N32205-16-R-3101 SBX-1 Operation & Maintenance

QUESTIONS AND ANSWERS # 6

The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.

1. If the contractor chooses to use its completed SAM (System for Award Management) representations and certifications and indicates so in Section K, 52.204-8, are there any other representations and certifications required for submission with the offer? We are asking this question because our experience is that MSC frequently asks for more certifications during discussions.

Answer: If the offeror has completed representations and certifications in SAM that are also in the solicitation, then the offeror is not required to complete the provisions in section K that have already been addressed in SAM.

2. Q & A #2 Questions 24 & 25 both state that “the 84 hour-mandated work schedule is all part of the

Contractor’s fixed price, regardless of whether or not it is considered partially as overtime as per the

Contractor’s CBA. All overtime beyond 12 hours in any one (1) day or 84 hours in any one week reimbursable with prior approval from COR.” However, Amendment 1 Section 1.7.11.3 provides a 56 hour work week for 365 days. It continues to say “All overtime that is incurred beyond the eight-hour workday shall be reimbursable in accordance with Section CONTRACT SECTION G-7.” Additionally

Pricing Form B is asking to price Reimbursable Overtime as well as Section 4.2 and crew overtime is mentioned throughout the contract as a reimbursable item.

Please clarify if Questions 24 & 25 were answered in error and all overtime beyond an 8 hour workday is reimbursable and pricing form B must be submitted or will you be issuing an amendment that aligns with

Questions 24 & 25. That amendment should also include updated pricing forms with the removal of

Form B.

Answer: Section 1.7.11.3 will be revised in solicitation amendment 0002 to clarify the overtime requirements as follows:

1.7.11.3 Overtime. The Contractor shall comply with the manning requirements specified in

SBX-1 TM, Section 19. The Contractor’s fixed priced FOS Per Diem rate shall include the full wages for each crew member for a twelve-hour workday, seven days per week (including weekends and holidays), 365 days per year (84 hours per week per person) during FOS. All overtime that is incurred beyond the twelve-hour workday shall be reimbursable in accordance with CONTRACT SECTION G-7. Any overtime incurred for the purpose of maintaining required “watches” shall be part of the fixed price Per Diem.

Pricing form B will be revised in amendment 0002. Please see the answer to question 8 below for pricing form B changes.

3. Section C 1.1.5 states “During each option it is anticipated, without guarantee, that the SBX-1 will spend 50% of its time in ROS.” The pricing sheet provided as part of Amendment 1 indicates that the vessel will be in FOS 185 days and in RAV 180 days and ROS 0 days. The pricing sheets and the RFP are in conflict. Please clarify Section C 1.1.5 ROS vs. Pricing Sheet RAV.

Answer: A revised form D was posted to FEDBIZOPPS along with amendment 0002 correcting the number of days anticipated in each status to match section C1.1.5 as amended in solicitation amendment 0001.

4. Section C-1.8.9 – High Voltage Electrical Safety training:

a. The course is one (1) week in length, NOT 3.5 days as indicated in this section. Please provide correction to Section C.

b. The training course is not located in Dallas as indicated. MEBA’s school is in Maryland.

Please provide a correction to this section.

Answer: The Calhoun/MEBA, ABO HV High Voltage Electrical Safety training is required. The course is taught at MEBA’s school in Maryland and is one-week in length. The reference to “Dallas 3.5 days” will be removed from section 1.8.9 in solicitation amendment 0002.

5. Will a conformed copy of the Solicitation eventually be provided to industry?

Answer: A conformed copy of the solicitation will be posted to FEDBIZOPPS along with the amendment 0002.

6. In reference to Amendment 0001 posted on May 6, 2016: It appears that you may have reversed RAV and ROS number of days “Est. Qty.” on Form D from Amendment 0001. There are NO ROS days and almost 50% RAV days, which directly conflicts with OPTEMPO in C-1.1.5. Please clarify and provide a correction to this form.

