About this file
This is an Exceptions Determination Response document for Solicitation BPM005633, Foreign Language Interpretation and Translation Services, submitted by Language Connection. The document records the offeror's proposed exceptions to the contract requirements and the state's responses to those exceptions as of December 4, 2023. The solicitation covers foreign language interpretation services across multiple service delivery methods and language categories, including Over-the-Phone Interpretation (OPI) and Video Remote Interpreting (VRI) services for Spanish, Core, and Rare languages. Language Connection submitted six exceptions requesting modifications to the pricing structure outlined in Attachment 13 of the RFP.
All exceptions submitted by Language Connection pertained to the implementation of a 15-minute minimum billing requirement with per-minute increment charges thereafter for OPI and VRI services across all three language categories (Spanish, Core, and Rare). The offeror justified this proposed change based on interpreter availability and operational constraints, noting that interpreters would not accept assignments without guaranteed minimum duration due to the risk of minimal time commitment. The state rejected all six exceptions on December 4, 2023, determining that approving a 15-minute minimum would constitute a material change to the contract. Language Connection accepted the state's denial of all proposed exceptions without further objection, indicating the offeror's willingness to proceed under the original contract terms as specified in the RFP.

Spanish Language Services Alternate language: The per-minute rate for OPI Services. Spanish Language Services.
Minimum of 15 minutes. Billed in 1-minute increments after the first 15 minutes.
Rationale: Interpreters will not accept assignments if there is no minimum duration. For example, they will not commit to an assignment with the potential that it may only last a couple of minutes, and thus a 15-minute minimum is required to reserve an interpreter for an assignment.
