About this file
This is a confidentiality determination letter issued by the Arizona Department of Administration regarding Request for Proposal #BPM005385 for Foreign Language Interpretation and Translation Services. The letter, dated January 4, 2024, addresses the offeror Language Connection's submission of documents designated as confidential. The determination outlines the state's assessment of which submitted materials qualify for confidential protection under Arizona Revised Statutes and Administrative Code provisions governing trade secrets and proprietary information.
The Arizona Department of Administration determined that Language Connection's "Method of Approach" documents (Attachment 12) do not qualify as confidential and may be disclosed, as they contain no trade secrets or information not readily ascertainable through public sources. However, the document titled "Confidential - Supplement - 2YrsFinancials.pdf" has been approved for confidential treatment and will be kept confidential. The determination clarifies that standard contract elements such as terms and conditions, pricing, and publicly available information are not considered confidential under state procurement regulations. This determination remains in effect unless subsequently modified or revoked.

Re: Determination of Confidential Documents Request for Proposal #BPM005385 – Foreign Language Interpretation and Translation Services
Dear Allen Antonelli, Proposal documents are designated confidential when the material is proprietary or a trade secret and therefore not subject to disclosure. Per A.A.C. R2-7-101(52), a trade secret is “information, including a formula, pattern, device, compilation, program, method, technique, or process, that is the subject of reasonable efforts to maintain its secrecy and that derives independent economic value, actual or potential, as a result of not being generally known to and not being readily ascertainable by legal means”.
In accordance with A.R.S. § 41-2502 A.A.C. R2-7-10, Written Determinations and the Arizona Procurement Code R2-7-103, Confidential Information, a Procurement Officer shall, upon receipt of an Offeror’s submission of information designated as “confidential” determine whether such submission is confidential or whether the information may be disclosed. The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that the documents listed below may be disclosed. This determination was made because none of these documents contained trade secrets or information that could not be ready ascertainable by a web search, or by legal means.
· Attachment 12 Method of Approach documents
The documents listed below were uploaded and designated “Confidential” in your offer, and we have determined that these documents will be kept confidential.
· Confidential - Supplement - 2YrsFinancials.pdf
Please keep in mind that, in accordance with A.A.C. R2-7-103, contract terms and conditions, pricing, and information generally available to the public are not considered confidential information.
This Determination is effective and shall remain in effect unless otherwise modified or revoked.
