AMENDMENT: 0004 SOLICTIATION N00383-18-R-012C
1. QUESTION: I can’t tell if Volume 1 and Volume 2 should be on all 7 CD-ROMs and Volume 3 is only 4 of same CD-ROMS and Volume 4 is on only 5 of those CD- ROMs or if we submit these all separately which would total 26 CD ROMS?
ANSWER: Each Volume shall be submitted as a separate CD-ROM or DVD ROM and labeled. For Volume 1- Performance Approach- 7 CD ROMS or 7 DVD ROMS are required; For Volume 2 - Past Performance – 7 CD ROMS or 7 DVD ROMS are required;
For Volume 3- Small Business Participation Commitment – 4 CD ROMS or 4 DVD ROMS are required; For Volume 4- Price – 5 CD-ROMS or 5 DVD ROMS are required. (Note:
This change was incorporated under Amendment 0002 dated 28 Jan 2019 in L03 – 3.1 General).
2. QUESTION: Should a paper proposal be submitted or should all be on CD-ROM or DVD-
ROM?
ANSWER: In addition to the foregoing the Offeror shall submit a paper copy of its complete proposal inclusive of Volumes 1, 2, 3, and 4 signed by authorized appropriate company official. (Note: This change was incorporated under Amendment 0002 dated 28 Jan 2019 in L03 – 3.1 General).
3. QUESTION: We are in the process of sending out the Past Performance Questionnaires and noticed they do not say “Source Selection Information- See FAR 2.101 and 3.104”. Should we be adding this to the questionnaire before going out to our USG customers?
ANSWER: The Past Performance Questionnaire does not need to be stamped “Source Selection Information – See FAR 2.101 and 3.104” when sent to your USG customers. When it is received by the Government – it will be stamped Source Selection Information- See FAR
2.101 and 3.104.
4. QUESTION: We had a repair contract with a POP that ended in 2011; however, we worked the closeout of those items that were already inducted in the repair cycle through 28 Jan 2014.
We have the final Purchase Order stamped and dated on that day. Since that is the day this solicitation was released (28 Jan 2019), are we ok using that contract as a recent Past Performance? In my opinion, it is 5 years to the day so should be acceptable.
ANSWER: The above-referenced contract would be considered acceptable to be submitted as part of the Past Performance evaluation.
5. QUESTION: L- 3.2.4 - “Each “page” is defined as one sheet, 8 1/2 x 11, with at least one inch margins on all sides, using a font with a font size of 12 or greater (e.g., Times New Roman style with 12-point font.” Will the Government consider allowing a smaller font size (such as Arial or Arial Narrow 10 point) for graphics, tables, charts and figures?
ANSWER: No.
6. QUESTION: L- 3.3.2 – “The Offeror should complete RFP Attachment H – Past
Performance Reference Information Sheet for each contract/subcontract offered as relevant past performance. To provide additional information regarding a particular reference beyond that which will fit on the form, the Offeror may continue onto another sheet of paper. Such continuation sheet(s) for submitted references will count towards the Volume 2 – page limit.”
Attachment H utilizes a smaller font and size than Times New Roman 12. Will the Government allow bidders to also use a smaller font, and size, to enter data into the form;
specifically, as any extra pages added to the form are counted toward the Volume 2 - page limit?
ANSWER: Times New Roman 12 font is to be used on the form and any continuation sheet.
7. QUESTION: L-3.3.4 “The Offeror shall populate their prices on RFP Attachment D- P-8 CCRS Pricing Sheets and return it with their proposal in Microsoft Excel. A separate copy in pdf format may also be submitted in Volume 4.” Will the Government allow all of Volumes 1-4 to be delivered in Adobe –pdf?
ANSWER: An Adobe PDF is a file format. While all volumes (except the Excel pricing sheet) can be in PDF file format, each offeror still must put those PDFs on either CD or DVD per the RFP’s instruction. And as indicated in the RFP, a separate signed paper copy of the entire proposal is still required. Note in this regard that such paper copy of the entire proposal needs to include a paper print out of the Attachment D Pricing Sheet Excel spreadsheet. (While submission of a copy of the entire proposal in paper form may seem duplicative, what such submission does is it provides a low-tech, secure hard copy.)
