EXECUTIVE SUMMARY
The Puerto Rico Highway & Transportation Authority (PRHTA), as part of their project AC- 818544 / AC-812544 “Emergency relief program: landslides & road damages-evaluation repairs”, requested a Lead Based Paint (LBP) survey. The project is located at following PR road’s segments as indicated in Attachment 1.0 (Location Maps):
The assessment was conducted by Nortol Environmental & Occupational Safety, Inc., under agreement with Integra Design Group (IDG) as PRHTA representative. The field work was executed within October 25 and November 1st, 2019 & October 17, 2020 in coordination with Ms. Luz M. Rodríguez from IDG.
The XRF-readings shown that metal safety guardrails from segments at PR-162 (km 6.20) Aibonito and PR-155 (km 35) Morovis are positive to Lead-based Paint. The established threshold for the classification of painted components as lead bearing per federal and local regulations is 1.0 mg/cm². Other guardrails and components are negative to LBP or are unpainted. Representative pictures are included as Attachment 2.0

I. INTRODUCTION
A. Lead-based Paint background
Lead is one of the most common over exposure found in industry. It is also a major potential public health risk. Lead poisoning is a leading environmentally induced illness in children. At greatest risk are children under the age of six because they are undergoing rapid neurological and physical development. In general population, lead may be present at hazardous concentrations in food, water, and air. Sources include lead-based paint, urban soil, and dust, and drinking water.
Lead is commonly added to industrial paints because of its characteristic to resist corrosion.
Industries with particularly high potential exposures include construction work involving welding, cutting, brazing, blasting, etc., on lead paint surfaces; most smelter operations either as a trace contaminant or as a major product; secondary lead smelters where lead is recovered from batteries; radiator repair shops; and firing ranges. Oral ingestion may represent a major route of exposure in contaminated workplaces. Once in the blood, lead is distributed primarily among three routes - blood, soft tissue (kidney, bone marrow, liver, and brain) and mineralizing tissue (bones and teeth).
B. Survey Purpose and Scope
The purpose of this survey was to locate and identify if Lead-based Painted components are present in the PRHTA project AC-818544 / AC-812544 “Landslide and Road Evaluation and Repairs Recommendations”. The scope of work for this project consisted of the following tasks:
Review the information for proposal as provided by the client;
Coordinate field work with the client’s representative;
Achieve inventory of painted surfaces (guardrails, pavement parking and concrete barriers as apply);
Select locations to be tested;
Perform XRF testing;
Review and evaluate the data;
Report findings.

II. REGULATORY REVIEW
Hazard of lead in paint has been defined by the Department of Housing and Urban Development as 1.0 mg/cm2 as measured by an XRF instrument, or Atomic Absorption Spectroscopy (AAS);
or 0.5% by weight (or 5,000 ppm) as measured by AAS, or Inductive Coupled Plasma (ICP).
The same level was adopted by EPA regulations published in 1992, under Title X and by local regulation.
Although Occupational Safety and Health Administration (OSHA) regulations for occupational lead exposure have been in effect since 1971 for the construction and general industries, the agency recognized the need to provide better protection and revised the regulations for general industry in 1978. The 1978 lead standard, however, excluded the construction industry from coverage because of insufficient information regarding lead use in construction.
In 1990, the National Institute for Occupational Safety and Health (NIOSH) set a national goal to eliminate worker exposures resulting in blood lead concentrations greater than 25 micrograms per deciliter (25 µg/dl) of whole blood. Consequently, OSHA began developing a proposal for a comprehensive standard regulating occupational exposure to lead in construction. In October 1992, the Congress passed Section 1031 of Title X of the Housing and Community Development Act of 1992 (P. L. 102-550) requiring OSHA to issue an interim final lead standard for the construction industry, effective until OSHA issues a final standard.
The interim final rule, published on May 4, 1993, amends the OSHA standards for occupational health and environmental controls in Subpart D of Title 29 Code of Federal Regulations (CFR) 1926 by adding a new section 1926.62, containing employee protection requirements for construction workers exposed to lead.
On July 1998, the PR Departamento de Recursos Naturales y Ambientales-former PR Environmental Quality Board regulations regarding to Lead Based Paint was created to issue activity permits, accredit institutions, and certificate persons involved in Lead Based Paint activities in Puerto Rico. Local regulations require all lead to be managed as a special waste.
On August 2019 this regulation was replaced by the new Reglamento para el Manejo Adecuado de Actividades de Pintura con Base de Plomo. To obtain a demolition permit in Puerto Rico is necessary to includes a certification (OGP-PGC-010 or equivalent) stating that there is no lead-based paint in the project.

