QUESTIONS AND ANSWERS #4
29 November 2016
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
35. The ship check for the USS Roosevelt DMP is not on the Roosevelt but another Flight IIA DDG, the USS Lassen, located in Mayport, FL. We ask that the Government add the USS Bulkeley, also a Flight IIA DDG from the same Building Yard that is currently located in Norfolk, VA as a recommended ship for a ship check on this solicitation.
A. The Government is unable to accommodate a ship check besides that specified in the solicitation.
36. ADDRESSED IN BIDDERS Q&A ROUND #3
37. What are the components and their foreseeable costs that were applied to the Interport Differential Model?
A. The Government clarifies that the interport differential amounts included in the solicitation are based upon current NAVSEA guidance. Interport differentials, in accordance with current NAVSEA guidance, include fuel costs, towing and pilot charges, escort ship charges, TYCOM or Squadron Commander travel (to include the port engineer/maintenance manager, type desk assistant, immediate superior in charge, intermediate maintenance activity, and SUPSHIP), and ships force travel/per diem for work and for training purposes.
A special notice was posted on 18 November 2016 under this solicitation regarding NAVSEA’s intent to revise the interport differential calculation to further capture the cost of moving and sustaining ships force outside the ship’s current homeport. NAVSEA plans to hold an industry day on or around 30 November 2016 to discuss interport differential costs. This forum will give NAVSEA an opportunity to receive feedback from the ship repair industry on matters relating to the calculation of the interport differential costs. The timing of this Industry day and the solicitation amendment will extend an offeror's right to challenge the interport differential aspect of the solicitation beyond the initial proposal submission date.
38. Does the Interport Differential Cost include Government Furnished Material storage costs?

70. The reference listed in Work Item 235-90-001, paragraph 2.19 does not exist. Will the Government Please clarify the correct reference number for reference listed in paragraph 2.19?
A. Ref 2.19 in Work Item 235-90-001 was previously distributed as a J-2 attachment in Amendment 2. Errata 6 generated to correct reference title and number to “Reservation 1: Require Connector/Backshell Information” for RLAR 82710/DDG80/1161532, which was distributed with Amendment 3.
71. CANCELLED
72. In work item 251-31-001 it is unclear if contractor is required to ship removed louvers , in accordance with 3.6 009-32 including Table 2, Line 24, to identified vendor for powder coating or to simply store, reinstall, and repair per section 10 of ref 2.5 63125-001. What is the correct interpretation of this scope?
A. Para 3.6 of Work Item 251-31-001 requires preservation/Powder Coating of the Louvers. Work Item modified to clarify para 3.6 via Errata 6, which was distributed with Amendment 3.
73. The reference listed in Work Item 463-80-001, Paragraph 2.5 is not available at SERMC Tech Library. Will the Government please provide the reference listed in paragraph 2.5?
A. Work Item 463-80-001 has been modified to correct ref 2.5 via Errata 6, the correct reference is GXPS-GI-001 Rev D, Chg 0, Installation Guide for Routing AN/SQS-53C Stave Cable Assembly Pigtail Cables and TR-343 Transducer Element Cables. The errata was distributed with Amendment 3.
74. The reference listed in Work item 512-90-003, Paragraph 2.13 is not available at SERMC Tech Library. Will the Government please provide the reference listed in paragraph 2.13?
A. Paragraph 2.13 reference in Work Item 512-90-003 has been corrected via Errata 6; the correct reference number is “RLAR 74012/DDG80/1159937, Upsize Cooling Coil 21 & 24 Chilled Water Root Piping from 1-1/2" to 2" to repair high velocity” and has been provided for distribution. The errata was distributed with Amendment 3.
75. The requirements of item 541-90-001, paragraph 3.1 through 3.5 specifically identifies a contractual scope of work required for the executing contractor to accomplish. However, the non-contractual paragraphs of 4.1 through 4.5 lead the contractor to presume that there are portions of the 3.1 through 3.5 requirements being accomplished by other entities. In order to ensure the Government is not incurring pricing for a scope of work that is going to be accomplished by an AIT, the item must be revised.
If the intent of this item is for the contractor to only accomplish partial requirements, will the Government please revise the contractual requirements of 3.1 through 3.5 and identify the specific scope of work (Reference, Plan View, Elevation, Detail, Test Note, Etc…) that is being accomplished by the executing contractor?
A. In accordance with 4-E definition, Paragraph 4 of the Work Item are notes and contain information or explanations that do not lend themselves to inclusion in the requirements. These notes shall not place requirements on the contractor.