8. QUESTION: L-3.2.4 “Each “page” is defined as one sheet, 8 1/2 x 11, with at least one inch margins on all sides, using a font with a font size of 12 or greater (e.g., Times New Roman style with 12-point font.” Will the Government consider allowing ‘fold-out’ pages (such as 11 x17) in proposal submissions?
ANSWER: No, except for the paper copy of the Attachment D CCRS Pricing Sheet (Excel spreadsheet). Because of its size, the paper copy can be in fold-out format.
9. QUESTION: L 3.3.1 (2) “If the Contractor complies with ISO 9001 or AS9100, the certificate of compliance must be submitted with the Contractor’s proposal.” Does the
Government consider certificate(s) of compliance (submitted with the proposal) to, count toward the page limit of Volume 1?
ANSWER: The Government would not count the certificate(s) of compliance against the page limit of Volume 1.
10. QUESTION: Section C – 2.2.1 – This section states the Contractor is required to maintain copies of the 8130-3/Form 1 forms for all items repaired under the contract. Is this documentation required to be maintained for a specified period of time (i.e., 2 years), or the entire duration of the contract?
ANSWER: The Contractor shall maintain a copy of the 8130-3 Form for a period of two years. See Page: 10 of this amendment which incorporates this change into Section C – 2.2.1 of the RFP.
11. QUESTION: Section C – 2.2.2 – The Contractor is required to maintain/update Life Limited and Fatigue Sensitive Aviation material records IAW CNAFINST 4790.2C, Chapter
5. Will the PCO please provide us a DVD of the Instruction? Solicitation advises not to use an on-line version of this document.
ANSWER: The PCO will provide a copy of CNAFINST 4790,2C, Chapter 5 upon request.
Note that offerors and the awardee cannot rely on any version of CNAFINST 4790,2C, Chapter 5 found on-line or elsewhere; only the version that NAVSUP WSS will supply is to be used.
12. QUESTION: Section F02 -B – “ATAC is responsible for delivery and pick-up of Government owned assets going to and from the repair facility.” Is this specific to shipment of the repairable asset to the Contractor’s facility only, or will shipping also be provided by ATAC from the Contractor’s facility to the designated FAA Part 145 repair facility; if not being repaired by the Contractor in-house?
ANSWER: The Navy’s transportation organization, Advanced Traceability and Control (ATAC), will at Government expense, (i) deliver items needing repair/overhaul/upgrade from the Fleet to the Awardee’s facility and (ii) pick up repaired “ready for issue” (RFI) items from the Awardee’s facility (or from the Awardee’s packaging house if the Awardee assures in a timely fashion after award that such packaging house has a Government Department of Defense Activity Address Code (DoDAAC). The Awardee is responsible at its expense for all other transportation, for example, transportation of an item needing repair from the
Awardee to a subcontracted FAA Part 145 Repair Station and back to the Awardee, transportation of item to a packaging house, etc. See Page 10 of this amendment which incorporates this change into Section F02- Place of Delivery – paragraph B of the RFP.
13. QUESTION: Section F03; Time of Delivery 2a – “Contractor shall complete CAVS “Receipt” transaction – immediately upon receiving the”. Is something missing from this statement? It appears to be incomplete.
ANSWER: Section F03; Time of Delivery 2a is corrected to read: “Contractor shall complete CAVS “receipt” transaction –immediately upon receiving an item for repair/overhaul/upgrade.” See Page: 10 of this amendment which incorporates this change into Section F03 – 2a of the RFP.
14. QUESTION: Section F03, Time of Delivery; 2 “RTAT is expressed in the number of days from induction of the failed assembly at the contractor’s plant to acceptance by the Government of the same “repaired” assembly.” Please clarify if RTAT starts when delivered to the Contractor’s facility, or when the assembly arrives at a subcontracted FAA Part 145 repair station, if not being repaired in-house.
ANSWER: RTAT begins immediately upon the receipt of an item at the Contractor’s facility. (Note this assumes the Contractor has received a funded order; in the event an item is received before receipt of a funded order, RTAT doesn’t begin until the Contractor receives the funded order). See Page: 10 of this amendment which incorporates and adds this into Section F03 – under “Please Note” “b” of the RFP.
