Section M - Evaluation Factors for Award
SECTION M
M-1 Basis for Award
A. General
The Government will award, if at all, a single contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, represents the best value to the Government, price and other factors considered in accordance with the RFP. The Government will evaluate offers on a tradeoff basis in accordance with
FAR 15.101-1. Award will not be made to an offeror who receives an Unacceptable rating for the technical factor, a
Limited or No Confidence rating for Past Performance, or a Marginal or Unacceptable rating for the Small Business
Participation Factor.
The Government reserves the right to make an award to other than the lowest-priced offeror and to issue an award based upon initial offers. The Government may award on the basis of a proposal with superior ratings even though it may result in a higher price to the Government. Additionally, the Government may, after evaluation of initial offers, limit the number of proposals in the competitive range to allow for an efficient competition in accordance with FAR
15.306(c)(2).
Prior to award, the Contracting Officer will make a responsibility determination that will include a financial review of the apparent successful offeror. This review will include assessing the financial resources available to the apparent successful offeror to perform its contractual obligations. Accordingly, each offeror is required to demonstrate that it has such financial resources or the ability to obtain such financial resources. Financial condition and capability statements made by the offeror as well as any additional data available to the Contracting Officer regardless of whether it was provided by the offeror may be evaluated as part of the Contracting Officer’s responsibility determination.
B. Evaluation Factors
1. Technical – In order to be determined acceptable an offeror’s technical proposal shall demonstrate it has five years of experience in the management of afloat/ashore Safety Management System's as required in C-
3.18 that complies with the International Maritime Organization's (IMO) International Safety Management
(ISM) Code.
2. Past Performance, Small Business Participation, Price
a. Following evaluation of proposals against the minimum technical factor, those proposals that have been determined technically acceptable will be evaluated to determine the offer providing the best value. In order to determine the offer providing the best value, a tradeoff of the following factors will be conducted:
i. Factor 1: Past Performance
ii. Factor 2: Small Business Participation
iii. Factor 3: Price
i) Factors 1, 2 and 3 are in descending order of importance with Factor 1 and 2 significantly more important than factor 3. All evaluation factors other than price, when combined, are significantly more important than price.
ii) Price will not be a numerically weighted factor in the evaluation of proposals, and the importance of the price factor does not bear a linear relationship to the importance of the non-price factors. The importance of price will increase as differences in the evaluated quality of proposals decrease or when price is so significantly high as to diminish the value of the technical superiority to the Government.
iii) An overall adjectival rating will be assigned to the Small Business Participation and Past
Performance factors as a result of the source selection evaluation. In assigning these ratings, the evaluators will consider, for each factor, the offeror’s ability to exceed the minimum performance requirements of this solicitation and the risk of nonperformance, defective performance or late performance under the resulting contract.
C. Past Performance
(1) The past performance evaluation will assess the offeror’s probability of meeting the solicitation requirements. To develop an overall rating, the Government will evaluate the relevancy of the information submitted in the offerors past performance proposal as well as other sources of information (PPIRS, FAPIIS, ESRS, questionnaires, interviews, etc.) the Government will use to develop an overall past performance rating. The Government reserves the right to contact references provided in the past performance proposal for verification or additional information.
(2) The follow relevancy definitions will be assigned to each referenced contract:
PAST PERFORMANCE RATINGS - RELEVANCY
RATING DESCRIPTION
VERY RELEVANT Present / past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
RELEVANT Present / past performance effort involved similar scope and magnitude effort and complexities this solicitation requires.
SOMEWHAT RELEVANT Present / past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
NOT RELEVANT Present / past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires
The Government will assign each offeror a confidence assessment rating based an evaluation of an offeror’s recent/relevant performance record. The ratings (and their descriptions) are provided as follows:
PAST PERFORMANCE RATINGS – CONFIDENCE ASSESSMENT
RATING DESCRIPTION
SUBSTANTIAL CONFIDENCE Based on the offeror’s recent/relevant performance record, the
Government has a high expectation that the offeror will successfully perform the required effort
SATISFACTORY CONFIDENCE Based on the offeror’s recent/relevant performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort.
