Bonding
Capacity Requirements
- Factor 3 Past Performance, Changes language regarding PPQ submittals to read: Offerors are permitted to submit copies of previously completed PPQs. However, Offerors shall not incorporate previously submitted PPQs submitted for other RFPs by reference into their proposal; but this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
- Factor 5 Project Management Approach, Basis of Evaluation, (4) Schedule, Revises language from “within 1,826 days” to read “A schedule that phases individual building completion dates within the package so the Government can take beneficial occupancy earlier than the 1,826 days overall completion date may be considered more favorably.

Experience:
Additional requirements for relevant projects indicate “At least one project meeting the
Size/Scope/Complexity requirements shall have a final construction cost of $125,000,000 or greater. This project may include a single facility or multiple facilities, as long as one of the facilities in the project meets the Size/Scope/Complexity requirements” Procurement agencies must state requirements in a manner that will allow for the broadest field of competition within the minimum needs required.
When requirements are stated in a manner that exceeds the procuring agency’s actual needs, competition is considered to be restricted. Because none of the Projects listed within the RFP approach anywhere near $125 million and an awardee will have five (5) years to perform all backlog within the package while not having to perform all projects concurrently, this requirement has no rational basis and appears to be unduly restrictive of full and open competition
(unnecessarily excluding many strong and capable regional contractors). While it is understood that the government has stated this requirement in furtherance of a need to procure services from a contractor that has financial strength and ability to successfully perform a large amount of backlog, there are alternative evaluative factors that would be rationally based and relevant to the subject procurement and would not run afoul of full and open competition. For example, the agency could instead require bidders to do one or both of the following: 1) demonstrate a minimum aggregate bonding capacity of $225 million (the high end of the government’s DB Budget for the package), and/or 2) demonstrate having performed at least a total of $225 million in federal government construction contracts over the last five (5) years.
To avoid an unreasonable restriction on competition, we recommend that NAVFAC lower the single project size requirement from the stated $125mil to something at or about $30 million (which would be closer to the value of the largest project within the package), and in lieu of the $125 million requirement, add the more rationally based requirements provided in the examples above.
The requirement to demonstrate experience on one project with a final construction cost of $125,000,000.00 remains. This solicitation will result in a single contract award to one offeror where the total value of the contract is anticipate to exceed $125,000,000.00.
See Amendment 0002.
Solicitation Instruction -
Factor 2
During the industry day it was mentioned that under normal circumstances these buildings would be solicited individually. However, due to time and available contracting resources five buildings have been bundled into one single solicitation. Given that it is uncommon for this many non-adjacent structures to be solicited together, it is unreasonable that the government would expect contractors to have similar previous performance of this magnitude ($125M). A magnitude of $100M would be reasonable given the stated range of each building($25M-100M) or the government should allow contractors to demonstrate relevant magnitude by showing that they completed several large projects in parallel. We kindly request that the government remove the unreasonable requirement which needlessly reduces competition and replaces it with a lower ($100M) threshold or allow projects completed concurrently above $50M each to counted towards the ($125M) requirement.
The requirement to demonstrate experience on one project with a final construction cost of $125,000,000.00 remains. This solicitation will result in a single contract award to one offeror where the total value of the contract is anticipate to exceed $125,000,000.00.

