Consolidated Storage Program (CSP) Operations Contract Questions from Industry/Draft Solicitation Questions

Questions submitted via email from posting of Draft Solicitation M67004-20-R-0012:

1. By site you need to be at 98% of serialized items, is the Contractor financially liable for the items below those percentages by site? The RFP states the Contractor shall be at least 98% on schedule over the period of performance of the inventory by facilities IAW the Contractors Physical Inventory Control Plan (CDRL A010). Draft RFP page 38, in section 3.3.5 Physical Inventory Control Program.

Answer: Yes, the Contractor may be financially liable for the items below those percentages by DoDAAC. This will be determined by the KO to validate whether culpability exists on the part of the Contractor. The AQL for Section 3.6 in Section 9 of the PWS has been updated to reflect the requirements of Section 3.3.5 of the PWS (Controlled items 100%; Non-controlled items 98% Accuracy). Controlled items includes serialized and pilferable items.

2. PWS paragraph 2.5 states, “The minimum workforce required is 360.” Please clarify whether offerors must propose 360 FTEs in order to be compliant with the solicitation. Draft RFP, Page 27.

Answer: Yes, the minimum workforce required is 360. This is a technical evaluation factor.

3. If 360 FTEs must be proposed to be compliant with the solicitation, will the government provide historical hours, job classifications by site? Draft RFP, Page 27.

Answer: No. See Attachment 22 for estimated labor hours for Mission Support. Attachment 22 is not all inclusive. The remaining labor categories are determined by the Contractor based on performing the tasks required in PWS Section 3.

4. Regarding labor categories, will the government provide the wage determination classification of the required job title? Draft RFP, Page 27.

Answer: No. The only labor categories provided are in PWS Section 2.5 and Attachment 22, Pricing Workbook.

5. Minimum qualifications for key personnel include a bachelor’s degree from a US accredited college or university. We request that the government allow for an additional equivalent level of relevant work experience in lieu of a degree. Draft RFP, Page 28.

Answer: No, the minimum qualification requirements for key/essential personnel will not be changed.

6. The School of Infantry East is assigned a Site Manager, however there is not a Site Manager for School of Infantry West. Please clarify. Draft RFP, Page 30.

Answer: Not required because SOI-West is not currently part of the CSP; therefore, it is not incorporated into this solicitation.

7. As some MHE is only electric, will the government allow the contractor to provide chargers? Draft RFP, Page 32.

Answer: It depends, coordination must be done through the CSP PMO prior to installing any chargers.

8. Regarding Phase-In, paragraph 4.4.1 states, “A 100% count of the entire inventory of GFP (Attachments 19A and 19B) at existing CSP facilities (Attachments 1A and 1B). This inventory is not part of the commodities listed in the baseline inventory in DPAS. The Government will take control of this inventory from the incumbent and then provided to the new Contractor on Day 1 ready (Start of Work). The inventory must be completed by Day1 Ready.” Our assumption is this is a joint inventory with awardee, incumbent, and government, however the statement that the government will take control of inventory and then provide to new contractor creates uncertainty. Please clarify. Draft RFP, Page 49.

Answer: A 100% count of the entire inventory of GFP (Attachments 19) at existing CSP facilities (Attachments 1A and 1B). This inventory is not part of the commodities listed in the baseline inventory in DPAS-WM. The Government will inventory the GFP with the incumbent, take control of this inventory from the incumbent and then inventory with the awardee during the phase-in period. The GFP will be provided to the new Contractor on Day 1 Ready (Start of Work).

9. The clause states, “The offeror shall provide with its offer a written plan describing how it will continue to perform the essential contractor services listed in Attachment 3 of the PWS.” Our assumption is that the MECS Plan should be included in Binder I, Section 3 – Mission Support Approach. Please clarify. Draft RFP, Page 89

Answer: The MECS Plan will be included in Binder V and incorporated into the contract upon award.

10. Regarding insurance, will the government pay/reimburse the additional cost for insurance for working overseas? Draft RFP, Page 91

Answer: No, the government will not pay/reimburse for insurance for work overseas.

11. FAR 52.222.17 Pg. 82, subpara (c) (1) Non displacement of Qualified Workers In solicitations and contracts for (1) service contracts (2) that succeed contracts for performance of the same or similar work at the same location and (3) that are not exempted by 22.1203-2 or waived in accordance with 22.1203-3. Question: Will this clause be removed with the revocation by the current administration in November 2019? Ref: 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (OCT 2019)

Answer: Presently, the clause will not be removed. The Case Number 2020-001 (EO) Revocation of Executive Order on Nondisplacement of Qualified Workers is currently an open FAR Case. If this FAR Case is finalized and changes are required to this solicitation, the Government will issue an amendment. FAR 52.212-5 will be updated to the JAN 2020 version.

12. FAR 52.222-55 Pg. 82 subpara (c)(8) Minimum wages Under Executive Order 13658.

On September 19, 2019, the Department of Labor published a Notice in the Federal Register to announce that, beginning January 1, 2020, the Executive Order 13658 minimum wage rate is increased to $10.80 per hour (84 FR 49345). This Executive Order minimum wage rate generally must be paid to workers performing work on or in connection with covered contracts.

Question: For States (like California) where the state’s minimum wages are significantly higher than the wages for labor categories to be used under the current DOL AWD in the solicitation, will the government adjust the labor rates to match the rates of the respective states where the services are to be performed? This is important when competing for qualified talent in the local labor markets.

Answer: No, FAR 52.222-55(b)(8) states: “Nothing in this clause shall excuse the Contractor from compliance with any applicable Federal or State prevailing wage law or any applicable law or municipal ordinance establishing a minimum wage higher than the E.O. minimum wage. However, wage increases under such other laws or municipal ordinances are not subject to price adjustment under this subpart.” The Government recommends the offerors read FAR 52.222-55 in its entirety.

13. The transition period will be 2 months. The transition period is bulk funded and firm-fixed price (FFP). Question: Inasmuch as there are 21 locations to Transition, to include the III MEF location in Okinawa, this does not appear to be sufficient time to properly obtain necessary clearances and rebadge over 350 personnel, as called for in the RFP. Clearly this requirement can only be accomplished by the incumbent. Will Government consider doubling that time to 120 days? Ref: Section 2 General Information, Paragraph 2.0 on page 20.

Answer: No, the Government will not double the time to 120 days. The transition period is 2 months.