Answer: A revised Form D will be posted to FEDBIZOPPS along with Amendment 0002 correcting the error and matching the number of days in each status IAW section C-1.1.5 as amended in solicitation amendment 0001

7(a). In reference to Amendment 0001 posted on May 6, 2016: Even though B-9 says that overtime is for the Contractor’s account “except as specifically otherwise provided in the contract”, it appears that virtually all overtime in FOS, except overtime for maintaining required watches, is reimbursable. As per

C-1.7.11.3, ALL overtime beyond 8 hours in any single day is reimbursable during FOS. Please confirm that this is correct.

Answer: Section 1.7.11.3 will be revised in solicitation amendment 0002 to clarify the overtime requirements and answer this question. See Answer to question 2 above for revised section

1.7.11.3.

7(b). Assuming that the previous question in (7(a)) was correct, then we are assuming that Form B

“Reimbursable OT” is meant for us to include all overtime except watch overtime that is mandatory or that the Contractor considers necessary to perform, due to our collective bargaining agreements. Please clarify and/or confirm if these assumptions are correct.

Answer: See answer to question #9 below.

8. In reference to Amendment 0001 posted on May 6, 2016: Form B Reimbursable OT has a box next to the name of each department that says either “billets:” or “Total billets:” This appears to be left over from a similar form that was used in the 2011 bid submission, where each position showed the billet, and then there was a total of all the billets in each position with each department. Please specify what should go into the box to the right of the “billets:” or “Total billets:” words.

Answer: Please note that form B is not required to be submitted with the proposal. Form B must be submitted by the awardee after contract award. Form B will be revised in amendment

0002. The box to the right of “Total billets:” must be filled in for each department (Deck, Engine, Steward and Other). See instructions contained in form B reflecting this answer.

9. In reference to Amendment 0001 posted on May 6, 2016: Form B Reimbursable OT requests

“overtime wage per hour” for each position. We believe that wage per hour should be defined as fully burdened wage per hour, thus we believe that any taxes or other fringes applicable to OT should be included in the hourly wage. Please confirm that this is correct.

Answer: Form B will be revised in an amendment 0002. The heading in column two for each department (Deck, Engine, Steward and Other) will be changed from “Overtime wage per hour

(not including watch overtime)” to “Fully Burdened overtime wage per hour (not including watch overtime)”

10. In reference to Questions and Answers #3 posted on May 5, 2016, please re-confirm that the answer to Question 12 of MSC Q&A #3 means that Contractor’s (offeror) P&I insurance must provide coverage for sponsor personnel and/or their subcontractors. This would be a major expense to Contractors

(Offerors), as work requirements, number of sponsor personnel to be covered, etc., liability of sponsor subcontractors and their insurance certificates, etc. could not be reasonably obtained or estimated in advance.

Answer: As stated in Q&A #3, Question 12 answer, The Contractor's P&I insurance should cover any and all persons working onboard the vessel.

11. In reference to Questions and Answers #4 posted on May 11, 2016, we request the following clarification for Question 2: On page 164 C. Small Business Participation Proposal of the RFP, the following note: THIS FACTOR IS DISTINCT FROM THE SMALL BUSINESS SUBCONTRACTING

PLAN AND IS REQUIRED OF ALL OFFERORS REGARDLESS OF SIZE STATUS. However, I do not see a section where they want us to provide a small business subcontracting plan. Do we just insert this plan in this section? Please clarify how the Subcontracting Plan should be submitted. For Offerors required to submit a Subcontracting Plan, would you like this submitted as part of the Solicitation

Package? If so, please amend the solicitation to reflect this.

Answer: The small business subcontracting plan shall be submitted on the first CD along with

Solicitation Package, Price Proposal, and Small Business Participation Proposal as required in section L-7(d). Section L-7(d) will be revised to incorporate this answer in solicitation amendment 0002.