15. QUESTION: Attachment D; Pricing Sheet; Line 193- Item #A188, Actuator Electro-mechanical, is identified by Part Number U26B10-62025-3. Will the USG please confirm this part number to be accurate? It appears to be two part numbers combined; U26B and 10- 62025-3. Both are rudder trim actuators manufactured by MPC. And which part number should the Contractor price?
ANSWER: The part number for Line Item A188 should be U26B or 10-62025-3. The applicable NSN is 01-626-1398. See Page: 10 of this amendment which incorporates this change into Attachment A – Item List and Attachment D – P-8 CCRS Pricing Sheets.
16. QUESTION: In regards to Attachment E – Configuration and Obsolescence/DMSMS
Items, which includes all repairs to be covered under this potential contract as well as 387 additional commercial items; Are you looking for the contractor to develop relationships (license agreements, etc.) with the various OEM’s in order to be on the leading edge of these activities and possibly be part of the generation of the various notifications (SB’s, Sl’s and AD’s), or are you looking for the contractor to simply stay in the loop by maintaining visibility on publicly distributed notifications (websites, distribution lists, etc.) to ensure that you are notified in a timely manner after publication that may affect the fleet?
ANSWER: NAVSUP WSS requires the Contractor to simply stay in the loop by maintaining visibility on publicly distributed notifications (websites, distribution lists, service bulletins, OEM notifications, etc.) to ensure the Government is notified in a timely manner after publication of any configuration changes or Obsolescence/DMSMS issues that may affect the Fleet.
17. QUESTION: In regards to Section H – Special Contract Requirements; While we understand the need for a Security Representative for the contract, is there any expectation, aside from an unforeseen incident or activity, that the contractor will be required to work at a Federally controlled base, facility or activity? This is an attempt to clarify potential costs of such activity.
ANSWER: There is no expectation that the Contractor will be required to work at a Federally controlled base, facility or activity.
18. QUESTION: In regards to the DO rating. We understand the requirement generally, but will a specific DO rating apply to the entire contract or be identified on individual orders, or both?
ANSWER: There will be a DO Rating on every Order. The DO Rating will be DO A1.
19. QUESTION: Do APU’s have logbooks.
ANSWER: Yes
20. QUESTION: What dollar value should the Small Business Participation Plan be based on?
ANSWER: The small business participation plan should be for the dollar value of the Best Estimated Quantities (BEQs).
21. QUESTION: Can Past Performance Reference Questionnaires be submitted after 27 February 2019?
ANSWER: Past Performance Reference Questionnaires can be submitted on or before 10 April 2019. See Page:10 of this amendment which adds a notation making this date change.
22. QUESTION: Do you need to have the Amendment (SF30s) signed and returned with the proposal?
ANSWER: Yes
23. QUESTION: Do companies need to submit a DD Form 1694 request for variance if a company wants a variance from what the CMM calls out?
ANSWER: Variances from the CMM will NOT be accepted. As stated in 2.2.1 “Components Maintenance Manuals (CMM)” of the SOW: “Any repairs requiring FAA Designated Engineering Representative (DER)- approved or other FAA approved deviations or alterations to that which is required by the requirements of a CMM will not be accepted.”
24. QUESTION: What happens if I receive a repair/overhaul to complete and find an internal component or a WRA on the contract is life limited (CMM states it is life limited part and this life limited part needs to be replaced). Would this be considered an over and above repair/overhaul?
ANSWER: Life limited parts should not be priced in the repair/overhaul price. If you receive a repair/overhaul to complete and find an internal component or a WRA on the contract and the CMM states it is a life limited part and it needs to be replaced this would be treated at an over and above repair. The Contractor would need to indicate to the Contracting Officer what life limited part needs to be replaced and back up data to support an over and above repair/overhaul price.
25. QUESTION: Are sub vendors required to be ISO/ASO Compliant? Primes are encouraged to be but are their subs. Or is FAA certified fine?
ANSWER: The only requirement of subcontractors (or any entity that will do repairs, etc.)
is that they must be certified as a CFR 43 Part 145 repair station by FAA.
