Maintenance Bond for City of Carmel
This is a Maintenance Bond template issued by the City of Carmel, Indiana, for use by successful bidders on public improvement projects. The bond requires the contractor to warrant all workmanship and materials used in construction, installation, and completion of work in accordance with the contract documents and all applicable local, state, and federal laws and regulations. The contractor and surety company are jointly and severally bound to the City of Carmel for a penal sum to be specified, guaranteeing against defective materials and workmanship. The maintenance period extends for three (3) years following acceptance of the work for public maintenance, during which the contractor must make all necessary repairs or replacements at its own expense resulting from improper or defective workmanship, materials, or failures to conform to contract provisions. Any repairs or replacements made under the bond remain subject to the same terms and conditions.
The surety company executing the bond must appear on the current U.S. Treasury Department Circular 570 list of "Surety Companies Acceptable on Federal Bonds" and be authorized to transact business in Indiana. The bond date must not be prior to the contract date. If the contractor is a partnership, all partners must execute the bond. The form requires completion of standard contractual information including contractor name, surety company details, penal sum amount, contract date, project name, number, and description. The bond serves as a guarantee mechanism specific to the City of Carmel's public improvement projects and must be executed in counterparts as specified.
