If the Government elects not to cap punitive QASP fines at 2.5% for this solicitation consistent with its established course of conduct, will it allow Contractors to exclude their pricing of the risk resulting from uncapped QASP fines from their Total Evaluated Price (TEP) ?
| The Government does not intend to cap punitive QASP fines. Offerors should include all applicable pricing to properly propose and complete the availability in accordance with the terms of the solicitation. | |||||
| 145 | 1/29/19 | Solicitation | LOE | The RFP provisions for negotiating growth and new work to be performed under the contract assumes that contract changes will require only direct production hours and material dollars. However, changed conditions arise after contract award are not related to growth work or new work; e.g.,, delay and disruption impacts, changes related to other Navy third party contractors such as AITs, changes related to Navy ship’s forces, schedule/time related changes, and time gaps between the discovery of potential growth work (condition found reports) and receipt of the Contracting Officers’s authorization to perform the growth work. Based upon the growth and new work pricing provisions (fixed rates applied to direct production hours and material dollars), bidder requests clarification regarding negotiation and pricing of contract changes that do not correlate with direct production hours or material dollars. |
In addition, the RFP provisions state that the fixed labor and material burden rates for growth and new work include all wages, overhead, all other indirect costs, general and administrative expenses, facilities capital cost of money (FCCOM) and profit. A significant element of a fixed labor rate is the component for premium time required in circumstances where growth and new work impact the program’s critical path. Bidder requests that the Navy provide a detailed explanation of the how the RFP’s number of LOE hours and material dollars were derived. In addition, please provide guidance regarding the number of LOE hours and material dollars that may impact the program’s critical path and/or be introduced at a time when the bidder must execute the growth and new work using premium labor dollars; i.e., in order to maintain the required schedule.
The Government will use "NOTE E: SCHEDULE OF PRICES / RATES FOR THE PURPOSES OF A GOVERNMENT REQUIRED EXTENSION: DAILY RATES FOR PIERSIDE AND DRY-DOCKING (FULLY BURDENED) " to adress Government caused impacts resulting in extensions to the contract.
The LOE hours and material dollars are based on the historical percentage growth for CG-47 class docking CNO Availabilities at the Availabilities system level. The amount of growth and new work that may impact the Availabilities critical path is unknown. Offerors should include all applicable pricing to properly propose and complete the availability in accordance with the terms of the solicitation.
| 146 | 1/29/19 | Solicitation | Schedule Performance | To assist the bidder’s understanding of the performance, financial, and schedule risks associated with the RFP work package, please provide the quantity of anticipated growth and new work that will impact the program’s critical path. Bidder notes that the introduction of contract changes without impacting the program’s critical path and schedule is highly dependent upon the nature of the growth and new work and insertion into the program in an efficient manner. The RFP “Availability Schedule Performance” provisions introduce undue risk to the bidder given the unknown nature of the anticipated growth and new work that will be introduced after contract award. Bidder is also concerned about the introduction of new work after contract award, with respect to the risks associated with new work not being included in the Navy’s pre-RFP/contract acquisition planning processes. | The amount of growth and new work that may impact the Availabilities critical path is unknown. |
| 147 | 1/29/19 | Solicitation | Small Dollar Value Change | Please provide the detailed derivation of the RFP’s “Small Dollar Value Change” price of $6,986.00” per occurrence. Bidder understands the “Small Dollar Value Change” price is unilaterally derived by the Navy. However, bidder is not afforded an understanding of how the Navy derived the “Small Dollar Value Change” price and how it will apply. In particular, bidder requests a detailed explanation of how the “Small Dollar Value Change” price is applied during contract execution; i.e., individual/single changes as identified in “Condition Found Reports (CFR)”, grouping of changes, etc. |
In addition, please explain how the Government determined that there would be over 800 occurrences on each ship.
| The data used for developing the dollar values and quantities for the SDVG are based on Request for Contract Change (RCC) data from the Navy Maintenance Database (NMD). This data was provided at an industry event at which all ship repair vendors were present. The data is from 2014 to present and is broken out by region. An analysis of the standard deviation of each geographical dataset, signifying how much variation or "dispersion" exists from the average (mean, or expected value). The standard deviation shows the range of prices NAVSEA can expect to pay for each SDVG in each region. SDVG will be applied during contract execution as detailed in Note F of the RFP. | ||||||
| 148 | 1/29/19 | Solicitation | Planning Yard Est | Please provide a copy of the Gov’t Planning Yard’s work package estimate for each ship included in this bid opportunity. In addition, please inform bidders whether the Gov’t Planning Yard’s work package estimate includes the RFP “Level of Effort to Completion” associated with forecasted growth work and “Additional Growth” associated with forecasted new work to be added after contract award? | The Government will not provide the Planning Yard’s work package estimate. | |
| 149 | 1/29/19 | Solicitation | FFP FAR | Based upon the amount of uncertainty included in the RFP’s provisions, bidder requests an alternative contract type, e.g., cost plus an award fee that more equitably acknowledges the instability of the RFP requirements at the time of bidding and contract award or creating a hybrid contract with some CLINS priced on a firm, fixed-price basis and other CLINS priced as level of effort work. | The contract type will remain unchanged. |
