DEPARTMENT OF THE NAVY

NAVAL SEA SYSTEMS COMMAND

1333 ISAAC HULL AVE, SE

WASHINGTON NAVY YARD, DC 20376-0001 IN REPLY TO

J&A Number: 41,209 Code: SEA 0244

P.R. Number: N00024-15-NR-93030

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Fleet Support Contracts Division (SEA 024).

2. Description of the Action Being Approved

This is a brand name justification for work to be provided in support of the USS PAUL HAMILTON (DDG 60) FY16 EDSRA under the following Work Items (WI) contained as a reference to RFP number N00024-16-R-4400:

165-11-001, B.F. Goodrich Technical Representative 243-11-001, Wartsila technical representative 245-11-001, on-site authorized Rolls Royce technical representative 245-12-001, on-site authorized Rolls Royce technical representative 245-12-002, on-site authorized Rolls Royce technical representative 245-12-003, on-site authorized Rolls Royce technical representative 551-51-001, qualified on-site Dresser-Rand technical representative 551-52-001, qualified on-site Dresser-Rand technical representative 562-11-002, qualified Wartsila Lips Inc. technical representative

This justification pertains only to those portions of the acquisition, for which an Original Equipment Manufacturer (OEM) service representative is required.

3. Description of Supplies/Services

NAVSEA requires Original Equipment Manufacturer (OEM) service representative to perform the Work Items listed in paragraph 2. The estimated dollar value of the supplies and service covered by this justification is $800K, which will be funded with FY16 Operations & Maintenance funds.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C 2304 (c)(1), Only One Responsible Source or a Limited Number of Responsible Sources and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).

J&A Number: 41,209

5. Rationale Justifying Use of Cited Statutory Authority

a. 165-11-001, Sonar Dome Rubber Window (SDRW); inspect and repair

B.F. Goodrich is the sole source qualified to conduct inspections and repairs on the sonar dome rubber window that were originally manufactured by B.F. Goodrich for U.S. Navy Destroyers. Ensuring an accurate inspection of the sonar dome and follow on repairs is vital to the operations and capabilities of USS PAUL HAMILTON (DDG 60).

b. 243-11-001, Stern Tube Shaft Seal; overhaul

Wartsila is the only authorized contractor to remove, inspect, repair and install stern tube shaft seals that were originally manufactured by Wartsila on U.S. Navy Destroyers. Ensuring proper alignment of the stern tube seals is vital to Operational commitments after the EDSRA and the safety of the crew. Flooding of the ship and damage to shipboard equipment could occur if the seals are defective or otherwise malformed.

c. 245-11-001, Controllable Pitch Propeller (CPP) Blade; inspect and repair

The OEM for the vessel’s CPP system is Rolls-Royce. Rolls-Royce is the only qualified contractor to work on the CPP system’s hubs and blades. OEM parts are required for all critical equipment on board DDG 51 class ships. Failure of one OD Box would cause the loss of one shaft about USS PAUL HAMILTON, reducing speed and putting the ship at risk with no redundancy in shafts. If two hubs failed, the ship would be dead in the water and face extreme risk to the rolling of the ship.

d. 245-12-001, Controllable Pitch Propeller (CPP) Oil Distribution Box; replace

The OEM for the vessel’s Controllable Pitch Propeller Oil Distribution (OD) Box is Rolls-Royce Naval Marine, Inc (formerly Bird-Johnson Company). Rolls-Royce is the only qualified contractor to work on the OD Box. OEM parts are required for all critical equipment on board DDG 51 class ships. Failure of one OD Box would cause the loss of one shaft about USS PAUL HAMILTON, reducing speed and putting the ship at risk with no redundancy in shafts. If two OD Boxes failed, the ship would be dead in the water and face extreme risk to the rolling of the ship.

e. 245-12-002, Controllable Pitch Propeller (CPP) System, Propeller Hub; replace qualified contractor to work on the CPP system’s Hubs. OEM parts are required for all critical equipment on board DDG 51 class ships. Rolls-Royce possesses all the special tools, documentation and skills to replace the hubs.

f. 245-12-003, Controllable Pitch Propeller (CPP) Prairie Air Tube, and Valve Rod Assembly; repair and test qualified contractor to work on the CPP system’s Prarie Air tube and Valve Rod Assembly. OEM parts are required for all critical equipment on board DDG 51 class ships. Rolls-Royce possesses all the special tools, documentation and skills to repair and replace equipment as needed.

g. 551-51-001, Number One High Pressure Air Compressor (HPAC) Class B

Overhaul; accomplish

The OEM for the equipment is Dresser-Rand. Dresser-Rand is the only contractor with the material required to conduct a Class B Overhaul for an HPAC. Dresser-Rand does not supply other contractors with the proprietary material to conduct overhauls and therefore must be done through the OEM.

h. 551-52-001, Number 2 High Pressure Air Compressor (HPAC) Class B Overhaul;

accomplish

The OEM for the equipment is Dresser-Rand. Dresser-Rand is the only contractor with the material required to conduct a Class B Overhaul for an HPAC. Dresser-Rand does not supply other contractors with the proprietary material to conduct overhauls and therefore must be done through the OEM.

i. 562-11-002, Rudder Bearing Seal and Rudderstock Seal; repair

Wartsila is the only authorized contractor to remove, inspect, repair and install Rudder Bearing and Rudderstock Seals that were originally manufactured by Wartsila onboard U.S. Navy Destroyers. Ensuring proper repairs of the seals is vital to Operational commitments after the EDSRA and the safety of the crew. Flooding of the ship and damage to shipboard equipment could occur if the seals are defective or otherwise malformed.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract to the lowest price, technically acceptable offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the related WIs. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5, for any company other than the OEM or OEM authorized vendor(s) to perform the work in the related WIs.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.

8. Actions to Remove Barriers to Competition

For reasons set forth in Paragraph 5, NAVSEA has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, NAVSEA will assess whether competition for future requirements is feasible.