N/A Please provide a definition of “Design to Budget”.
Please clarify if the intent is (A) Fixed price specified by the Government where the Offeror will fill out the bid form with 100% of the Design to Budget for each
MILCON or (B) the Design to Budget is a Not To Exceed amount for each MILCON and the expectation is the Offeror is to evaluate the scope of each MILCON and provide a firm fixed price equal to or less than the
Design to Budget for each MILCON.
Please Note: If Option B is selected, a minimum 90-day response time will be required for Phase II and a hefty stipend provided for Phase II respondents.
For this solicitiaton, NAVFAC is using the term "Design to
Budget" to mean the amount of funds that are available for construction of the specific project. The expectation for the Price Proposal in Phase II is that the offeror will evaluate the scope and provide a separate price for each of the projects within the package as a firm fixed price. Also, the Design to Budget is not a Not To Exceed amount but rather is provided for information on the Government's expectations of the scope concerning both cost and quality.
N/A N/ A
N/A Please provide the “Design To Budgets” in phase 1 for each MILCON with basic parameters so Teams can make a determination if budgets are adequate before expending efforts for Phase 1.
Design to Budgets will be provided in Phase 2. RFP
Packages will not be developed with sufficient fidelity to provide
Design to Budgets during the Phase 1 solicitation period.
N/A N/ A
N/A Please explain what information will be provided in Phase II as part of the AE1 RFP Packages. Will bridging design level information be provided with programmatic drawings or will only narratives be provided?
The Government's intent is to provide in the Phase II RFP
Package, at a minimum, adjacencies, room requirements, minimal site information, and narratives.
A
N/A Will individual contracts be awarded for each
MILCON?
In accordance with The RFP, Section 00 21 16, INSTRUCTIONS TO
OFFERORS, 1.2 GENERAL
OVERVIEW OF THE
CONTRACT: "The general intent of this solicitation is to award a Fixed Price
Construction Contract for design-build (DB) projects in Hurricane Florence Recovery
Package 1 at Marine Corps Air Station (MCAS) Cherry
Point,North Carolina (NC)."
The intent is to award one contract that includes all
Projects.
N/A N/
A N/A Please clarify if a Stipend will be provided to Phase II responsive firms. If so, please provide the amount.
At this time, stipends will not be provided.
N/A N/
A N/A Please provide the anticipated Phase II RFP response period.
Phase II will be issued via amendment. As included in the Hurricane Florence Industry Day
Brief, Phase 2 is anticipated to be issued February 2020 and responses are anticipated to be due in April 2020. The government intends to allow approximately 60 days for the
Phase II Non-Price Proposal and to allow approximatley 20 additional days for the Phase II Price Proposal.
Amendment 1 revised the proposal submission requirements to require hand delivery of proposals. The amendment also states “If the proposal due date is extended, it is the contractor’s responsibility to work with the Government to revise the date on the pass request”. Please clarify what is required of the contractors to “work with the government”.
Please refer to RFP Section 00 21 16, Instructions to Proposers,
4. Proposal Requirements, 4.2
Proposal Submission Instructions
"All proposals shall be mailed or hand carried to the following address:
Naval Facilities Engineering
Command, Mid-Atlantic 9324 Virginia Avenue
Building Z-140, Room 216 Norfolk, Virginia 23511
Attn: Holly Snow, ACQ4"
If the proposal due date is changed, it will be the responsibility of the contractor to email the government only if you wish to change the personnel submitted for base access. In that case, the contractor would submit the
5512 and ODPR for the person needing access.
N/A N/ A
N/A On a typical Phase II Design Build project, the Government allows 45 to 60 days to prepare the technical and pricing proposal. Given that this project includes multiple facilities, we would anticipate the bid duration to be much longer in order to allow offerors to sufficiently develop a plan and associate pricing for each facility within the project. At a minimum we would anticpate 90 days for preparation. Please advise the anticipated duration for the Phase II portion of the project.
Phase II will be issued via amendment. As included in the
Hurricane Florence Industry Day Brief, Phase 2 is anticipated to be issued February 2020 and responses are anticipated to be due in April 2020. The government intends to allow approximately 60 days for the
Phase II Non-Price Proposal and to allow approximatley 20 additional days for the Phase II Price Proposal.
N/A N/ A
N/A Will there be bridging drawings and specifications for each facility under this project issued by the Government with the phase II documents?
The Government's intent is to provide in the Phase II RFP
Package, at a minimum, adjacencies, room requirements, minimal site information, and narratives.
N/A N/ A
N/A For the Phase II pricing documents what is the anticipated level of bridging documents for each facility?
The Government's intent is to provide in the Phase II RFP
Package, at a minimum, adjacencies, room requirements, minimal site information, and narratives.
N/A If bridging documents are not being issued, how complete are the program documents?
A. Will the program documents include adjacency and/or blocking and stacking diagrams?

The Phase 2 RFP will include as-builts if available, geotechnical information, as well as some existing site information. The Phase 2 RFP will also include adjacency diagrams and room requirements for each building.
N/A N/ A
N/A Will a stipend be available for unsuccessful offerors in Phase II?
At this time, stipends will not be provided.
N/A N/ A
N/A Will the government allow meetings with the offeror(s) and government contracting officials and end users of the facilities during the Phase II bid period to assure that any design solutions being developed are acceptable?
The Government does not intend to allow meetings with Offerors during Phase II. However, the
Government anticipates providing a draft of the Phase II
RFP for comments prior to release of the Amendment.
17 Fac tor
Tec h
Sol utio n
A Based on the Phase I RFP, the Phase II submission will only allow for six (6) drawings for only one (1) of the facilities. In order to develop firm fixed prices for all of the facilities under this project, the design build team will have to advance design for all of the facilities, which will include significantly more than six (6) drawings. Will NAVFAC consider accepting all of the Phase II design development documents the offeror develops as part of the price proposal and ultimately the contract?
While the Government understands that the design build team may need to develop drawings in addition to those required by the solicitation, only those drawings required by Factor 4 will be reviewed.
Drawings submitted in addition to the six (6) allowed in Factor 4 will not be considered.
N/A N/
A N/A If additional drawings are not acceptable, will
NAVFAC allow the offerors to include pricing clarifications, assumptions and qualifications with the price proposal?
In accordance with Factor 4, narratives are required for each project. The Government cautions Offerors that price qualifications may disqualify an Offeror or make proposals deficient. Please submit your proposal in accordance with the
RFP.
17 Fac tor
Tec h
Sol utio n
A Based on the Phase I RFP, the Phase II submission will only allow for two (2) pages of narratives for each of the facilities under the project. This is not enough space for the offeror to adequately describe the design solution for the facilities as we have to define systems and parameters to adequately develop a firm fixed price for all of the facilities. Will NAVFAC consider allowing at least ten (10) pages of narratives for EACH facility under the project?
At this time, page limitations for Phase II proposals remains but may be reconsidered when the request for Phase II proposal is issued via Amendment.
N/A If additional narratives are not acceptable, will NAVFAC allow the offerors to include pricing clarifications, assumptions and qualifications with the price proposal?
In accordance with Factor 4, narratives are required for each project. The Government cautions Offerors that price qualifications may disqualify an Offeror or make proposals deficient. Please submit your proposal in accordance with the
RFP.
Fac tor
1. Factor 3 Past Performance. The solicitation states, ‘Experience. The Offeror should provide completed
Past Performance Questionnaires (PPQ) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.” Often, personnel associated with projects are assigned to other facilities and/or retire and are not available to provide PPQs. May the offeror submit copies of previously submitted PPQs as long as the information contained therein provides the same level of detail in the PPQ form included in the RFP?