26. QUESTION: Do companies internal Quality Management Plans counts towards page counts? Separate plans from ISO & ASO certification.
ANSWER: No.
27. QUESTION: What happens if a company does not currently have ISO/ASO CERT during the proposal process, but will have it before contract award?
ANSWER: NAVSUP WSS’ Contracting Officer cannot predict how any given set of facts presented by an offeror will be evaluated; Section M of the RFP states the evaluation factors.
28. QUESTION: For the bottom half of Table I, where SB Concern Subcategories are listed (i.e., SB, SDB, WOSB, etc.), is it acceptable to list all of the subcontracted FAR Part 145 repair stations for each Subcategory under the “Subcontractor Name/CAGE” column? For example, if there are five Small Disadvantaged Businesses that may be used, is it ok to list them by name and CAGE in that last column but not specify by company the $ to be subcontracted, % of Total Contract Value or % of Total Planned Subcontracted Amount for each company? For example, if the total amount to be subcontracted to those five in the SDB category is $4M, is it ok to list them by name and CAGE and just put in that total $4M?
ANSWER: Yes. The dollars, % of Total Contract Value, and % of Total Planned Subcontracted Amount do not need to be specified by company.
29. QUESTION: I just noticed on the top of page 3 of Amendment #2, the requirement is for 5 CD ROMS or 7 DVD ROMS. Can you clarify whether it is 5 or 7 that is desired?
ANSWER: On Page 3 of Amendment 2 it should read: “For Volume 4 – Price - 5 CD ROMS or 5 DVD ROMS are required.
30. QUESTION: Is it possible to get size and weight for the items we are quoting? Any information you can provide would be most appreciated.
ANSWER: NAVSUP WSS does not have this information readily available. These items are commercial common 737 components; industry should have this data (size and weight) available already.
31. QUESTION: How should we price each part number listed?
ANSWER: All items are to be priced as a repair unless Attachment D- P-8 CCRS Pricing
Sheets specifically call for overhaul or upgrade.
32. QUESTION: What is the required small business participation?
ANSWER: See Page:11 of this Amendment which clarifies the discussion at the recent P-8 Commercial Common Readiness Solution (CCRS) Pre-Proposal Conference regarding a side bullet that said "at least 51% of the work must be done by the awardee." This clarification supersedes the bullet and all prior discussion.
33. QUESTION: For the APU, are serviceable parts allowed to be used in the repair or overhaul (serviceable parts which themselves were repaired or overhauled to OEM standards per the CMM)?
ANSWER: No serviceable parts can be used in the repair or overhaul of APUs or any other item covered by this contract, with one exception as specified below. Thus, only NEW OEM parts may be used in the repair/ and or overhaul of an APU or other item. The only exception is if there is a subcomponent classified as repairable within a Navy/RAAF APU or other Navy/RAAF item which failed and that unit of the subcomponent is determined to be fixable.
The repair station is authorized to repair and use any subcomponent within the APU or other item which comes back from the Navy/RAAF. For example, if Navy APU Serial Number 123 comes back for repair, and there is a failed subcomponent within that APU that can be repaired to make the entire unit RFI, the repair station is authorized to repair such failed subcomponents and put it back in APU Serial Number 123. What is UNACCEPTABLE for a repair station to do is to take off the shelf a repaired (‘serviceable”) component from the airlines or another user to replace a failed subcomponent on Navy APU serial number 123.
Thus, except for the narrow exception above, parts (e.g., subcomponents) used in repairs, etc.
MUST be new and an OEM part or a part licensed by OEM.
The following changes are hereby incorporated and made a part of solicitation N00383-18-R-012C:
1. The last sentence of paragraph one under Section C02- 2.2.1 is changed to read: The Contractor shall maintain a copy of the FAA Form 8130-3 or EASA Form 1 for items repaired under this contract for a period of two years.
