About this file

This document is an amendment to a solicitation for the repair of seawalls at the United States Naval Academy in Annapolis, Maryland. The amendment provides responses to contractor questions to clarify the scope of work. The repairs include rebuilding failing bulkhead sections along Farragut Field and the east side of Santee Basin, utilizing a new sheet pile wall constructed outboard of the existing. For Santee Basin, the existing tieback system will be used, while Farragut Field will involve a new inland tieback system. The amendment clarifies that the work may be conducted concurrently across phases and that landscaping restoration is expected to match existing conditions.

AMENDMENT 0005

The purpose of this amendment is to provide the following:

1. RFI Responses

All other terms and conditions remain unchanged.

1. RFI RESPONSES

70. If Phase 1A, 1B, and 1C, as shown on drawing C-100, are all awarded, can all three phases be under construction at the same time? The area of construction and temporary fencing limits shown on drawing G-110 appear to show that all three phases can be under construction at the same time, but we cannot find any contract language that verifies this.

GOVERNMENT RESPONSE: Yes, provided the contractor demonstrates a plan to safely execute the work, and adequately achieve the quality specified in the contract. The entire area will be secured and become the construction site to provide this possibility, and to adapt and control operational impacts of the work on continuing Government operations.

71. Can the specification sections be provided for the landscaping work shown on drawing L- 110? (Plantings, sod, mulch, planting media, topsoil, etc).

GOVERNMENT RESPONSE: The information necessary is on sheet L-110. The contractor will restore the area to pre-work or better condition using identical plants as existing, or native plants as shown on the planting schedule. Sod will be in accordance with the response to RFI 43. The response to RFI 43 also outlines the establishment of the plantings and is equally applicable to all work on sheet L-110 as it is to the temporary road.

This is a memorial park area on a national historic landmark installation honoring the efforts and heroism of hundreds of Naval personnel, some of whom lost their lives in that effort over a century of service. Work performed, and finished product, is expected to be commensurate with that level of prestige and expectation.

72. What are SHEET KEYNOTES #15, 16, & 17 referring to on drawing C-113?

GOVERNMENT RESPONSE: They refer to the offset sheet keynote table immediately to the left of the key plan.

73. Is the 10' temporary roadway shown on drawing C-124 (SHEET KEYNOTE #6) supposed to be the temporary 24' wide roadway with 10' wide sidewalk as shown on drawing G-120?

GOVERNMENT RESPONSE: Disregard dimensioning and information regarding temporary roadway on C-124 in all instances where it is in conflict with G-120. G-120 governs.

74. Is there a specification relating to the submarine cable restoration that can be provided to bidders?

GOVERNMENT RESPONSE: No, as this work is unique in nature. Details and information that are available are provided in the drawings and specifications. Plan to execute all work with the utmost care and professionalism in all ways and at all times.

75. In reference to GENERAL SHEET NOTES #6, #7, and #8; if inspection and/or testing of the submarine cable identifies existing damage, will repair of the damage be treated as extra work?

GOVERNMENT RESPONSE: RFI fails to identify which sheet this question is from, and is answered assuming it refers to sheet ED-112. Bidders are required to read the contract in its entirety. On sheet ED-112 all fifteen sheet notes (along with other parts of the contract) define the requirements and procedures for handling the submarine cable work.

You are required to fully test and identify problems or damage in the cable in pre-work inspection and prior to any work on relocation of the cable. Issues discovered at that time will be addressed as appropriate by the Contracting Officer. If the contractor damages the cable in the process of the work and these issues are discovered in the post-relocation phases of testing the Government will review the situation and make the appropriate determination. If the contractor means, methods, or conduct of the work results in damage to the cable it is entirely likely the contractor will be required to repair at their own cost.

Such circumstances are speculative at this point and will be decided if they occur by the Contracting Officer as necessary. Plan to execute all work with the utmost care and professionalism in all ways and at all times.

76. In reference to GENERAL SHEET NOTES #12; if inspection and/or testing of the submarine cable identifies damage after relocation/restoration, will repair of the damage be treated as extra work?

77. Is the existing submarine cable buried below mudline or laying on top of the channel bottom as shown in the detail A1 - "SECTION - GROUT BAGS FOR SUBMARINE CABLE"?

