About this file
This is a Questions and Answers (Q&A) document from a federal solicitation for Materials Handling Equipment (MHE) services. The document does not address specific products or services, response dates, or award dates, but rather clarifies solicitation requirements and policy in response to offeror inquiries.
Key clarifications include: wage determinations under FAR 52.222-42 allow offerors to quote the best applicable labor category; Volume III is required for small business offerors per Section L; the contract uses Cost-Plus-Fixed-Fee (CPFF) pricing where each Section B line item represents the total annual cost estimate for that category, with detailed breakdowns required in Attachment 2 (CNSL MHE Cost Spreadsheet); cost-reimbursement contracts require contractors to have an acceptable accounting system per DFARS 242.7501, which cannot be waived; the government will not convert to Fixed-Price (FFP) or establish a small business set aside; and the solicitation will be awarded using Full and Open Competition. The incumbent contractor is Huntington Ingalls Industries under contract N0018921D0018. Additional requirements addressed include forklift weight test certifications per NAVSUP P-538 (4.0 labor hours with 2-person requirement), five NMCI workstations for CAC card employees (Program Manager, Material Expediter, Administrative Assistant, Shop Supervisor, Quality Assurance Inspector), and portrait page orientation for proposal submissions. Amendments 1 and 2 contain updates to the Summary Tab, clarification that Level of Effort and Cost Spreadsheets are identical, and confirmation that "Program Manager" is the correct position title.

Q1: Would the government include a statement of equivalent wages, under 52.222-42, ensuring all offerors provide the same Wage Determination Occupation code for applicable roles.
A1: Within FAR 52.222-42, the applicable labor rates are listed, please quote to the best applicable labor category.
Q2: If a Small Business if the offeror, is Volume III required?
A2: Yes, please provide in accordance with Section L.
Q3: For the Past Performance Questionnaire, which is to be sent by the customer, it references a different Solicitation number on top of the document, and only one POC, is this accurate? If
PPQ’s have already been sent, what happens to do those?
A3: Please see Amendment 1.
Q4: Solicitation Section B does not show the typical CPFF format which includes the unit as number of hours, the labor cost, the fixed fee amount, and the total amount. It mentions a Lot, does the government intend this to be the process, it seems to differ from that of the Attachment
2?
A4: For the line items in section B, each line is the total cost estimate for that year in that category. For example, 0001 “Base Year- Labor”, the amount should be the total cost estimate for base year labor. You must still fill out the entirety of Attachment 2, CNSL MHE Cost
Spreadsheet, which breaks down the costs.
Q5: 5. If the offeror, or subcontractor, does not have an approved accounting system from
DCAA/DCMA, is FAR 42.101 and 42.102 applicable where the government will initiate the audit process?
A5: In accordance with FAR 15.404-2(b)(4), cost submissions shall be in accordance with the contract cost principles and procedures in part 31 and, when applicable, the requirements and procedures in 48 CFR chapter 99, Cost Accounting Standards. DFARS 242.7501 requires contractors that receive cost-reimbursement type contracts to have an acceptable accounting system. The contracting officer does not have authority to waive this provision. The government cannot provide a pre-evaluation as to whether your particular accounting system is acceptable, nor can advice be provided as to how to achieve acceptability. You are encouraged to consult your own legal counsel and accountants in that regard.
Q6: Would the government please provide details on the Forklift certifications required and general costs for those certifications? Would the government provide these certifications?
A6: As required by ANSI/ITSDF B56.1, forks shall be inspected and documented in the MHE history file at intervals of not more than [12] months or whenever and defect or permanent deformation is detected. To satisfy this requirement, all MHE forks shall be inspected in accordance with the Fork Maintenance Inspection Form [figure 8-13] in NAVSUP P-538. [18] month periodic weight test certification whenever one of the following conditions occur: Prior to be placed into service and every [18] months thereafter or less than [18] months when it is necessary to coincide with the ship deployment. Operational weight test certification required whenever ashore forklifts have undergone repairs or modifications affecting any load bearing component [forks, carriage, cylinders, frame or mast]. Typical labor hours for completion of weight test certification are [4.0] hours labor [2-person requirement] as have mechanic and certifying official. Per the contract, the contractor provides the weight test certification and must have a letter on file on company letterhead stating that the individual is knowledgeable about the various MHE requirements. All requirements for performing the weight test procedures are outlined in the NAVSUP P-538 6th Revision [Management of Materials Handling Equipment]
Q7: Would the government consider making this requirement a Small Business Set Aside?
A7: The Government at this time will not consider making this requirement a small business set aside, this solicitation will be awarded using Full and Open Competition.
Q8: Is there currently an incumbent on this requirement? If so, what is the incumbent name, contract # and contract value?
A8: This is a follow-on to N0018921D0018, the incumbent is Huntington Ingalls Industries.
Q9: Attachment 2, seems to put an overall CLN Value on the SUMMARY tab, is that CLN value for labor to include fee? Shouldn’t this be broken down by Labor cost, fee, and total, as it is understood that the fee is fixed but the other costs can fluctuate.
A9: The Summary Tab will be updated in Amendment 1. Labor cost, fee, and total can be found on each of the ordering period tabs.
Q10: In response to Attachment 2, Would the government consider making this requirement an
FFP requirement?
A10: The Government at this time will not consider making this requirement a FFP requirement.
Q11: Attachment 9 seems to mention only 5 NMCI workspaces, does the government consider
MORE equipment available, it seems the government expects more FTE’s to be available?
A11: [5] NMCI workstations, which equates to [5] CAC card employees, “Program Manager, Material Expediter, Administrative Assistant, Shop Supervisor, and Quality Assurance Inspector.
The rest of the FTE’s are DBIDS holder and do not require any NMCI workstations.
Q12: Sam.gov lists a Special Notice which has a response date that overlaps with this requirement, the Special Notice (screenshot below) shows a response date of April 15th). Is there any action required for this?
A12: Special Notice response date has been updated; no action is required for the Special Notice posting.
Q13: Is it possible to make this requirement only for Seaport NxG MAC holders?
A13: The Government at this time will not consider posting to Seaport NxG.
Q14: In follow up to question 8, if yes, is FAR 52.237-3 applicable to this requirement?
A14: No, the government does not intend on including FAR 52.237-3 at this time.
Q15: Can the Government confirm whether the reference to "CNSL MHE Cost Spreadsheet, Attachment 1" should be corrected to "Attachment 2 Level of Effort Spreadsheet"? Alternatively, will the Government be providing a separate "CNSL MHE Cost Spreadsheet" as a new attachment?
A15: Please see Amendment 2, the Level of Effort and Cost Spreadsheets are the same thing.
Q16: Can the Government clarify which title is correct and should be used for proposal submission—Project Manager or Program Manager?
A16: Program Manager, please see Amendment 2.
Q17: May landscape oriented pages be used and counted as one “page,” provided they maintain the required 8 1/2" x 11" page size, one inch margins on all sides? Landscape orientation would better accommodate certain graphics and visual presentations we wish to include in our proposal.
A17: The government will not be changing the requirement that the page orientation be portrait.