LIMITED CONFIDENCE Based on the offeror’s recent/relevant performance record, the
Government has a low expectation that the offeror will successfully perform the required effort.
NO CONFIDENCE Based on the offeror’s recent/relevant performance record, the
Government has no expectation that the offeror will be able to successfully perform the required effort.
UNKNOWN CONFIDENCE
(NEUTRAL)
No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
NOTE: Any offeror which receives a rating of Limited Confidence or No Confidence on the Past
Performance Confidence Assessment will not be considered for award.
(2) The Government will consider the company itself, predecessor companies, personnel who have relevant experience and subcontractors who will perform major or critical aspects of the requirement.
(3) The Government reserves the right to consider information received after the due date for receipt of proposals.
The Government reserves the right to contact references for verification or additional information and the right to consider other relevant past performance information. The Government may call customers, whether or not provided by the offeror, to inquire about the offeror’s past performance. The Government does not assume the duty to search for data to cure the problems it finds with the information provided by the offeror. The burden of providing thorough and complete past performance information remains with the offeror.
(4) In accordance with FAR 15.305(a)(2)(iv), an offeror without a record of relevant past performance or for whom information on past performance is not available will be evaluated neither favorably nor unfavorably.
Therefore, the offeror shall be determined to have unknown past performance. “Unknown Confidence” shall be considered “neutral.”
D. Small Business Participation
The Small Business Participation Plan provided by the offeror as required in Section L-8 will be evaluated based on the following:
a. Total effort to be performed by small business concerns.
b. Additional efforts to identify and develop opportunities for small business concerns.
c. The extent to which the offeror identifies and commits to small business concerns.
d. The Government will evaluate more favorably plans that are detailed and more achievable than plans that simply propose a high percentage of work to be performed by small business concerns.
e. The following rating (and its description) will be assigned to each offeror based on the information provided:
Small Business Participation Ratings:
RATING DESCRIPTION

NOTE: Any offeror which receives a rating of Marginal or Unacceptable rating for the Small Business
Participation Factor will not be considered for award.
E. Price
The offer will be evaluated using the total evaluated price as calculated in Form D. The total evaluated price will equal the proposed per diem rates multiplied by the number of days of FOS, ROS and RAV.
To be eligible for award, an offer’s total evaluated price must be determined fair and reasonable.
a. Each offeror’s price proposal will be evaluated to determine whether pricing is materially unbalanced.
Materially unbalanced pricing may cause a proposal to be unacceptable if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
b. FOS, ROS, and RAV pricing will be evaluated for contract award. All proposed rates submitted by the apparent awardee must be found fair & reasonable in order for the offer to be eligible for award.
F. Compliance with Solicitation Requirements
Proposals will be evaluated to determine compliance with all of the Instructions, Conditions and Notices to Offerors contained in Section L of the solicitation including proposal submission requirements. The solicitation requirements include all stated terms, conditions, representations, certifications and other information required by Section L of this solicitation. Offerors must follow the submission requirements in Section L-7, Submission of Offers, and provide all the documentation required under Section L-8, General Proposal Requirements. An Offeror's proposal submission must be found acceptable by the Government on an Acceptable/Unacceptable basis in order for the proposal to be considered for contract award. To that end, the Government will review the offeror's entire proposal package, including insurance information, to ensure that the proposal meets the RFP minimum submission requirements. A solicitation package missing any of the components will be ineligible for award, however, the Government may waive informalities and minor irregularities in proposals received.
M-2 Single Or Multiple Award
The Government intends to make a single award under the solicitation.
M-3 Notice of Award
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
M-4 Award Without Discussions
Pursuant to FAR 52.215-1(f), Instructions to Offerors-Competitive Acquisition (JAN 2004), the Government may evaluate offers and award the contract without discussions with offerors. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
