AMENDMENT 0002
The purpose of this amendment is to provide the following:
1. Provide RFI Responses
2. Attachments
3. Extend the proposal Due Date
4. Add Clause
5. Revised Wage Determination
All other terms and conditions remain unchanged.
1. RFI RESPONSES
1. Request that the bid date be extended by 4 weeks. The complexities of the Seawall Repairs project will require extensive coordination and planning with multiple specialty subcontractors in order to provide NAVFAC with a complete proposal and the best possible value for the best price. We do not believe that this can be done in the time allotted for preparing a response to the solicitation.
The goals and targets for minority, disadvantaged, and woman owned business participation will require more time to perform adequate good faith efforts to solicit those businesses and provide satisfactory time for them to respond to the request.
Other bids for NAVFAC have been postponed and are now due in same timeframe. These are also complicated projects that require extensive efforts from our preconstruction team.
GOVERNMENT RESPONSE: The Proposal due date has been extended to June 21, 2022 at 2:00 PM. Please follow the Proposal Delivery Instructions for submitting a proposal.
The SB goals and targets are being reviewed and will be updated in a forthcoming amendment.
2. Respectfully requesting a 3 week bid letting date extension and corresponding bid question date extension. The additional time will allow us to review the bid documents in depth and provide the Government with a complete bid proposal and competitive pricing.
GOVERNMENT RESPONSE: The Proposal due date has been extended to June 21, 2022 at 2:00 PM. Please follow the Proposal Delivery Instructions for submitting a proposal.
3. Due to the level of complexity and sequencing of the work we respectfully request a 3 week bid extension from June 10, 2022 to July 1, 2022. The additional time will allow us to provide the most competitive proposal to NAVFAC.
GOVERNMENT RESPONSE: The Proposal due date has been extended to June 21, 2022 at 2:00 PM. Please follow the Proposal Delivery Instructions for submitting a proposal.
4. Referenced Plan Sheets state, "Provide 1" steel plate road. Remove at end of Project, and restore field to original condition with sod." Plan Sheet C-001 Note 17 states, "Temporary steel plate-surfaced roadway crossing.....will be installed by owner." Please clarify who is furnishing and installing the temporary steel plate roadway.
GOVERNMENT RESPONSE: Delete text for note 17, and replace with the following:
Temporary steel plate-surfaced roadway crossing Farragut field and connecting the intersection of Brownson and Santee Roads to Turner Joy Road must be installed by the Contractor per sheets G-110 and G-120. Upon completion of construction activities and when directed by the Contracting Officer, Contractor must remove steel plates and restore to existing site conditions with sod.
5. Please provide additional information on the unidentified utility to be demolished per Keynote 3. We need to know what type of utility and depth in order to correctly price this work.
GOVERNMENT RESPONSE: Utility is unidentified because it is not known what it may be. It is shown on CD-112 with keynote 1, and on CD-113 with keynote 3. Assume it is a concrete encased 6” steel or iron pipe with abandoned in place electrical service/cables at an elevation that will, or very nearly will conflict with the new tie-rods.
6. Can the following language, removed from the solicitation by Amendment #1, be added back into the solicitation? "Each of the projects does not need to meet all three requirements (size, scope, and complexity). However, the combination of projects must demonstrate all requirements of size, scope, and complexity (i.e. at least one of the projects must meet the size requirement, at least one of the projects must meet the scope requirement, and the aggregate of projects must meet the complexity requirements)." We have several projects that meet the requirements separately, but not within single projects.
GOVERNMENT RESPONSE: The technical factor remains unchanged.
7. Can projects that are at least 75% complete by the date of issuance of the RFP be used for Factor 1 - Experience?
GOVERNMENT RESPONSE: Yes. Projects submitted for the Offeror shall be at least 75% complete within the past ten (10) years of the date of issuance of this
RFP.
8. What is the Governments definition of "water frontage construction" and "waterfront construction"?
GOVERNMENT RESPONSE: For purposes of this solicitation the definition is construction, reconstruction, or repair work requiring any combination of pile driving of steel or concrete piles, steel sheet piles, including tie-rod or structural support systems integrating one or more of these components into a structural system providing a finished engineered product suitable for mooring vessels with draft to at least 75% of adjacent channel depth where the waterways and structures are subject to wind, wave, and other environmental conditions associated with operation of vessels at or exceeding 100 tons in displacement. Work on rivers, streams, lakes, or similar waterways using rip rap, rubble mound, or similar stone or natural materials, or for the primary purpose of environmental restoration will not be considered as meeting the scope requirements for this project.
9. Amendment 0001 Factor 1 - Experience section for size states, "approximately 500 linear feet of water frontage construction and/or a final construction cost of approximately $20M." Please clarify this requirement. We read this as submitted projects shall either have 500 linear feet of water frontage construction of any final construction cost OR could be any type of construction project with a value of approximately $20M.
GOVERNMENT RESPONSE: That reading is grammatically correct. However, in the selection of projects for review under this factor be aware if a project has no direct correlation to the actual work of this solicitation, including the answer to RFI 8 above (for example it is building construction or renovation, bridge or highway work with retaining walls, or environmental restoration using natural shoreline/vegetation/stone materials) and the project is simply qualifying for size based on pricing such projects will likely be evaluated as deficient regarding scope and complexity for purposes of solicitation of this project. Discussions will not be engaged in based on such a situation, the deficiency will stand as evaluated.
10. Only a "Heavy Dredging" WAGE DETERMINATION is included in the solicitation. Can the WAGE DETERMINATION for all other work on the project be provided?
GOVERNMENT RESPONSE: The wage determination was for Heavy Dredging which was not accurate, but was the most current available at the time of compilation of this solicitation. The most current Heavy construction wage determination that is applicable to this project that replaces the old Heavy Dredging determination has been included in this amendment.
11. A "Heavy Dredging" WAGE DETERMINATION is provided in the solicitation and plan sheets show dredging depths. Is there dredging on this project? Can detailed plans and specifications for dredging be provided if there are dredging requirements on the project?
GOVERNMENT RESPONSE: See response to RFI 10. Dredge Line Elevation is referenced on sheets S-011 and S-022. These elevations are reflective of the channel bottom depth for seawall design conditions only. They represent the deepest point along these particular stretches of bulkhead according to the depths indicated on the V-100 sheet. No dredging will be required as part of the new construction.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