III. SURVEY DESIGN & METHODOLOGY
Inspection scope and schedule was coordinated with Luz M. Rodríguez from Integra Design Group as PRHTA representative to be conducted within specific days/hours.
The applicable guardrails, pavement marks and concrete barriers in the project scope areas were inspected for LBP. The survey was performed following applicable current regulations leading accredited inspections in Puerto Rico. The technique used for the assessment of the painted components was the XRF instrument model VIKEN (former HEURESIS) with serial number 2279. Portable XRF instruments expose a component to X-ray or gamma radiation, which causes lead to emit X rays with a characteristic frequency or energy. The intensity of this radiation is measured by the instrument. The XRF instrument was set at Standard Paint Mode showing reading “Positive” or “Negative” with a 95% confident reading. The result is reported in mg/cm2.
IV. Lead Based Paint Survey Results
By definitions set forth in 24 CFR Part § 35.86: “Lead-Based Paint (LBP) means paint or other surface coatings that contain lead equal to or in excess of 1.0 milligram per square centimeter or 0.5 percent by weight.”
At the PRHTA project AC-818544 / AC-812544 “Landslide and Road Evaluation and Repairs Recommendations”, Group A (PR-162-Aibonito Kms 4.5, 4.70, 6.20; PR-155-Morovis km 35.0;
PR-514-Villalba Km 2.60, the metal safety guardrails from the segments described in Table 2.0 were found to contain lead-based paints at or above current PR regulatory limit of 1.0 mg/cm2.
The XRF-instrument’s readings were between 1.2 and 9.4 mg/cm2. Some of metal barriers have only the remnants of yellow paint. The XRF readings are tabulated in the Attachment 3.0.
Other guardrails or components are negative to LBP or are unpainted. See Attachment 4.0 for the PGC-010 (no LBP presence applicable certifications).

V. Conclusion and Limitations
The following options are promulgating by the PR Departamento de Recursos Naturales y Ambientales - former PR Environmental Quality Board regulations and/or the US Environmental Protection Agency (EPA):
- A Lead-Based Paint mitigation project shall be conducted prior to any demolition when lead is present in painted components. The LBP abatement project shall be in accordance with new PR DRNA (former Environmental Quality Board) applicable regulations. This requirement is particularly applicable to concrete components.
- Federal and local regulation provides that steel (or metal) structures with Lead-based Paint be considered as recycling material. Scrap metal is a relatively easy waste to recycle. Many operators have found that scrap metal recycling companies will collect and remove materials such as tanks, drums, and other types of scrap metal from the lease.
Additional consideration should be given to the associated regulatory requirements.
Scrap metal that is recycled is not subject to hazardous waste regulations; but it can be considered hazardous waste if disposed.
The results, findings, and conclusions expressed in this report are based only on conditions that were noted during the Nortol’s assessment of the PRHTA project AC-818544 / AC-812544 “Landslide and Road Evaluation and Repairs Recommendations”, Group A (PR-162-Aibonito Kms 4.5, 4.70, 6.20; PR-155-Morovis km 35.0; PR-514-Villalba Km 2.60 within October 25 and November 1st, 2019. Any conditions or materials that could not be visually identified on the surface were not inspected and may differ from those conditions or materials noted. It was not within the scope of the inspection to remove surface materials to investigate portions of the structure or materials that lay beneath the surface. Nortol’s selection of reading locations and frequency of readings was based on Nortol’s observations and the assumption that like components in the same area are homogeneous in paint content.
The report is designed to aid the building owner, architect, construction manager, general contractors, and potential lead abatement contractors in locating lead-based paint. The abatement bidders are responsible for visiting the project to confirm the estimated amounts.
See Attachment 5.0 for company, personnel, and instrument’s certifications.
I certify that the subject project was done in accordance w ith current applicable regulations and that the information included in this report is true.