2. Section F02- Place of Delivery – paragraph B is deleted in its entirety and replaced with the following:
B. The Navy’s transportation organization, Advanced Traceability and Control (ATAC), will at Government expense, (i) deliver items needing repair/overhaul/upgrade from the Fleet to the Awardee’s facility and (ii) pick up repaired “ready for issue” (RFI) items from the Awardee’s facility (or from the Awardee’s packaging house if the Awardee assures in a timely fashion after award that such packaging house has a Government Department of Defense Activity Address Code (DoDAAC)). The Awardee is responsible at its expense for all other transportation, for example, transportation of an item needing repair from the Awardee to a subcontracted FAA Part 145 Repair Station and back to the Awardee, transportation of item to a packaging house, etc. The above-referenced ATAC transportation actions will be as follows: ATAC will send a carrier (e.g.
Federal Express) to deliver or pick up items as referenced above. Refer to the CAVSOW and CAV website https://applictions.ahf.nmci.mil/cavweb/Documentation/CAVInfo/NAVSUP CAV SOW.pdf for instructions on contacting the ATAC Dispatcher for pick-ups.
3. Section F03- Time of Deliver – Please Note: Notes ‘a’ and ‘b’ are deleted in their entirety and is replaced with the following:
a. Contractor shall complete CAV “receipt” transaction immediately upon receiving an item for repair/overhaul/upgrade.
b. Contractor shall make inductions – immediately following the CAVS
“Receipt” transaction for items with open delivery orders for that particular item. RTAT begins immediately upon receipt of an item at the Awardee’s facility for that item provided there is an open delivery order for that item.
4. The Part Number listed for Line Item A188 – Nomenclature: Actuator Electro Mechanical, on Attachment A- Item List and Attachment D- P-8 CCRS Pricing
Sheets is changed to read: Part Number U26B or Part Number: 10-62025-3.
5. Attachment “J” – Past Performance Questionnaire – Section III – The deadline for submission is changed from 16:00 EST, 27 Feb 2019 to 16:00 EST, 10 Apr 2019.
https://applictions.ahf.nmci.mil/cavweb/Documentation/CAVInfo/NAVSUP%20CAV%20SOW.pdf https://applictions.ahf.nmci.mil/cavweb/Documentation/CAVInfo/NAVSUP%20CAV%20SOW.pdf
This clarifies a discussion at the recent P-8 Commercial Common Readiness Solution (CCRS) Pre-Proposal Conference regarding a slide bullet that said “at least 51% of the work must be done by the awardee.” This clarification supersedes the bullet and all prior discussion.
RFP N00383-18-R-012C includes FAR 52.219-14 Limitation on Subcontracting (DEVIATION 2019-O0003). The RFP’s clause dated January 2017 is hereby superseded by the Deviation 2019-O0003 version, quoted in pertinent part below. (Two notes: (i) the contract here will be a supply contract; (ii) the parenthetical in (e)(2) “(other than procurement from a non-manufacturer of such supplies)” is inapplicable here; it only makes FAR 52.219-14’s limitation on subcontracting inapplicable to “non-manufacturers” where the supply contract to be awarded is for the manufacture of supplies.)
Limitations on Subcontracting (DEVIATION 2019-O0003)
(b) Definition. As used in this clause— “Similarly situated entity” means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award and that is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform. An example of a similarly situated entity is a first-tier subcontractor that is a HUBZone small business concern for a HUBZone set-aside or sole source award under the HUBZone Program.
(c) Applicability. This clause applies only to—
(1) Contracts that have been set aside or reserved for small business concerns or 8(a) participants;
(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) Agreement. By submission of an offer and execution of a contract, the Offeror/Contractor agrees in performance of the contract in the case of a contract for—
(2) Supplies (other than procurement from a non-manufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;
(f) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph
(e) of this clause will be performed by the aggregate of the joint venture participants.
(End of clause)
Thus, pursuant to FAR 52.219-14 the awardee under RFP N00383-18-R-012C is by law permitted to subcontract to one or more large businesses as long as any such subcontracting (including any such subcontracting done by any “similarly situated entity”) totals up to, but does not exceed, 50% of the dollar value of the contract. The RFP under its “Small Business Participation” factor includes the statement “[t]he highest rating will be given to Offerors whose planned contract performance maximizes Small Business Concern participation….” Offerors should note that this rating statement pertains to the third of the four factors, which are in descending order of importance.