It is important to note that there are many Split Responsibility Work Items, (WI) in this Solicitation Package. In accordance with 4-E definition, Paragraph 3 of the Work Item provides the requirements that the Executing contractor shall complete. For these Work Items, Paragraph 4 provides Government Furnished Information (GFI), which describes elements of the WI that an outside activity shall accomplish, as well as testing and coordination information.
Accordingly, for Work Item 541-90-001, the contractor is expected to perform all requirements of paragraphs 3.1 through 3.5.
76. Will the Government please specify the amount and type of ‘medical solid waste’ to be disposed (e.g. Sharps/Infectious Waste, no controlled substances), and required frequency of disposal pick-up?
A. Para 3.21.4 deleted from Work Item 992-11-002 via Errata 6 due to undefined requirement. The errata was distributed with Amendment 3.
77. Solicitation Sect L, p. 92 states the Government will “use the Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2.”
Per the Department of Defense “Lowest Price Technically Acceptable Source Selection Process”, [Appendix C of “Department of Defense Source Selection Procedures” memorandum dated April 01, 2016]: “When standards of performance and quality are subjective...another approach should be used.” It further requires that “(t)he evaluation factors and subfactors shall be set forth in the solicitation in enough depth to communicate what will be evaluated” and “(t)hese factors and subfactors will identify the minimum requirements that are key to successful contract performance.”
Solicitation p. 97, section L, Factor 2 – Technical Capabilities instruct the offeror to “demonstrate experience” for five different elements; as written, evaluation of whether an offeror’s “demonstrate(d) experience” was sufficient could only be subjective. This is contrary to the DOD requirement for the LPTA approach.
Solicitation p. 98, section L, Factor 4 – Resource Capabilities instructs the offeror to provide schedules and a detailed narrative numerous elements; as written, evaluation of whether an offeror’s “resources” were sufficient could only be subjective. This is contrary to the DOD requirement for the LPTA approach.
Solicitation p. 105, section M, Factor 2 – Technical Capabilities fails to identify “the minimum requirements that are key to contract performance” as required by DOD.
Solicitation p. 105, section M, Factor 3 – Past Performance fails to identify “the minimum requirements that are key to contract performance” as required by DOD.
Solicitation p. 106, section M, Factor 4 – Resource Capacity fails to identify “the minimum requirements that are key to contract performance” as required by DOD.
Solicitation p. 106, section M, Factor 4 – Resource Capacity requires offeror to “clearly demonstrate that it has access to the required facilities and manpower required to execute” without specifying what those facilities or manpower should be; this contradicts the DOD requirement.
Will the Government modify the source selection criteria for this solicitation to bring it into compliance with the procedures required by DOD?
A. The Government has determined that LPTA source selection procedures are appropriate for the current requirement. The source selection procedures shall not be modified as a result of this bidder’s question.
78. Solicitation Sect L, p. 92 states the Government will “use the Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2.”
Per the Department of Defense “Lowest Price Technically Acceptable Source Selection Process”, [Appendix C of “Department of Defense Source Selection Procedures” memorandum dated April 01, 2016]: “LPTAs may be used in situations where the Government would not place any value on a product or service exceeding the Government’s threshold technical or performance requirements and these requirements can be objectively defined in measurable terms. Such situations include acquisitions of commercial or non-complex services or supplies which are clearly and objectively defined.
Solicitation p. 106, section M, Factor 4 – Resource Capacity states that this work contains “highly complex” requirements, which clearly indicates that the use of LPTA procedures in this case is in violation of the DOD directive.
Will the Government modify the source selection criteria for this solicitation in a manner consistent with the “highly complex” nature of the services to bring it into compliance with the procedures required by DOD?
A. The Government has determined that LPTA source selection procedures are appropriate for the current requirement. The source selection procedures shall not be modified as a result of this bidder’s question.

As of 08 November 2016, the Government has not provided the references listed above. Without these references, the contractor is unable to determine the level of effort, scope, vendor requirements and subcontractor requirements. The current proposal due date of 02 December 2016 is not going to be sufficient for the contractor to provide a proposal, considering there are still requirements that are not currently disclosed to the contractors with the references that have not been distributed to bidders. Will the Government please provide the references listed above and provide an extension of the bid date of at least 20 days to 22 December 2016, to provide the bidders time to review, solicit vendors/subcontractors and submit a proposal that is not restricting competition and advantageous to the Government?