BACKGROUND INFORMATION
EVALUATION DATA SOURCE AND DATE:
This sheet is supplemental information to be used in conjunction with Chapter 7 of the HUD Guidelines for the Evaluation and Control of Lead-Based Paint Hazards in Housing ("HUD Guidelines"). Performance parameters shown on this sheet are calculated using test results on building components in the HUD archive. Testing was conducted on 146 test samples in November 2015, with two separate instruments running software version 2.1-2 in Action Level test mode. The actual source strength of each instrument on the day of testing was approximately
2.0 mCi; source ages were approximately one year.
OPERATING PARAMETERS
Performance parameters shown in this sheet are applicable only when properly operating the instrument using the manufacturer's instructions and procedures described in Chapter 7 of the HUD Guidelines.
XRF CALIBRATION CHECK:
The calibration of the XRF instrument should be checked using the paint film nearest 1.0 mg/cm2 in the NIST Standard Reference Material (SRM) used (e.g., for NIST SRM 2579, use the 1.02 mg/cm2 film).
If the average (rounded to 1 decimal place) of three readings is outside the acceptable calibration check range, follow the manufacturer's instructions to bring the instrument into control before XRF testing proceeds.
SUBSTRATE CORRECTION VALUE COMPUTATION:
Chapter 7 of the HUD Guidelines provides guidance on correcting XRF results for substrate bias. Supplemental guidance for using the paint film nearest 1.0 mg/cm2 for substrate correction is provided:
XRF results are corrected for substrate bias by subtracting from each XRF result a correction value determined separately in each house for single-family housing or in each development for multifamily housing, for each substrate. The correction value is an average of XRF readings taken over the NIST SRM paint film nearest to 1.0 mg/cm2 at test locations that have been scraped bare of their paint covering. Compute the correction values as follows:
Using the same XRF instrument, take three readings on a bare substrate area covered with the NIST SRM paint film nearest 1 mg/cm2. Repeat this procedure by taking three more readings on a second bare substrate area of the same substrate covered with the NIST SRM.
Compute the correction value for each substrate type where XRF readings indicate substrate correction is needed by computing the average of all six readings as shown below.
For each substrate type (the 1.02 mg/cm2 NIST SRM is shown in this example; use the actual lead loading of the NIST SRM used for substrate correction):
Correction value = (1st + 2nd + 3rd + 4th + 5th + 6th Reading)/6 - 1.02 mg/cm2
Repeat this procedure for each substrate requiring substrate correction in the house or housing development.
EVALUATING THE QUALITY OF XRF TESTING:
Randomly select ten testing combinations for retesting from each house or from two randomly selected units in multifamily housing.
Conduct XRF re-testing at the ten testing combinations selected for retesting.
Determine if the XRF testing in the units or house passed or failed the test by applying the steps below. Compute the Retest Tolerance Limit by the following steps:
Determine XRF results for the original and retest XRF readings. Do not correct the original or retest results for substrate bias. In single-family and multi-family housing, a result is defined as a single reading. Therefore, there will be ten original and ten retest XRF results for each house or for the two selected units.
Calculate the average of the original XRF result and the retest XRF result for each testing combination.
Square the average for each testing combination.
Add the ten squared averages together. Call this quantity C.
Multiply the number C by 0.0072. Call this quantity D.
Add the number 0.032 to D. Call this quantity E.
Take the square root of E. Call this quantity F.
Multiply F by 1.645. The result is the Retest Tolerance Limit.
Compute the average of all ten original XRF readings.
Compute the average of all ten re-test XRF readings.
Find the absolute difference of the two averages.
If the difference is less than the Retest Tolerance Limit, the inspection has passed the retest. If the difference of the overall averages equals or exceeds the Retest Tolerance Limit, this procedure should be repeated with ten new testing combinations. If the difference of the overall averages is equal to or greater than the Retest Tolerance Limit a second time, then the inspection should be considered deficient.
Use of this procedure is estimated to produce a spurious result approximately 1% of the time. That is, results of this procedure will call for further examination when no examination is warranted in approximately 1 out of 100 dwelling units tested.
TESTING TIMES:
In the Action Level paint test mode, the instrument takes the longest time to complete readings close to the Federal standard of 1.0 mg/cm2. The table below shows the mean and standard deviation of actual reading times by reading level for paint samples during the November 2015 archive testing. The tested instruments reported readings to one decimal place. No significant differences in reading times by substrate were observed. These times apply only to instruments with the same source strength as those tested (2.0 mCi). Instruments with stronger sources will have shorter reading times and those with weaker sources, longer reading times, than those in the table.
Mean and Standard Deviation of Reading Times in Action Level Mode by Reading Level
Reading (mg/cm2) Mean Reading Time (seconds) Standard Deviation (seconds)
< 0.7 3.48 0.47
0.7 7.29 1.92
0.8 13.95 1.78
0.9 – 1.2 15.25 0.66
1.3 – 1.4 6.08 2.50
> 1.5 3.32 0.05
CLASSIFICATION OF RESULTS:
XRF results are classified as positive if they are greater than or equal to the stated threshold for the instrument (1.0 mg/cm2), and negative if they are less than the threshold.
DOCUMENTATION:
A report titled Methodology for XRF Performance Characteristic Sheets (EPA 747-R-95-008) provides an explanation of the statistical methodology used to construct the data in the sheets, and provides empirical results from using the recommended inconclusive ranges or thresholds for specific XRF instruments. The report may be downloaded at http://www2.epa.gov/lead/methodology-xrf-performance-characteristic-sheets-epa-747-r-95- 008-september-1997.