GOVERNMENT RESPONSE: Both conditions exist, and in some cases at the same location dependent on weather conditions and time of year.

78. In reference to GENERAL SHEET NOTES #9; is the intended scope of work defined by the wording "RESTORE SUBMARINE CABLE" limited to relocating the cable the 10' minimum distance from the outboard face of the existing seawall sheet piles and adding 8 each 80 pound grout bags as shown on Sheet ED112, or is additional work included in the restoration scope?

GOVERNMENT RESPONSE: Required work for the submarine cable is as shown in the drawings and the primary purposed of this work is to move it far enough away to allow safe execution of the seawall reconstruction. Aside from minor positional adjustment of the cable no other work with the submarine cable is intended.

79. If dredging is to be performed under this contract, how will the existing submarine cables be handled during dredging?

GOVERNMENT RESPONSE: There is no dredging in this project.

80. Page 5 of the Price Schedule form attachment includes Note 5 which states: "The Government reserves the unilateral right to award CLINs 0002, 0003, 0004, 0005, 0006, 0007, and/or 0008 to the Contractor at the proposed price within 365 calendar days after the contract award. Should the Government choose to exercise any of the options after award, the contract duration will remain the same.". 365 days is an unreasonable long time to award options after initial award. Can this duration be reduced to match the 90 day time limit that the offeror's price is valid for in Note 7? If award of options is made between the 90 day price validity date and 365 days, will price adjustments be allowed on the additionally awarded work?

GOVERNMENT RESPONSE: The intent is to award as many phases as can be afforded in the initial award or within 90 calendar days after award. However, the Government reserves the right award any unexercised option at the price proposed and incorporated into the contract within 365 calendar days after contract award.

The notes have been removed from the attached Price Schedule.

81. Are there any construction loading restrictions that will be in effect adjacent to the existing seawall during new construction work?

GOVERNMENT RESPONSE: The purpose of the project is to rebuild and upgrade a failing wall system. Given the progressive and ongoing structural issues that will be compounded by the construction operations assessing this safe methods is a decision dependent on means, methods and equipment used by the contractor. This is why the project specifically requires an extensive QC, superintendence and safety team that is subject to evaluation.

82. In reference to the Standard Erosion and Sediment Control Notes #26 the total quantity of Cut and Fill are the same. Based on the importation of new proposed typical aggregate base material for pavement and trench backfill there will be a surplus of excavated material to be wasted off the project site, not the zero cubic yards noted. Please advise.

GOVERNMENT RESPONSE: The permit information is accurate for the scope of permitting the project given environmental conditions. There has been substantial loss of material due to localized failures of the wall, additionally there are areas to be built up.

That material is to be generated from onsite material with excess to be sent off site. The new material being brought in is primarily for the reconstruction of paved areas and some instances of other backfill. The exact quantities will vary dependent on contractor means and methods. For purposes of design and permitting it is effectively a zero sum and off site borrow is at a level that is of such a nature as to not require a special consideration of the borrow site.

83. How is the submarine cable relocation as shown on the plans to be accomplished since it appears to show that the cable is somehow elongated into a longer sweep around the corner of the seawall while there does not appear to be any slack available in the cable to elongate it? Is a splice supposed to be added to the cable to increase the length of it?

GOVERNMENT RESPONSE: Based on dive inspections sufficient slack to make the minor adjustment of the cable positioning is available. Splicing is not authorized at this time.

84. The pricing form in the solicitation is different from the Price Schedule form attachment, which are both also different from the pricing breakdown in Specification Section 00 22 13.00 20

- SUPPLEMENTAL INSTRUCTIONS TO OFFERORS. Is the correct form to price, which the basis of award is determined from, the Price Schedule form attachment?

GOVERNMENT RESPONSE: RFP Section 00 22 13.00 20, Supplemental Instructions to Offerors was deleted in its entirety via Amendment 0003. Please use the attached Price Schedule.

85. Are Robert Crown Sailing Center building services contained within ductbank slated for demolition? If so please provide electrical feeder source, size information and duration of building off hours.

GOVERNMENT RESPONSE: See response to RFI 46.

86. Please provide Heat Trace specification.

GOVERNMENT RESPONSE: See response to RFI 47
