Attachment J34 – Affidavit, Combat Convoy Simulator Request for Proposal M67854-17-R-7832 and
Subsequent and Related Contract Award
I am submitting this affidavit as part of a proposal in response to the Combat Convoy Simulator (CCS)
Request for Proposal M67854-17-R-7832 (the RFP). In the event that
_________________________________ (insert company name) (the Company) is awarded the contract in response to this RFP, the Company will comply with all applicable Federal and State firearms laws, including obtaining all licenses required by the United States Government and any state or local government to perform the work described in the RFP (including, but not limited to, System
Performance Specification paragraph 3.3.2.4, entitled “Weapon System;” Statement of Work paragraph
3.3.1.3 entitled “PAC Exit Criteria;” and Statement of Work paragraph 3.4.1.2.1 entitled “CDR Entrance
Criteria”). The Company has had ample time to review the RFP and research the requirements to comply with laws and obtain any licenses it may need to successfully perform the work in accordance with the schedule it proposed. The Company agrees not seek any request for equitable adjustment to extend the timeline for performance or to be paid additional monies solely as a result of the Company’s efforts to comply with Federal or State firearms laws. For clarification, this includes the Company’s inability to obtain or timely obtain a Federal Firearms License. The Company is not relying upon any assistance from the United States Marine Corps in order to comply with Federal or State firearms laws.
The Company further acknowledges that the Government considers any negative impact on the performance of the contract resulting from the Company’s failure to comply with Federal or State firearms laws (including, but not limited to, a delay in obtaining - or failure to obtain - a Federal Firearms
License) to constitute a failure to perform a material term of the contract. In such case, the Government may exercise any right it has, including withholding payment for services not fully performed or terminating the contract for default.
This signed affidavit shall be included as an attachment to the contract.
