SECTION B

Section B - Supplies or Services and Prices

B.1 General Information

This is a Firm Fixed Price (FFP) base effort to perform system modification and installations to 7

CCS systems, as well as the option(s) to perform Contract Logistic Support (CLS) and Post

Deployment Software Support (PDSS) after initial installation.

B.2

This Contract is Full and Open and falls under NAICS CODE 541511.

B.3 Performance Based Requirements

As a FFP Performance Based Requirement, the contractor is required to meet all contract performance requirements, and if the requirements take more staffing than proposed (without a change requested by the Government), the contractor is required to provide additional staffing, at no increase in price, until all contract performance requirements are satisfactorily met. Failure to comply could result in a Termination for Default.

B.5 Indirect Rates

Travel and ODC costs may be burdened with the Contractor’s indirect rate in accordance with the Contractor’s disclosed practices and the applicable DFARS:

If no indirect rate is allowable in accordance with the Contractor’s disclosed practices, no indirect rate shall be applied to or reimbursed on these costs.

If no rate is specified in the contract award, no indirect rate shall be applied to or reimbursed on these costs.

B.6 Government Furnished Property

The Government intends to provide all parts within the existing 7 CCS Systems as Government

Furnished Property (GFP) in the Modification Effort. However, the specific parts to be utilized is based on specifics and individual approaches within the proposals of each Offeror, and the

Government cannot provide a current/exact list of GFP at time of solicitation. With that said, based on the successful offeror’s proposal, a list of GFP will be finalized and incorporated into the contract as an Attachment upon time of award.

All efforts shall be performed in accordance with the all Attachments in Section J.

The Contractor’s Technical Proposal, as negotiated and accepted by the Govenrment will be incorporated, in part or whole, into the resultant contract.

Any specific portions of the Contractor's technical proposal that exceed any of the Government's requirements (including, but not limited to dates, performance values, and/or any other measurable criteria) are hereby incorporated by reference with the same force and effect as if they were given in full text, and supersede the Government's threshold requirements that were exceeded and/or the Government's objective requirements that were met and/or exceeded.

D-1. Packaging and Marking of Hardware- All supplies/deliverables hereunder shall be prepared, packaged, and marked in accordance with current ASTM (see SOW) and best commercial practices to ensure safe delivery at destination unless otherwise specified in any resulting modifications. Any supplies that may require delivery overseas shall be packaged and marked in accordance with current Military Standard (see SOW).

D-4. Warranties: The contractor shall stamp or mark the supplies delivered or otherwise furnish notice with the supplies of the existence of the warranty. The purpose of the markings or notice is to inform Government personnel who store, stock, or use the supplies that the supplies are under warranty. Markings may be brief but should include:

(a) A brief statement that a warranty exists,

(b) The substance of the warranty

(c) The date or time the warranty expires

(d) Who to notify if the supplies are found to be defective. For commercial items (see 46.709), the contractor’s trade practice in warranty marking is acceptable if sufficient information is presented for supply personnel and users to identify warranted supplies.

(e) Any National Stock Number (NSN) or manufacturer's part number,

(f) A serial number or other item identifier (if the warranty applies to uniquely identified items)

(g) The contract number,

(h) The manufacturer or entity (if other than the contractor) providing the warranty

(i) An indication of whether or not attempted on-site repair by Government personnel will void the warranty.

Government as specified in accordance with the applicable DD 1423’s. Technical Data will be inspected and accepted as indicated in Block (7) of each Exhibit as follows:

1. Data items submitted under Letter of Transmittal (LT) shall be the responsibility of the initial addressee under Block 14 of the DD Form 1423 as to review for adequacy and contract compliance. Where Code A is entered in Block 8 of the DD Form 1423 and deficiencies or inadequacies are noted, the initial addressee shall so advise the Contractor in writing.

2. Inspection and acceptance of the Data Items requiring shipment under DD Form 250 shall be made in accordance with Block 7 of the DD Form 1423. Destination shall be by the first listed

Block 14 addressee. Addressees other than the initial addressee shall be considered informational. Codes are further explained below:

3. Unless otherwise specifically stated in the applicable DD Form 1423, or associated Data Item

Description (DID), the Government must provide written comment, rejection or acceptance to the Contractor within thirty (30) days after receipt of each data submission.

(a) Subject to DFARS 252.246-7001, Warranty of Data, Government comments on the initial data submission shall be complete and shall not be expanded subsequently. Recurring or new defects in subsequent submissions shall, of course, be the subject of fair comment.

(b) The contractor shall notify the Government in writing (PCO) if the Government is at risk of failing to meet the applicable review/approval time requirements.

E-3.2. Responsibilities- Inspection and acceptance of contract deliverables are the responsibility of the COR or his/her duly authorized representative(s) except as otherwise specified in the contract. Moreover, the COR serves in a supporting role to the Contracting Officer, providing advice and expertise on technical issues. b) In accordance with the Statement of Work (SOW), changes to the modification, installation, and delivery schedule and/or order may be directed by the Government at no additional cost to the Government prior to TRR.

F-3. Contractor Notice Regarding Late Delivery- In the event the Contractor for any reason anticipates or encounters difficulty in complying with the contract delivery schedule or in meeting any of the other requirements of the contract, it shall immediately notify the Contracting

Officer in writing giving pertinent details and shall provide a proposal for planned compensation.

However, this data shall be considered informational only in character and receipt by the

Government shall not be construed as a waiver by the Government of (a) any delivery schedule or date, or (b) compliance with any other contract requirement by the Contractor, or (c) any other rights or remedies provided to the Government by law or under this contract.

F.4 Performance Delivery:

Currently all Performance/Delivery for USMC CLINS are predicated on Contract Award of 01

April 2018. Any slippage in award day will affect a day for day slip in the schedule presented, and will be adjusted upon award to reflect said change:
